1.\tThe
\npresent appeal, under section 378 (4) of the Code of Criminal
\nProcedure, 1973, is directed against the judgment and order of
\nacquittal dated 2.1.2010 passed by the learned Judicial Magistrate
\nFirst Class, Morbi in Criminal Case No.261 of 1995, whereby the
\naccused have been acquitted from the charges leveled against them.\n<\/p>\n
2.\tThe
\nbrief facts of the prosecution case are as under:\n<\/p>\n
2.1\tThe
\nFood Inspector visited the shop of the original accused –
\nrespondent No.1 herein on 17.3.1994 and he purchased the sample of
\nBlack Pipper Powder Tastee Brand Packed Pocket in the presence of
\npanch witness and after following due procedure, the said sample was
\nstored and sealed. The Food Inspector obtained signature of the
\npanchas in the panchnama, which was drawn at the time of taking
\nsample. Thereafter, he sent the sample to the Public Analyst, Bhuj.
\nAs per the report of the Public Analyst, the said sample of Black
\nPipper Powder Tastee Brand Packed Packet is misbranded and not as per
\nthe provisions prescribed under the Prevention of Food Adulteration
\nAct, 1954. Thereafter, the Food Inspector obtained permission of the
\nLocal Health Authority and filed complaint against the present
\naccused in the Court of learned Judicial Magistrate First Class,
\nMorbi.\n<\/p>\n
2.2\t\tNecessary
\ninvestigation was carried out and statements of several witnesses
\nwere recorded and thereafter, the chargesheet was filed against the
\naccused persons before the court of learned JMFC, Morbi.\n<\/p>\n
2.3\tTo
\nprove the case against the present accused, the prosecution has
\nexamined, in all 2  witnesses  and also produced       documentary
\nevidence.\n<\/p>\n
2.4\tAt
\nthe end of trial,  after hearing arguments on behalf of prosecution
\nand the defence, the  learned trial Judge acquitted the present
\nrespondents of all the charges leveled against them by judgment and
\norder dated 2.1.2010.\n<\/p>\n
2.5\tBeing
\naggrieved by and dissatisfied with the aforesaid judgment and order
\npassed by the trial Court the appellant State has preferred the
\npresent appeal.\n<\/p>\n
3.\tIt
\nwas contended by learned APP that the judgment and order of the trial
\nCourt is against the provisions of law; the trial Court has not
\nproperly considered the evidence led by the prosecution and looking
\nto the provisions of law itself it is established that the
\ncomplainant – Food Inspector has proved the whole ingredients
\nof the evidence against the present respondents. Learned APP has also
\ntaken this court  through the oral as well  as the entire documentary
\nevidences.\n<\/p>\n
4.\tIt
\nis a settled principle that while exercising appellate power, even if
\ntwo reasonable conclusions are possible on the basis of the evidence
\non record, the appellate court should not disturb the finding  of
\nacquittal recorded by the trial court.\n<\/p>\n
5.\tEven
\nin a recent decision of the Apex Court in the case of State
\nof Goa V. Sanjay Thakran & Anr. Reported<\/a> in (2007)3 SCC 75,
\nthe  Court has reiterated the powers of the High Court in such cases.
\nIn para 16 of the said decision the Court has observed as under:\n<\/p>\n
“16.\tFrom
\nthe aforesaid decisions, it is apparent that while exercising the
\npowers in appeal against the order of acquittal the Court of appeal
\nwould not ordinarily interfere with the order of acquittal unless the
\napproach of the lower Court is vitiated by some manifest illegality
\nand the conclusion arrived at would not be arrived at by any
\nreasonable person and, therefore, the decision is to be characterized
\nas perverse. Merely because two views are possible, the Court of
\nappeal would not take the view which would upset the judgement
\ndelivered by the  Court below. However, the appellate court has a
\npower to review the evidence if it is of the view that the conclusion
\narrived at by the Court below is perverse and the Court has committed
\na manifest error of law and ignored the material evidence on record.
\nA duty is cast upon the appellate court, in such circumstances, to
\nre-appreciate the evidence to arrive to a just decision on the basis
\nof material placed on record to find out whether any of the accused
\nis connected with the commission of the crime he is charged with.”\n<\/p>\n
6.\tThus,
\nafter considering ratio laid down by Apex Court in  catena of
\ndecisions and in case the  appellate court agrees with the reasons
\nand the opinion given by the lower court, then the discussion of
\nevidence is not necessary.\n<\/p>\n
7.\tI
\nhave gone through the judgment and order passed by the trial court. I
\nhave also perused the oral as well as documentary evidence led by the
\ntrial court and also considered the submissions made by learned APP
\nfor the appellant-State. The trial court has clearly recorded a
\nfinding that the respondents – original accused were not guilty
\nof the offence punishable under Section 16 of the Prevention of Food
\nAdulteration Act. Even, the respondents have not committed any breach
\nof any provisions of the Act. The respondents purchased the goods
\nfrom accused No.5.  Thus, from the evidence itself it is established
\nthat the prosecution has not proved its case beyond reasonable doubt.\n<\/p>\n
8.\tMr.\n<\/p>\n
Jani, learned APP is not in a position to show any evidence to take a
\ncontrary view of the matter or that the approach of the trial court
\nis vitiated by some manifest illegality or that the decision is
\nperverse or that the trial court has ignored the material evidence on
\nrecord.\n<\/p>\n
9.\tIn
\nthe above view of the matter, I am of the considered opinion that the
\ntrial court was completely justified in acquitting the respondents of
\nthe charges leveled against them.\n<\/p>\n
10.\tI
\nfind that the findings recorded by the trial court are absolutely
\njust and proper and in recording the said findings, no illegality or
\ninfirmity has been committed by it.\n<\/p>\n
11.\tI
\nam, therefore, in complete agreement with the findings, ultimate
\nconclusion and the resultant order of acquittal recorded by the court
\nbelow and hence find no reasons to interfere with the same. Hence the
\nappeal is hereby dismissed. Bail bond, if any, stands cancelled.
\nRecord and proceedings to be sent back to trial Court, forthwith.\n<\/p>\n
