Leave granted.\n<\/p>\n<p><span class=\"hidden_text\">                                                                     1<\/span>\n<\/p>\n<p>2.       Challenge in this appeal is to the judgment of a<\/p>\n<p>learned Single Judge of the High Court of Andhra Pradesh at<\/p>\n<p>Hyderabad allowing the second appeal filed by the respondent<\/p>\n<p>under Section 100 of the Code of Civil Procedure, 1908 (in<\/p>\n<p>short &#8216;CPC&#8217;).\n<\/p>\n<\/p>\n<p>3.       Factual background in a nutshell is as follows:<\/p>\n<p>         The appellant-plaintiff filed O.S. No.78 of 1990 before<\/p>\n<p>the Sub-Court, Ramachandrapuram, East Godavari District,<\/p>\n<p>Andhra Pradesh against the respondent-defendant. The Trial<\/p>\n<p>Court by the judgment and order dated 27.06.1995 held that<\/p>\n<p>the plaintiffs are the owners of the schedule property and they<\/p>\n<p>being the owners of the schedule property are entitled to<\/p>\n<p>possession. Aggrieved by the judgment and decree of the Trial<\/p>\n<p>court, the respondent-defendant preferred an appeal in the<\/p>\n<p>Court   of   Additional   District   Judge,   Rajahmundry,   East<\/p>\n<p>Godavari District. By judgment and order dated 14.06.2001,<\/p>\n<p>the first appellate court confirmed the Trial Court&#8217;s judgment.<\/p>\n<p>The respondent-defendant preferred a second appeal under<\/p>\n<p><span class=\"hidden_text\">                                                                    2<\/span><br \/>\nSection 100 C.P.C. before the High Court of Andhra Pradesh<\/p>\n<p>at Hyderabad, being Second Appeal No.512 of 2001. By the<\/p>\n<p>impugned judgment, the learned Single Judge allowed the<\/p>\n<p>second appeal and the judgments and decree passed by the<\/p>\n<p>courts below were set aside.\n<\/p>\n<\/p>\n<p>         Though many points have been urged in support of<\/p>\n<p>the appeal, the primary stand of the learned counsel for the<\/p>\n<p>appellants is that the second appeal was allowed without<\/p>\n<p>framing any substantial question of law as mandated by<\/p>\n<p>Section 100 CPC.       Learned counsel for the respondent<\/p>\n<p>submitted that though the High Court&#8217;s judgment does not<\/p>\n<p>show that any substantial question of law was framed yet<\/p>\n<p>learned Single Judge has allowed the appeal after analyzing<\/p>\n<p>the factual position in the background of settled principles in<\/p>\n<p>law.\n<\/p>\n<\/p>\n<p>4.       Section 100 of CPC deals with &#8220;Second Appeal&#8221;. The<\/p>\n<p>provision reads as follows:\n<\/p>\n<\/p>\n<p>                &#8220;Section 100-Second Appeal: (1) Save as<br \/>\n                otherwise expressly provided in the body<\/p>\n<p><span class=\"hidden_text\">                                                                  3<\/span><br \/>\n               of this Code or by any other law for the<br \/>\n               time being in force, an appeal shall lie to<br \/>\n               the High Court from every decree passed<br \/>\n               in appeal by any Court subordinate to<br \/>\n               the High Court, if the High Court is<br \/>\n               satisfied that the case involves a<br \/>\n               substantial question of law.\n<\/p>\n<p>               (2)       An appeal may lie under this<br \/>\n               section from an appellate decree passed<br \/>\n               ex parte.\n<\/p>\n<p>               (3)       In an appeal under this Section,<br \/>\n               the memorandum of appeal shall<br \/>\n               precisely state the substantial question of<br \/>\n               law involved in the appeal.\n<\/p>\n<p>               (4)       Where the High Court is<br \/>\n               satisfied that a substantial question of<br \/>\n               law is involved in any case, it shall<br \/>\n               formulate that question.\n<\/p>\n<p>               (5)      The appeal shall be heard on<br \/>\n               the question so formulated and the<br \/>\n               respondent shall, at the hearing of the<br \/>\n               appeal, be allowed to argue that the case<br \/>\n               does not involve such question:\n<\/p>\n<p>                                  Provided that nothing<br \/>\n               in this sub-section shall be deemed to<br \/>\n               take away or abridge the power of the<br \/>\n               Court to hear, for reasons to be recorded,<br \/>\n               the appeal on any other substantial<br \/>\n               question of law, not formulated by it, if it<br \/>\n               is satisfied that the case involves such<br \/>\n               question.&#8221;\n<\/p>\n<\/p>\n<p>5.      