Exhibit   P2   is   an   application   filed   by   the<\/p>\n<p>third   party   seeking   to   set   aside   the   same.     Petitioner   has   raised<\/p>\n<p>various   contentions   including   the   non   maintainability   of   Exhibit   P2.<\/p>\n<p>But,   in   the   view   I   am   taking,   it   is   not   necessary   for   this   court   to<\/p>\n<p>entertain   the   contentions   on   the   merit   at   this   stage.   Equally   in   the<\/p>\n<p>view I am taking, it is not necessary to issue notice to the other side.<\/p>\n<p>Since Exhibit  P2 is an application preferred by  the third  party and is<\/p>\n<p>pending consideration before the Debts Recovery Officer, necessarily<\/p>\n<p>the same had to be disposed of expeditiously as the same has been<\/p>\n<p>filed as early as on 14th February 2006.\n<\/p>\n<\/p>\n<p>       2.
