Justice THOTTATHIL B.RADHAKRISHNAN\n\n Dated :06\/04\/2009\n\n O R D E R\n            THOTTATHIL B.RADHAKRISHNAN, J.\n                  -------------------------------------------\n                  W.P(C).No.11275 OF 2009\n                  -------------------------------------------\n               Dated this the 6th day of April, 2009\n\n\n                              JUDGMENT\n<\/pre>\n<p>1.The petitioner executed a sale deed in favour of the third<\/p>\n<p>  respondent. He now says that the said sale was only a<\/p>\n<p>  transaction of loan and was not intended to take effect as a<\/p>\n<p>  sale. On the strength of agreement for re-conveyance, the<\/p>\n<p>  petitioner had sued the third respondent in the civil court for<\/p>\n<p>  specific performance of the agreement. The third respondent<\/p>\n<p>  also filed a suit for injunction           against the petitioner. The<\/p>\n<p>  third respondent had mortgaged the property and created a<\/p>\n<p>  security interest in favour of the first respondent and obtained<\/p>\n<p>  a loan.     On default,         the bank has taken recourse to<\/p>\n<p>  securitisation proceedings. The petitioner wants this Court to<\/p>\n<p>  compel the bank to receive the amounts due under the loan<\/p>\n<p>  from him and also to disclose to him the total amounts due<\/p>\n<p>  under the account.\n<\/p>\n<p>WPC.11275\/09<\/p>\n<p>                            Page numbers<\/p>\n<p>2.Learned counsel for the bank states that the pleadings to the<\/p>\n<p>  writ petition discloses that there is a first appeal    pending<\/p>\n<p>  before this Court between the petitioner and the third<\/p>\n<p>  respondent.\n<\/p>\n<\/p>\n<p>3.The petitioner does not have a legal right to request this Court<\/p>\n<p>  to compel respondents 1 and 2 to receive amounts from him as<\/p>\n<p>  against the amounts due from the third respondent.           The<\/p>\n<p>  contract between the third respondent and the first<\/p>\n<p>  respondent cannot be interfered with in that manner.         The<\/p>\n<p>  petitioner&#8217;s request that the first respondent could disclose the<\/p>\n<p>  amounts due from the third respondent, is again a matter of<\/p>\n<p>  privacy within the realm of banking laws, subject of course to<\/p>\n<p>  any supervening entitlement of the petitioner to access such<\/p>\n<p>  information. I do not find it necessary for this Court to issue<\/p>\n<p>  any order as sought for. The writ petition fails.
