Udare\n\nName of the Public Authority:         B.P.C.L.\n         i\nFacts<\/pre>\n<p>:\n<\/p>\n<p>1.     The appeal was scheduled for hearing on 25\/2\/2009. But, the appellant<br \/>\ndid not avail of this opportunity.\n<\/p>\n<p>2.     The appellant has grievances regarding supply of refilled cylinders. In this<br \/>\ncontext, he has asked for certain information, which has been furnished except<br \/>\ndetails of the Dealership Agreement between the respondent and the dealer.<br \/>\nBeing not satisfied with the response, he has pleaded for providing copy of the<br \/>\nDealership Agreement.\n<\/p>\n<p>Decision:\n<\/p>\n<p>3.     The CPIO has replied and furnished the information except the copy of the<br \/>\nDealership Agreement. Since the agreement between the two parties provide a<br \/>\nframework for cooperation and coordination of activities between the parties,<br \/>\nthere is no justification for withholding such documents except the commercial<br \/>\ndetails.\n<\/p>\n<p>4.     The CPIO is, therefore, directed to consider the disclosure of Dealership<br \/>\nAgreement after due application of Section 10(1) of the Act to withhold a part of<br \/>\ninformation, the disclosure of which might not be in the commercial interest of the<br \/>\nparties.\n<\/p>\n<p>5.
