Gill, Advocate,\n                  Amicus-Curiae for the petitioner.\n\n                  Mr. DS Brar DAG Punjab.\n                  for the respondent-State.\n\n                  Mr. Kapil Aggarwal, Advocate,\n                  for respondents No.2 to 4.\n\nNAWAB SINGH J.\n<\/pre>\n<p>                  This revision petition has been filed by the<br \/>\ncomplainant against the judgment dated October 31st, 2001 passed<br \/>\nby Additional Sessions Judge, Sangrur, whereby, respondents No.2<br \/>\nto 4 were acquitted in case bearing First Information Report No. 193<br \/>\ndated October 1st, 1996 under Section 302 read with Section 34 of<br \/>\nIndian Penal Code Police Station Dhuri, district Sangrur.\n<\/p>\n<p>2.                The prosecution case in brief is that on September<br \/>\n8th, 1996, accused-respondents No.2 to 4 (for short &#8216;respondents&#8217;)<br \/>\nalong with 20\/25 persons brought the dead bodies of Malkiat Singh<br \/>\nand Balla Singh from village Ladda in a truck to their village Shahpur<br \/>\nKalan. They informed Sarwan Singh-complainant father of Malkiat<br \/>\nSingh deceased that the deceased had consumed insecticide by<br \/>\nmistake and died. Post-Mortem-Examination was not conducted on<br \/>\nthe dead-bodies because the respondents wanted to cremate them<br \/>\nwithout Post-Mortem Examination. The dead bodies were cremated.\n<\/p>\n<p>3.                On September 27th, 1996, that is, after 19 days of<br \/>\n<span class=\"hidden_text\"> Criminal Revision No. 914 of 2002                                2<\/span><\/p>\n<p>the occurrence, Sarwan Singh-complainant came to know that the<br \/>\nrespondents offered liquor to the deceased after mixing insecticide.<br \/>\nOn account of that, they died.\n<\/p>\n<p>4.                 On September 29th, 1996 Sarwan Singh, Baldev<br \/>\nSingh, Member Panchayat, Thakra Lambardar and Gurdev Singh<br \/>\nwere present in the house of Baldev Singh. Gurcharan Singh and<br \/>\nJagjit Singh-respondents came there and made extra-judicial<br \/>\nconfession before them begging that they should be pardoned for<br \/>\nmaking the deceased to drink liquor mixed with insecticide. After<br \/>\nmaking extra-judicial confession, both the respondents left the house<br \/>\nof Baldev Singh.\n<\/p>\n<p>5.                 On October 1st, 1996, that is, after two days of<br \/>\nmaking the alleged extra-judicial confession by the respondents,<br \/>\nSarwan Singh reached the Police Station and reported the matter<br \/>\nwhereupon, First Information Report (Exhibit P-8) was recorded.\n<\/p>\n<p>6.                 Motive for the crime alleged was that Harnek<br \/>\nSingh-respondent No.4 is issueless. He was married to Mukhtiar<br \/>\nKaur. The couple adopted Gurcharan Singh-respondent No.1.<br \/>\nHarnek Singh executed a Will in favour of Gurcharan Singh. Niece of<br \/>\nMukhtiar Kaur was married to Malkiat Singh (deceased). Gurcharan<br \/>\nSingh and Harnek Singh apprehended that Mukhatiar Kaur may<br \/>\nprevail upon Harnek Singh to change his Will and persuade him to<br \/>\nexecute another Will in favour of Malkiat Singh and for that reason<br \/>\nthey poisoned Malkiat Singh and Balla Singh to death.\n<\/p>\n<p>7.                 It may be stated at the outset that Jagjit Singh and<br \/>\nHarnek Singh respondents No.3 and 4 respectively were not<br \/>\nchallaned by the Police as they were found innocent. Later on, on the<br \/>\napplication filed under Section 319 of Code of Criminal Procedure<br \/>\nboth of them were summoned to face trial along with Gurcharan<br \/>\nSingh.\n<\/p>\n<p>8.                 The entire case hinges on circumstantial evidence.<br \/>\nThe only piece of circumstantial evidence relied upon by the<br \/>\nprosecution and discarded by the learned trial Judge was that<br \/>\nGurcharan Singh and Jagjit Singh made extra-judicial confession<br \/>\n<span class=\"hidden_text\"> Criminal Revision No. 914 of 2002                                    3<\/span><\/p>\n<p>before Sarwan Singh and others on September 29th,                    1996.<br \/>\nSurprisingly, Sarwan Singh did not opt to lodge the report to the<br \/>\nPolice even after the alleged extra-judicial confession made by the<br \/>\nduo to him. He kept on waiting for two days for reporting the matter<br \/>\nfor the reasons best known to him. He also did not inform the Police<br \/>\nwhen for the first time on September 27th, 1997 he came to know<br \/>\nabout the involvement of the accused in the alleged commission of<br \/>\nthe crime. The respondents No.2 and 3 were also not captured at the<br \/>\nhouse of Baldev Singh particularly, when five persons were present<br \/>\nthere and they allowed them to go from there. Any prudent man<br \/>\nwould have at least tried to capture the accused when he comes to<br \/>\nknow that he was the person who committed the murder. A criminal<br \/>\nwould not make extra-judicial confession simply for the heck of it. It is<br \/>\nonly in rare circumstances that a criminal would confess his guilt of<br \/>\nmurder. Had the respondents been involved in the murder of Malkiat<br \/>\nSingh and Balla Singh, they would not have brought the dead-bodies<br \/>\nof the deceased to their house and that too, along with 20\/25<br \/>\npersons of village Ladda, where the deceased allegedly consumed<br \/>\nliquor mixed with insecticide. It appears that the evidence of extra-<br \/>\njudicial confession before Sarwan Singh is manufactured one so, it<br \/>\nfails to inspire confidence.\n<\/p>\n<p>9.                 In view of above, this Court does not find any<br \/>\ninfirmity in the impugned judgment on any count which would call for<br \/>\nthe interference of this Court while exercising its reversional<br \/>\njurisdiction.\n<\/p>\n<p>10.
