Supehia, appearing on behalf of petitioner<br \/>\nand learned AGP, Mr. Maulik Nanavati, appearing on behalf of<br \/>\nrespondent no.1.\n<\/p>\n<p>\tIn<br \/>\npresent petition, petitioner has challenged denial of compassionate<br \/>\nappointment as per order dated 1st April,2010.  Learned<br \/>\nadvocate Mr. Supehia submitted that father of the petitioner died on<br \/>\n13.2.2001 and date of birth of petitioner is 12th<br \/>\nJuly,1988 and he become major on 12th July,2006.<br \/>\nThereafter on 17th April,2007 he has made application for<br \/>\ncompassionate appointment and he has cleared the S.S.C. Examination<br \/>\nin March,2005.  He also submitted that as per Government Resolution<br \/>\ndated 10th March,2000 and 7th September,2002,<br \/>\nat the time when the father of the petitioner expired, petitioner was<br \/>\nminor, naturally such application cannot be filed within a period of<br \/>\nsix months.  Therefore, all the three reasons which have been given<br \/>\nby respondent while rejecting application for compassionate<br \/>\nappointment is contrary to the facts and records.\n<\/p>\n<p>\tIf<br \/>\nsubmissions made by learned advocate Mr. Supehia is right, then let<br \/>\npetitioner may make further detailed representation against aforesaid<br \/>\norder dated 1st April,2010 annexing all the documents<br \/>\nwhich are relevant and referred by learned advocate Mr. Supehia to<br \/>\nrespondent i.e. date of birth certificate of petitioner, death<br \/>\ncertificate of father of petitioner, certificate of S.S.C. pass<br \/>\nexamination along with representation.
