SHAH\n\t\t\n\t\n\n \n\nDate\n: 08\/07\/2010 \n\n \n\n \n \nORAL\nJUDGMENT<\/pre>\n<p>1.\tBy<br \/>\nway of this application the applicant-original petitioner has prayed<br \/>\nfor the following relief:\n<\/p>\n<p>a)\tthat<br \/>\npending the hearing and final disposal of Special Civil Application<br \/>\nNo. 1637\/2004, respondent no. 1 and respondent no. 3 be directed to<br \/>\nreturn the retail selling licence duly renewed by the District Supply<br \/>\nOfficer in order to enable the applicant to resume their business of<br \/>\nretail outlet, Valwada for supply of essential product of petroleum<br \/>\ndiesel to public at large.\n<\/p>\n<p>2.\tIt<br \/>\nappears that the interim relief, which is sought for in the present<br \/>\napplication, is to direct the concerned opponents to return the<br \/>\nretail selling licence, which has been taken back by the concerned<br \/>\nopponents.  The aforesaid can be said to be a fresh independent cause<br \/>\nof action for which the applicant-original petitioner can initiate<br \/>\nappropriate independent proceedings.  However, such a relief, in the<br \/>\npresent application by way of interim relief, cannot be granted.<br \/>\nHence, the present application is dismissed without further entering<br \/>\ninto the merits of the case.  As and when such proceedings are<br \/>\ninitiated the same shall be considered in accordance with law on its<br \/>\nown merits.\n<\/p>\n<p>3.\tWith<br \/>\nthis, the present application is disposed of.
