This is five year Degree course. The petitioner has also<br \/>\nappeared four times in the examination, but could not succeed<br \/>\nand has sought relief in this petition to direct respondents to<br \/>\nallow one more chance to the petitioner to appear in the<br \/>\nexamination.\n<\/p>\n<p>       The prayer made by the petitioner is vehemently opposed<br \/>\nby learned counsel for respondent no.3, who submitted that as<br \/>\nper regulation 14 petitioner is not entitled for any further<br \/>\nopportunity to appear in the Ist Year examination.\n<\/p>\n<p>       In reply to this, learned counsel for petitioner submitted<br \/>\nthat as per decision of respondents Annexure R-3\/2 and order<br \/>\npassed in Writ petition No.2184\/2008 (Hiresh Shrivastava and<br \/>\nothers Vs. State of M.P. &amp; others) decided on 21.2.2008,<br \/>\npetitioner is entitled for one more opportunity.\n<\/p>\n<p>       So far as Annexure R-3\/2 is concerned, it relates to a<br \/>\ndecision of     Education       Committee       of    Central     Council    of<br \/>\n                     W.P.No.7324\/2010<\/p>\n<p>  Resabh Kumar Namdev                         State of M.P. &amp; others<\/p>\n<p>Homoeopathy in which a resolution was passed which reads<br \/>\nthus :-\n<\/p>\n<blockquote><p>            &#8220;The Education Committee resolved as under :-\n<\/p><\/blockquote>\n<blockquote><p>                    The Education Committee considered the<br \/>\n            matter alongwith letter No.1447\/Conf.\/08 dated<br \/>\n            06.06.08 of Barkatullah Vishwavidhyalaya and<br \/>\n            resolved as under :-\n<\/p><\/blockquote>\n<blockquote><p>                    &#8220;It is resolved that students of BHMS<br \/>\n            Course need to appear in examinations and pass<br \/>\n            in the subjects as per provisions of Homoeopathy<br \/>\n            (Degree Course) Regulations, 1983 (as amended<br \/>\n            in 2003 &amp; 2005) including I-BHMS examinations.<br \/>\n            The students study basic medical subjects like<br \/>\n            Anatomy &amp; Physiology (including Biochemistry) in<br \/>\n            I-BHMS Course to understand normal structure<br \/>\n            and functions of human beings besides basics of<br \/>\n            Organon of Medicine &amp; Homoeopathic Philosophy<br \/>\n            &amp; Materia Medica as well as another pre-clinical<br \/>\n            subject of Pharmacy; and even if in four chances<br \/>\n            they cannot pass I-BHMS exams, then how they<br \/>\n            can understand the more complex subjects like<br \/>\n            Pathology, Practice of Medicine, Gynaecology &amp;<br \/>\n            Obstetrics, Surgery etc. in Second BHMS Course.\n<\/p><\/blockquote>\n<blockquote><p>                    However,       Education     Committee<br \/>\n            recommended to allow one more but final chance<br \/>\n            to appear in the I-BHMS exam in the respective<br \/>\n            subjects where students are yet to pass the<br \/>\n            subjects maximum upto two subjects but this<br \/>\n            should not be taken as a precedence.\n<\/p><\/blockquote>\n<blockquote><p>                  A note of dissent given by Dr.C.Nayak,<br \/>\n            Member, is enclosed.\n<\/p><\/blockquote>\n<blockquote><p>                    The Executive Committee agreed with<br \/>\n            the resolution of Education Committee in the<br \/>\n            matter. It desired that the decision taken may<br \/>\n            be informed to all concerned authorities as well<br \/>\n            as to the petitioners in the Court case.&#8221;<\/p><\/blockquote>\n<p>      From the perusal of aforesaid, it is apparent that the<br \/>\naforesaid resolution was passed as a special case with a specific<br \/>\nnote that it should not be taken as a precedent, so the<br \/>\npetitioner is not entitled for any benefit by issuing a writ of<br \/>\nmandamus against the respondents to permit petitioner to allow<br \/>\none opportunity to appear in the examination.                  In Hiresh<br \/>\n                      W.P.No.7324\/2010<\/p>\n<p>  Resabh Kumar Namdev                           State of M.P. &amp; others<\/p>\n<p>Shrivastava (supra) this Court considering the case of the<br \/>\npetitioner passed an order, which reads thus :-\n<\/p>\n<blockquote><p>            &#8220;21.2.2008<\/p>\n<p>                     By this writ petition the petitioners have<br \/>\n            prayed for issue of a writ of mandamus<br \/>\n            commanding the respondents to allow them to<br \/>\n            appear in B.H.M.S. Ist Professional Examination<br \/>\n            or to conduct the separate examination in<br \/>\n            relation to the petitioners.\n<\/p><\/blockquote>\n<blockquote><p>                    Mr.A.K.Jain, learned counsel for the<br \/>\n            petitioners and Mr.Deepak Awasthy, learned<br \/>\n            Government Advocate for the State fairly stated<br \/>\n            that the controversy is covered by the order<br \/>\n            dated 28.1.2008 passed by this Court in<br \/>\n            W.P.No.950\/2008 wherein following order has<br \/>\n            been passed :-\n<\/p><\/blockquote>\n<blockquote><p>                     &#8220;Invoking the extraordinary jurisdiction<br \/>\n            of this Court the petitioners have prayed for<br \/>\n            issue of a writ of mandamus to the respondent<br \/>\n            No.3 to relax the conditions by exercising power<br \/>\n            conferred under Homeopathy (Degree Course)<br \/>\n            BHMS, Regulations, 1983 (As Amendment upto<br \/>\n            September, 2003). Mr.Aditya Sanghi, learned<br \/>\n            counsel appearing for the petitioners has drawn<br \/>\n            out attention to Regulation 14 and specifically<br \/>\n            14(iii) of the aforesaid Regulations. It is further<br \/>\n            submitted by him that earlier the Central Council<br \/>\n            of Homeopathy had relaxed the Regulation. We<br \/>\n            do not intend to enter into the said spectrum.<br \/>\n            However, as the Council has to relax the<br \/>\n            regulation on certain parameters, at presently<br \/>\n            advised, the respondent No.3 shall consider the<br \/>\n            case of the petitioners within the permissible<br \/>\n            parameters as envisaged under Regulation 14.&#8221;\n<\/p><\/blockquote>\n<blockquote><p>                    The aforesaid direction shall apply in full<br \/>\n            force to the case at hand. In view of the<br \/>\n            aforesaid we only direct that the respondents<br \/>\n            shall complete the exercise within six weeks<br \/>\n            from the date of receipt of the order passed<br \/>\n            today. Needless to emphasize, it will be open to<br \/>\n            the petitioners to approach the said authority<br \/>\n            within the stipulated period of time.\n<\/p><\/blockquote>\n<blockquote><p>                   The writ petition is accordingly disposed<br \/>\n            of. There shall be no order as to costs.\n<\/p><\/blockquote>\n<blockquote><p>                    C.C., as per rules in course of the day.&#8221;<\/p><\/blockquote>\n<p>      As this Court in Hiresh Shrivastava (supra) as issued<br \/>\n                     W.P.No.7324\/2010<\/p>\n<p>  Resabh Kumar Namdev                    State of M.P. &amp; others<\/p>\n<p>the aforesaid directions, we find it appropriate to dispose of this<br \/>\nmatter with the same directions which were issued by this Court<br \/>\nin Hiresh Shrivastava.        The aforesaid directions shall be<br \/>\napplicable in the case of petitioner, in so far as they are<br \/>\napplicable in the case of petitioner.
