5. Learned Addl. Government Advocate has sought to justify<\/p>\n
the order of the learned Single Judge contending that the<\/p>\n
penalty is passed by the Disciplinary Authority dernjoting:  <\/p>\n
Second Division Clerk to the lower post and’ erecoiferyllyloifli. <\/p>\n
appropriated amount mentioned above <\/p>\n
suspension as suspension, after conducting a valid’ enquiry.._p’roviding A’<\/p>\n
fair and reasonable opportunity. to the—-la”ppe’llant.lhert\ufb01illnand the
\nAppellate Authority has modif’icl{1..   reducing the
\npunishment to the minirnurn payscale   years from 5
\nyears and withholding;     ilclulmulative effect by
\nits order dated  rightly affirmed by the
\nRevisional authority  cf-the revisional power, which
\norders are af\ufb01rrned the  Judge by recording reasons.
\nTherefore, she\u00e9subniits thatlthe lsarne does not call for interference by<\/p>\n
this Couri;  ofits appellate jurisdiction and power.

it is a major penalty under the Karnataka Civil Services
\n(Classi\ufb01cation, Control and Appeal) Rules, 1957. Therefore, though<\/p>\n
the Appellate Authority has exercised the appellate jurisdictioryhe<\/p>\n
has modi\ufb01ed the punishment as indicated above, but <\/p>\n
is also vitiated in law. The same thing is done <\/p>\n
authority. Hence, the orders impugned <\/p>\n
sustainable in law. The learned Single Judgethas not–“.i.noticed*.<\/p>\n
in\ufb01rmity in the orders crept in, as contended by the  the
\nWrit Petition. The learned Single iindings of the
\ndisciplinary authority and the    of the
\nfunds of the Department’;  has declined to
\nexercise his Xlihit.-Petition. The learned
\nSingle J udge   \ufb01relevant important aspects
\nthat the Discipiinaxy  to impose the proposed
\npenalty of WithhOldi(lg’vQi1Ef_ai11CI’\u00e9ii1CI1t with cumulative effect and
\nrecovery    Contrary to the said proposed<\/p>\n
punish;rnent,..Vthe”pu.nishrnent of imposition of reduction of some<\/p>\n
inpcrementslh of the  in the pay scale for 5 years is bad in law.<\/p>\n
Therefore,  appellant is justified in approaching this Court seeking<\/p>\n
 for.ytheV.reIiefsy_.as indicated, supra.<\/p>\n
