    This petition is filed under Article 226 of<\/p>\n
the Constitution of India   to issue a writ of<\/p>\n
mandamus forbearing first respondent not to<\/p>\n
take  disciplinary   proceedings  against   the<\/p>\n
petitioner  without   due  compliance  of   the<\/p>\n
various provisions of Extradition Act, 1962,<\/p>\n
contending that the provisions of Extradition<\/p>\n
Act will not apply to the petitioner at all.<\/p>\n
    2.   Second   respondent   the    Principal<\/p>\n
Secretary, Ministry of External Affairs,  filed<\/p>\n
a counter affidavit stating that to initiate<\/p>\n
Extradition proceedings a request is to be<\/p>\n
submitted by the competent authority and as per<\/p>\n
the information available with the Ministry, a<\/p>\n
message was received from NCB-India in Mach<\/p>\n
2007 requesting to locate the petitioner in<\/p>\n
W.P.(C)21294\/2007          2<\/span><\/p>\n
India and to inform the authorities in UAE and so<\/p>\n
that Extradition Act through diplomatic channels<\/p>\n
could be sent.      Counter affidavit shows that to<\/p>\n
initiate extradition proceedings or initiate any<\/p>\n
prosecution by Union of India, a formal request for<\/p>\n
Extradition\/prosecution shall be received from the<\/p>\n
Government of United Arab Emirates and no such<\/p>\n
request has been received.    In such circumstances,<\/p>\n
recording the submission, the petition is disposed.<\/p>\n
