Respondent   is   petitioner   therein.     Respondent<\/p>\n<p>filed I.A.955\/06 for permission to examine the witnesses shown in the<\/p>\n<p>witness schedule.  Petitioner filed Ext.P4 objection contending that the<\/p>\n<p>purpose of examination of witnesses are not shown and application is<\/p>\n<p>not in confirmity with sub rule 2 of rule 1 of Order XVI of Code of Civil<\/p>\n<p>Procedure  and therefore it cannot be allowed.   Learned Munsiff under<\/p>\n<p>Ext.P5 order  allowed the application.   It is  challenged in this petition<\/p>\n<p>filed under Article 227 of Constitution of India.\n<\/p>\n<\/p>\n<p>       2.     Learned Counsel appearing for petitioner was heard.<\/p>\n<p>       3.     Arguments of learned Counsel appearing for petitioner was<\/p>\n<p>that under Sub rule 2 of rule 1 of  Order XVI, petition to summon the<\/p>\n<p>witnesses must reveal the purpose for which the witnesses are to be<\/p>\n<p>examined   and the   application  filed  by  respondent  does   not   show   the<\/p>\n<p>purpose  for  which the witnesses are examined and therefore  learned<\/p>\n<p>Munsiff   should   not   have   permitted   the   witnesses   to   be   examined<\/p>\n<p>inspite   of   the   objection   raised   by   petitioner.     Learned   Counsel   also<\/p>\n<p><span class=\"hidden_text\">W.P.(c)1993\/07                               2<\/span><\/p>\n<p>pointed   out   that   under   proviso   to   Section   94   (1)   of   Kerala<\/p>\n<p>Panchayat Raj Act, Court has a discretion to refuse to examine any<\/p>\n<p>witness,   if   it   is   of   the   opinion   that   evidence   of   such   witness   or<\/p>\n<p>witnesses is not material for the decision of the petition or that the<\/p>\n<p>party   tendering   such   witness   or   witnesses   is   doing   so   in   frivolous<\/p>\n<p>ground   or   with   a   view   to   delay   the   proceedings   and   unless   the<\/p>\n<p>purpose of which witnesses are examined is shown in the petition,<\/p>\n<p>Munsiff cannot exercise the discretion provided under Section 94 (1)<\/p>\n<p>of the Act and in such circumstances, the order is to be set aside.<\/p>\n<p>Learned   Counsel   also   argued   that   petitioner   cannot   be   put   in   the<\/p>\n<p>dark   on   the   purpose   for   which   the   witnesses   are   to   be   examined<\/p>\n<p>and therefore Ext.P5 order is bad.\n<\/p>\n<\/p>\n<p>       4.      On hearing learned Counsel appearing for petitioner and<\/p>\n<p>on going through Ext.P5 order, I do not find any infirmity in Ext.P5<\/p>\n<p>order   warranting   interference   in   exercise   of   the   extraordinary<\/p>\n<p>jurisdiction of this Court under Article 227 of Constitution of India.<\/p>\n<p>Learned   Munsiff   considered   the   question   and   exercised   the<\/p>\n<p>discretion, vest on him.   Proviso to Section 94(1) Court enables the<\/p>\n<p>Munsiff   to   exercise   the   discretion   by   refusing   to   examine   the<\/p>\n<p>witnesses   or   to   allow   to   examine   the   witnesses.     In   the   case   of<\/p>\n<p>refusal Munsiff has to record the reasons. When Munsiff is allowing<\/p>\n<p>the   party   to   examine   the   witnesses,     reasons   are   not   to   be<\/p>\n<p>recorded.  Learned Munsiff found that no prejudice will be caused to<\/p>\n<p><span class=\"hidden_text\">W.P.(c)1993\/07                            3<\/span><\/p>\n<p>petitioner by allowing examination of witnesses and the purpose of<\/p>\n<p>examination   of   the   witnesses   is   clear   from   the   election   petition.<\/p>\n<p>That   discretion   properly   exercised   by   the   Munsiff   cannot   be<\/p>\n<p>interfered in exercise of the supervisory or extraordinary jurisdiction<\/p>\n<p>of this Court.\n<\/p>\n<\/p>\n<p>       In such circumstances, petition is dismissed.<\/p>\n<pre>\n\n\n\n\n\n                                            M.SASIDHARAN NAMBIAR,JUDGE\n\n\n\n\nAcd\n\n\nW.P.(c)1993\/07    4\n\n\n<\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Kunnathadathil Kutti Hassan vs M.