A perusal of the impugned judgment passed by the<\/p>\n<p>High Court does not show that any substantial question of law<\/p>\n<p>has been formulated or that the second appeal was heard on<\/p>\n<p><span class=\"hidden_text\">                                                                4<\/span><br \/>\nthe question, if any, so formulated. That being so, the<\/p>\n<p>judgment cannot be maintained, which is set aside and<\/p>\n<p>remitted back to the High Court for proceeding in the matter<\/p>\n<p>in accordance with law and in terms of observations made<\/p>\n<p>herein.\n<\/p>\n<\/p>\n<p>6.        In Ishwar Dass Jain v. Sohan Lal (2000 (1) SCC 434),<\/p>\n<p>this Court in para 10, has stated thus:<\/p>\n<blockquote><p>           &#8220;10. Now under Section 100 CPC, after the<br \/>\n           1976 Amendment, it is essential for the High<br \/>\n           Court to formulate a substantial question of<br \/>\n           law and it is not permissible to reverse the<br \/>\n           judgment of the first appellate Court without<br \/>\n           doing so.&#8221;\n<\/p><\/blockquote>\n<p>7.        Yet again in Roop Singh v. Ram Singh (2000 (3) SCC<\/p>\n<p>708), this Court has expressed that the jurisdiction of a High<\/p>\n<p>Court is confined to appeals involving substantial question of<\/p>\n<p>law. Para 7 of the said judgment reads:<\/p>\n<blockquote><p>              &#8220;7.      It is to be reiterated that under<br \/>\n              section 100 CPC jurisdiction of the High<br \/>\n              Court to entertain a second appeal is<br \/>\n              confined only to such appeals which<br \/>\n              involve a substantial question of law and it<br \/>\n<span class=\"hidden_text\">                                                                 5<\/span><br \/>\n            does not confer any jurisdiction on the<br \/>\n            High Court to interfere with pure questions<br \/>\n            of fact while exercising its jurisdiction<br \/>\n            under section 100 CPC. That apart, at the<br \/>\n            time of disposing of the matter the High<br \/>\n            Court did not even notice the question of<br \/>\n            law formulated by it at the time of<br \/>\n            admission of the second appeal as there is<br \/>\n            no      reference of it in the impugned<br \/>\n            judgment. Further, the fact findings courts<br \/>\n            after appreciating the evidence held that<br \/>\n            the defendant entered into the possession<br \/>\n            of the premises as a batai, that is to say, as<br \/>\n            a tenant and his possession was<br \/>\n            permissive and there was no pleading or<br \/>\n            proof as to when it became adverse and<br \/>\n            hostile. These findings recorded by the two<br \/>\n            courts below were based on proper<br \/>\n            appreciation of evidence and the material<br \/>\n            on record and there was no perversity,<br \/>\n            illegality or irregularity in those findings. If<br \/>\n            the defendant got the possession of suit<br \/>\n            land as a lessee or under a batai<br \/>\n            agreement then from the permissive<br \/>\n            possession it is for him to establish by<br \/>\n            cogent and convincing evidence to show<br \/>\n            hostile animus and possession adverse to<br \/>\n            the knowledge of the real owner. Mere<br \/>\n            possession for a long time does not result<br \/>\n            in converting permissive possession into<br \/>\n            adverse possession <a href=\"\/doc\/1924102\/\">(Thakur Kishan Singh<br \/>\n            v. Arvind Kumar<\/a> (1994 (6) SCC 591). Hence<br \/>\n            the High Court ought not to have<br \/>\n            interfered with the findings of fact recorded<br \/>\n            by both the courts below.&#8221;\n<\/p><\/blockquote>\n<p>8.      The position has been reiterated in <a href=\"\/doc\/1320146\/\">Kanhaiyalal and<\/p>\n<p>Ors. v. Anupkumar and Ors.<\/a> (2003 (1) SCC 430), <a href=\"\/doc\/1735456\/\">Mathakala<\/p>\n<p>Krishnaiah v. V. Rajagopal<\/a> (2004(10) SCC 676), Smt. Ram<br \/>\n<span class=\"hidden_text\">                                                               6<\/span><br \/>\n<a href=\"\/doc\/1569140\/\">Sakhi Devi v. Chhatra Devi &amp; Ors. (JT<\/a> 2005 (6) SC 167),<\/p>\n<p><a href=\"\/doc\/1915593\/\">Sasikumar &amp; Ors. v. Kunnath Chellappan Nair &amp; Ors.<\/a> (2005<\/p>\n<p>(12) SCC 588), <a href=\"\/doc\/678582\/\">Gian Dass v. The Gram Panchayat Village<\/p>\n<p>Sunner Kalan &amp; Ors.<\/a> (2006 (6) SCC 271), Shah Mansukhlal<\/p>\n<p>Chhaganial (d) through Lrs. V. Gohil Amarsing Govindbhai (d)<\/p>\n<p>through Lrs. (2006(13) SCALE 99).\n<\/p>\n<\/p>\n<p>9.
