SANKARAN, JJ.\n\n           ------------------------------------\n\n                  W.P.(C) NO. 16239 OF 2006 G\n\n           ------------------------------------\n\n           Dated this the 13th day of April,2007\n\n\n\n                           JUDGMENT\n<\/pre>\n<p>Kurian Joseph, J.\n<\/p>\n<p>     The   challenge   is   on   Ext.P7   order   passed   by   the<\/p>\n<p>Family Court, Kottayam.  As per the said order, request<\/p>\n<p>of   the   petitioner,   who   is   the   husband   of   the<\/p>\n<p>respondent, to send the parties for further counselling<\/p>\n<p>was   rejected.     The   marriage   between   the   parties   took<\/p>\n<p>place on 27.12.2001.   There is a dispute as to whether<\/p>\n<p>the   marriage   has   been   consummated   or   not.     Be   that   as<\/p>\n<p>it may, the main ground taken in the Original Petition<\/p>\n<p>filed before the Family Court by the respondent wife is<\/p>\n<p>that   the   marriage   has   not   been   consummated.     When   the<\/p>\n<p>case   was   posted   before   us,   we   had   opportunity   to   talk<\/p>\n<p>to both parties and the respective counsel as well.  As<\/p>\n<p>suggested   at   the   time   of   hearing,   the   petitioner   was<\/p>\n<p>also   referred   to   an   institute   of   sexual   and   marital<\/p>\n<p>health   &#8211;   Dr.Promodu&#8217;s   Institute   of   Sexual   &amp;   Marital<\/p>\n<p>Health.     The  petitioner  has  not  co-operated  fully  with<\/p>\n<p>the various tests suggested in the Institute.  When the<\/p>\n<p>W.P.(C). NO. 16239 OF 2006<\/p>\n<p>                                 ::  2  ::\n<\/p>\n<p>case was taken up today, petitioner submitted before us<\/p>\n<p>that   he   was   got   examined   at   another   centre   &#8211;\n<\/p>\n<p>Vishranthi Centre, Kottayam and according to them, only<\/p>\n<p>with   the   presence   of   the   respondent,   a   further<\/p>\n<p>treatment in the matter could be made.   We are afraid,<\/p>\n<p>it   may   not   be   proper   for   this   Court   to   permit   the<\/p>\n<p>respondent, in the facts and circumstances of the case,<\/p>\n<p>to   have   further   test   or   treatment   for   the   purpose   of<\/p>\n<p>this   case.     It   is   for   the   petitioner   to   undergo   any<\/p>\n<p>counselling   or   any   treatment   and   get   appropriate<\/p>\n<p>certificate     from   the   competent   doctors   to   the   effect<\/p>\n<p>that   he   is   physically   and   emotionally   fit   to   lead   a<\/p>\n<p>married   life,   in   which   event,   the   Family   Court   will<\/p>\n<p>consider   the   matter   in   the   light   of   such   materials<\/p>\n<p>produced   by   him   and   take   a   decision   as   to   whether   any<\/p>\n<p>further counselling is necessary with the participation<\/p>\n<p>of the respondent.  Till such time, it may not be just,<\/p>\n<p>proper   and   reasonable   to   compel   the   respondent   to<\/p>\n<p>undergo   any   further   counselling     for   the   purpose   of   a<\/p>\n<p>decision in this case.  Subject to the above liberty to<\/p>\n<p>the petitioner, this Writ Petition is dismissed.\n<\/p>\n<p>W.P.(C).
