PUBLIC\nPROSECUTOR for the\nRespondent. \n=========================================================\n\n\n \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE DN PATEL\n\t\t\n\t\n\n \n\n\t\t\tDate\n: 04\/07\/2008 \n\n \n\n \n\t\t\t   \nORAL ORDER<\/pre>\n<p>\t\tRule.\n<\/p>\n<p>Learned Additional Public Prosecutor Ms. H.B.Punani waives<br \/>\nservice of notice of Rule on behalf of the respondent-State.\n<\/p>\n<p>2.\t\tThis<br \/>\napplication has been preferred for regular bail under Section 439 of<br \/>\nthe Code of Criminal Procedure,1973, in connection with the offence<br \/>\nbearing C.R.No.I-16 of 2008 registered with Visavadar Police Station<br \/>\nunder Sections 366, 306 and 114 of the Indian Penal Code.\n<\/p>\n<p>3.\t\tHaving<br \/>\nheard the learned counsel for both the sides and looking to the facts<br \/>\nand circumstances of the case, statements of witnesses, gravity of<br \/>\nthe offence, quantum of punishment, the manner in which the<br \/>\napplicants are involved in the offence, as per the allegations of the<br \/>\nprosecution, looking to the statement of the landlord namely<br \/>\nShivabhai Ukabhai upon which the prosecution is mainly relying upon,<br \/>\nit appears that the applicants were residing separately from the<br \/>\naforesaid witness,hardly for few months,the applicants had worked<br \/>\nwith the said witness and  other co-accused have also been enlarged<br \/>\nby this Court vide order dated 12th May, 2008 passed in Criminal<br \/>\nMiscellaneous Application No. 6042 of 2008, coupled with the fact<br \/>\nthat the investigation is already over and charge-sheet is filed and<br \/>\nalso keeping in mind the fact that there is no antecedent of the<br \/>\npresent applicants, this application is allowed. The applicants are<br \/>\nordered to be released on bail in connection with the offence<br \/>\nregistered with Visavadar Police Station bearing C.R.No.I-16 of 2008<br \/>\non each of them  executing a bond of Rs. 5000\/- (Rs. Five thousands<br \/>\nonly) with one surety of like amount to the  satisfaction of the<br \/>\nlower Court and subject to the conditions that they shall,<\/p>\n<p>(a)\tnot<br \/>\ntake undue advantage of their liberty or abuse their liberty;\n<\/p>\n<p>(b)\tnot<br \/>\nact in a manner injurious to the interest of the prosecution;\n<\/p>\n<p>(c)\tmaintain<br \/>\nlaw and order;\n<\/p>\n<p>(d)\tshall<br \/>\nmark their  presence before Visavadar Police Station on every first<br \/>\nday of English Calendar month between 9.00 a.m. to 2.00 p.m.;\n<\/p>\n<p>(e)\tnot<br \/>\nleave the State of Gujarat without the prior permission of the<br \/>\nSessions Court concerned;\n<\/p>\n<p>(f)\tfurnish<br \/>\nthe address of their residence at the time<br \/>\nof execution of the bond and shall not change the residence without<br \/>\nprior permission of this Court;\n<\/p>\n<p>(g)\tsurrender<br \/>\ntheir passport, if any, to the lower Court within a week.\n<\/p>\n<p>4.\tIf<br \/>\nbreach  of any of the above conditions is committed, the Sessions<br \/>\nJudge concerned will be free to issue warrant or to take appropriate<br \/>\naction in the matter.\n<\/p>\n<p>5.\tBail<br \/>\nbefore the lower court having jurisdiction to try the case.\n<\/p>\n<p>6.\tRule<br \/>\nis made absolute.
