The petition was thereafter Admitted by<br \/>\nthis Court on 29.06.2009 and the ad interim relief granted earlier<br \/>\nwas continued till the final hearing of the petition.\n<\/p>\n<p>3\t\tHeard<br \/>\nMr. P.S. Champaneri, learned Advocate, appearing for the petitioners,<br \/>\nMr. Rashesh Rindani, learned AGP, appearing for the respondents &#8211;<br \/>\nauthorities and Mr. D.N.Pandya, learned Advocate appearing for the<br \/>\nrespondent No. 5 and 6.  Other respondents were served and no<br \/>\nappearance is filed.  It is stated at the Bar that only four months<br \/>\nare left to hold the election of Dabhoi Nagarpalika.\n<\/p>\n<p>4\t\tSince<br \/>\nthe petition is at the notice stage,  normally, this Court does not<br \/>\ninterfere at the notice stage.  However, since the petition is<br \/>\nadmitted and the interim relief is granted, the Court is of the view<br \/>\nthat,  the interest of justice be better served if the respondent<br \/>\nNo.7 is directed to decide the Petition No.37 of 2009  pending before<br \/>\nhim  in accordance with law  and  to  pass appropriate orders  after<br \/>\naffording opportunity of  being heard to  the parties, and if any<br \/>\nadverse  order is passed  against the petitioners,  the same shall<br \/>\nnot be implemented for the period of  two weeks  from the date of<br \/>\ncommunication of such order  to the petitioners.\n<\/p>\n<p>5\t\tConsidering<br \/>\nthe above aspect of the matter, without expressing any opinion on the<br \/>\nsubject mater of this petition and keeping all the rights and<br \/>\ncontentions of the  parties  open,  the present petition is disposed<br \/>\nof  with a direction  to the respondent No.7  to  decide the petition<br \/>\nNo. 37 of 2009 pending before him, after  issuance of notice to the<br \/>\npetitioners  as well as other affected persons and after hearing<br \/>\nthem, to pass appropriate order in accordance with law.  It is<br \/>\nfurther directed that,  if any adverse order is passed against the<br \/>\npetitioners,  the same shall not be implemented for a period of two<br \/>\nweeks from the date of communication of such order.\n<\/p>\n<p>6\t\tWith<br \/>\nthese directions and observations, this petition is accordingly<br \/>\ndisposed of.
