DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 02\/08\/2011 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>1.\tRule.\n<\/p>\n<p>Learned APP, waives service of notice of Rule for respondent &#8211; State.\n<\/p>\n<p>2.\tThis<br \/>\napplication is filed under Section 438 of the Code of Criminal<br \/>\nProcedure in connection with first information report registered at<br \/>\nCR No.I- 68 of 2009 with Limbdi Police Station for the offences<br \/>\npunishable under Sections 406, 420, 114, 409, 465, 467, 468, 471, 474<br \/>\nand 477(a) of the Indian Penal Code.\n<\/p>\n<p>3.\tLearned<br \/>\ncounsel for the applicant submits that the alleged incident for which<br \/>\ntransaction had taken place are of the year 2002 to 2003 and the role<br \/>\nof the applicant as a member is to facilitate the crime in question.<br \/>\nIt is further submitted that other co-accused are granted<br \/>\nanticipatory bail and by imposing suitable conditions the applicant<br \/>\nmay also be granted anticipatory bail.\n<\/p>\n<p>4.\tHeard<br \/>\nLearned APP for the respondent &#8211; State.\n<\/p>\n<p>5.\tHaving<br \/>\nheard learned counsel for the parties and perusing the record of the<br \/>\ncase and taking into consideration the facts of the case,<br \/>\n    I am inclined to grant anticipatory bail to the applicant.  This<br \/>\nCourt has also taken into consideration the law laid down by the Apex<br \/>\nCourt in the case of <a href=\"\/doc\/1108032\/\">Siddharam Satlingappa Mhetre v. State of<br \/>\nMaharashtra &amp; Ors. Reported<\/a> in [2011]1 SCC 694, wherein<br \/>\nthe Apex Court reiterated the law laid down by the Constitutional<br \/>\nBench in the case of Shri Gurubaksh Singh Sibbia &amp; Ors.<br \/>\nReported in [1980]2 SCC 565.\n<\/p>\n<p>6.\tLearned<br \/>\ncounsel for the parties do not press for further reasoned order.\n<\/p>\n<p>7.\tIn<br \/>\nthe result, this application is allowed by directing that in the<br \/>\nevent of the applicant herein being arrested pursuant to FIR being CR<br \/>\nNo.I- 68 of 2009 with Limbdi Police Station,  the applicant shall be<br \/>\nreleased on bail on furnishing a bond of Rs.10,000\/- (Rupees Ten<br \/>\nThousand only) with one surety of like amount on following conditions<br \/>\n:-\n<\/p>\n<p>[a]\tshall<br \/>\ncooperate with the investigation and make himself available for<br \/>\ninterrogation whenever required.\n<\/p>\n<p>[b]\tshall<br \/>\nremain present at concerned Police Station on 8.8.2011 between<br \/>\n11:00 am to 2:00 pm:\n<\/p>\n<p>[c]\tshall<br \/>\nnot hamper the investigation in any manner nor shall directly or<br \/>\nindirectly make any inducement, threat or promise to any witness so<br \/>\nas to dissuade them from disclosing such facts to the Court or to any<br \/>\nPolice Officer;\n<\/p>\n<p>[d]\tshall<br \/>\nat the time of execution of bond, furnish the address to the<br \/>\nInvestigating Officer and the Court concerned and shall not change<br \/>\nthe residence till the final disposal of the case or till further<br \/>\norders;\n<\/p>\n<p>[e]<br \/>\n\twill not leave India without the permission of the Court and, if is<br \/>\nholding a Passport, shall surrender the same before the trial Court<br \/>\nimmediately<\/p>\n<p>[f]\tIt<br \/>\nwould be open to the Investigating Officer to file an application for<br \/>\nremand, if he considers it just and proper and the concerned<br \/>\nMagistrate would decide it on merits.\n<\/p>\n<p>[g]\tdespite<br \/>\nthis order, it would be open for the Investigating Agency to apply to<br \/>\nthe competent Magistrate, for police remand of the applicant. The<br \/>\napplicant shall remain present before the learned Magistrate on the<br \/>\nfirst date of hearing of such application and on all subsequent<br \/>\noccasions, as may be directed by the learned Magistrate. This would<br \/>\nbe sufficient to treat the accused in the judicial custody for the<br \/>\npurpose of entertaining application of the prosecution for police<br \/>\nremand. This is, however, without prejudice to the right of the<br \/>\naccused to seek stay against an order of remand, if ultimately<br \/>\ngranted, and the power of the learned Magistrate to consider such a<br \/>\nrequest in accordance with law. It is clarified that the applicant,<br \/>\neven if, remanded to the police custody, upon completion of such<br \/>\nperiod of police remand, shall be set free immediately, subject to<br \/>\nother conditions of this anticipatory bail order.\n<\/p>\n<p>8.\tAt<br \/>\nthe trial, the trial court shall not be influenced by the<br \/>\nobservations of preliminary nature, qua the evidence at this stage,<br \/>\nmade by this Court while enlarging the applicant on bail.\n<\/p>\n<p>9.\tRule<br \/>\nmade absolute.
