He had filed complaint No.891\/2002 before<br \/>\nthe Court of Judicial Magistrate First Class, Deesa.  He, however,<br \/>\ndid not remain present for considerable period of time after the<br \/>\nlearned Judge issued process.  Allegation in the complaint were for<br \/>\noffences punishable under Sections 504, 506(2) read with 114 IPC.\n<\/p>\n<p>\tEventually,<br \/>\nthe learned Magistrate by an order dated 19.12.2007 dismissed the<br \/>\ncomplaint for default noting that complainant is not remaining<br \/>\npresent and no steps are taken for paying the process fee.  The<br \/>\ncomplaint is dismissed for default again.\n<\/p>\n<p>\tThis<br \/>\norder was challenged by the petitioner before the Sessions Court.<br \/>\nThere was delay in filing the Revision Application.  The learned<br \/>\nAdditional Sessions Judge examined all aspects of the matter and<br \/>\nfound that the petitioner was negligent.  No case for condonation of<br \/>\ndelay was made out.\n<\/p>\n<p>3.\tFrom<br \/>\nthe facts on record, it clearly emerges that after the Court issued<br \/>\nprocess on 09.05.2002, petitioner did not pay process fee for years<br \/>\ntogether.  At one stage, the complaint was dismissed for default.<br \/>\nSame was, however, later on restored.  Petitioner sought permission<br \/>\nto change his advocate, which was granted.  He, however, did not<br \/>\nengaged another advocate.  For more than 5 years, process fee was not<br \/>\npaid.  Eventually, the Magistrate was compelled to dismiss the<br \/>\ncomplaint for default second time.  This order also came to be<br \/>\nchallenged by the petitioner after delay.\n<\/p>\n<p>4.\tLooking<br \/>\nto the lethargy of the petitioner in pursuing his complaint, no case<br \/>\nfor interference is made out.
