Samastipur Muffasil, District Samastipur.\n                                                ------- Petitioner\n                               Versus\nThe State of Bihar                              ------ Opp. Party\n                            -----------\n<\/pre>\n<p>3       20.4.2011             Heard       learned         counsel       for      the<\/p>\n<p>                    petitioner and counsel for the State.<\/p>\n<p>                              The        prayer         for     bail     of     the<\/p>\n<p>                    petitioner was earlier rejected by an order<\/p>\n<p>                    dated 18.9.2009 in Cr. Misc. No. 8268 of 2009<\/p>\n<p>                    with a liberty that he could renew his prayer<\/p>\n<p>                    for bail after expiry of a period of one<\/p>\n<p>                    year.\n<\/p>\n<p>                              Learned      counsel        for   the    petitioner<\/p>\n<p>                    would    submit      that     not    only    the    aforesaid<\/p>\n<p>                    period of one year has been completed but the<\/p>\n<p>                    victim girl has also been examined in course<\/p>\n<p>                    of trial and she has not named the petitioner<\/p>\n<p>                    to be one of the members of the mob, which<\/p>\n<p>                    had allegedly kidnapped her. He would also<\/p>\n<p>                    draw    attention     to    an      order   of     this    Court<\/p>\n<p>                    dated 6.4.2010 in Cr. Misc. No. 36776 of 2009<\/p>\n<p>                    (Suresh Mahto Vs. State of Bihar) to submit<\/p>\n<p>                    that    the   said    co-accused,         whose     case   also<\/p>\n<p>                    stands on the same footing, has been directed<\/p>\n<p>                    to be enlarged on bail.\n<\/p>\n<p><span class=\"hidden_text\">                  2<\/span><\/p>\n<p>          Considering all these aspects as also<\/p>\n<p>the fact that the trial court has observed in<\/p>\n<p>its      order        dated        7.1.2011      that        after<\/p>\n<p>examination           of     the     important       witnesses<\/p>\n<p>including the victim girl and her mother, the<\/p>\n<p>informant, rest of the witnesses, having been<\/p>\n<p>not     turning       up     for    their      evidence,       are<\/p>\n<p>delaying the conclusion of the trial, this<\/p>\n<p>Court     would        direct      for     release      of    the<\/p>\n<p>petitioner, namely, Gopal Paswan on bail on<\/p>\n<p>furnishing       bail      bond     of   Rs.   10,000\/-       (ten<\/p>\n<p>thousand)       with       two     sureties     of   the      like<\/p>\n<p>amount     each       to     the     satisfaction       of     1st<\/p>\n<p>Additional        Sessions         Judge,      Samastipur       in<\/p>\n<p>connection with S.T. No. 83 of 2009 arising<\/p>\n<p>out of Musrigharari P.S. Case No. 87 of 2008,<\/p>\n<p>subject to the following conditions:-<\/p>\n<p>          (i)        The   two      bail    bonds      will    be<\/p>\n<p>furnished, one by the Government servant and<\/p>\n<p>the other by a close family relative.<\/p>\n<p>           (ii)        The       petitioner     will       remain<\/p>\n<p>present in course of trial on each and every<\/p>\n<p>day and his absence even for a single day<\/p>\n<p>would automatically entail the consequences<\/p>\n<p>of cancellation of his bail.\n<\/p>\n<p><span class=\"hidden_text\">                     3<\/span><\/p>\n<p>              (iii) The petitioner in case is now<\/p>\n<p>      made accused in any other criminal case, that<\/p>\n<p>      would   itself     lead    to    cancellation   of   his<\/p>\n<p>      bail.\n<\/p>\n<p>               Subject          to     the     aforementioned<\/p>\n<p>      conditions,       the   prayer     for   bail   of   the<\/p>\n<p>      petitioner is allowed.\n<\/p>\n<\/p>\n<pre>Rsh                                   (Mihir Kumar Jha, J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Gopal Paswan vs The State Of Bihar on 20 April, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.Misc.
