Shukla,Bimal Prasad\nRespondent Counsel :- C.S.C.,S.C.Srivastava\n\nHon'ble Amreshwar Pratap Sahi,J.\n<\/pre>\n<p>Heard learned counsel for the petitioner and Sri S.C.<br \/>\nSrivastava, learned counsel for the Nagar Palika Parishad,<br \/>\nMoghulsarai, District Chandauli.\n<\/p>\n<p>The petitioner has come up with a prayer for quashing the<br \/>\norder dated 28.06.2007 and for a mandamus to appoint the<br \/>\npetitioner on compassionate ground against the vacant post<br \/>\nof his deceased father under the Dying in Harness Rules,<br \/>\n1974.\n<\/p>\n<p>The question is as to whether the petitioner&#8217;s father was<br \/>\nappointed on regular basis or not.\n<\/p>\n<p>Learned counsel for the petitioner contends that in view of<br \/>\nthe Division Bench judgment dated 21.08.1987, the<br \/>\noperative para of the judgment whereof is quoted in<br \/>\nparagraph 18 of the writ petition, the services of the<br \/>\npetitioner&#8217;s father will be deemed to have been regularized<br \/>\nand he is entitled to the same benefit as extended by this<br \/>\nCourt in the judgment dated 08.02.2000 in Civil Misc. Writ<br \/>\nPetition No. 20507 of 1995. It is further submitted that<br \/>\nseveral candidates who came later on to the petitioner, have<br \/>\nbeen accommodated. A counter affidavit has been filed on<br \/>\nbehalf of the respondent and it has been categorically<br \/>\naverred that the petitioner&#8217;s father was never regularized in<br \/>\nservices and, therefore, the question of extending the benefit<br \/>\nunder the Dying in Harness Rules does not arise.\n<\/p>\n<p>Sri S.C. Srivastava, learned counsel for the respondent has<br \/>\n relied on the decision in the case of Smt. Sundari Devi Vs.<br \/>\nState of U.P. and others reported in 2010 (1) LBESR 349,<br \/>\nwhich is a judgment in relation to a claim by an employer of<br \/>\nanother local body namely the Meerut Development<br \/>\nAuthority, Meerut. The law in that regard has been explained<br \/>\nin detail.\n<\/p>\n<p>Learned counsel for the petitioner relies on the decision of<br \/>\nthis Court in the case of Deen Bandhu Verma Vs. State of<br \/>\nU.P. and others reported in 2007 (2) ADJ 190 to contend<br \/>\nthat the provision of Dying in Harness Rules, 1974 would be<br \/>\napplicable in such circumstances as well.\n<\/p>\n<p>The question which requires consideration is as to whether<br \/>\nthe petitioner would be entitled to get the benefit under the<br \/>\nDying in Harness Rules keeping in view the status of<br \/>\nemployment of the petitioner&#8217;s father.\n<\/p>\n<p>The facts which have been brought on record and also<br \/>\nindicated in the counter affidavit leave no room for doubt that<br \/>\nthe petitioner&#8217;s father had never been regularized in his<br \/>\nservice. In view of that the Rules, 1974 as explained in Smt.<br \/>\nSundari Devi&#8217;s case would not be applicable. So far as, the<br \/>\njudgments relied upon by the petitioner are concerned, the<br \/>\nsame do not hold water in view of the law laid down by the<br \/>\nApex Court in the case of Secretary, State of Karnataka and<br \/>\nothers Vs.
