Munshaw  for petitioner and Mr. Bipin<br \/>\nI. Mehta, learned advocate for the respective workmen who is<br \/>\nappearing on caveat. Petitioner Board has challenged various awards<br \/>\npassed by labour court granting reinstatement with continuity of<br \/>\nservice without back wages for intervening period.  On 29.2.2006,<br \/>\nrule was issued by this court by making it returnable on 20.12.2006.<br \/>\nBy same order, ad.interim relief against continuity of service was<br \/>\ngranted and it wa clarified that the award qua reinstatement has not<br \/>\nbeen stayed.  It was observed that it will be open for petitioner to<br \/>\ngive any other equivalent work to the respondent workmen.\n<\/p>\n<p>\tApplicant<br \/>\nBoard has filed these civil applications in the respective main<br \/>\nmatters and has prayed to modify order of this court dated 24.2.2006.<br \/>\nIt was submitted by Mr. Munshaw on behalf of the applicant Board that<br \/>\nthere is no vacancy available with the petitioner in which the<br \/>\npresent respondents can be accommodated. He has also submittied that<br \/>\nthere is shortage of fund, grant is not available from the Government<br \/>\nand no work is available and, therefore, they are unable to reinstate<br \/>\nworkmen concerned. It is also submitted by him that in various circle<br \/>\noffices and division office of the Board, it has been inquired as to<br \/>\nwhether any vacancy is available or not but no vacancy is available<br \/>\nand, therefore, ad.interim order of this Court  may be modified<br \/>\nsuitably.  Learned advocate Mr. Mehta has opposed the submissions and<br \/>\nprayer made by Mr. Munshaw.\n<\/p>\n<p>\tI have<br \/>\nconsidered the averments made in the application and the submissions<br \/>\nmade by the learned advocates for the parties.\n<\/p>\n<p>\tIn light of<br \/>\nthese factual aspects of the matter, question required to be<br \/>\nconsidered by this court is, whether reinstatement in fact is<br \/>\npossible or not. When the petitioner is not able to reinstate workmen<br \/>\nbecause of non availability of vacancy, in those circumstances, court<br \/>\ncan modify the ad.interim order by directing petitioner to pay<br \/>\nbenefit of section 17B of the ID Act, 1947 to workmen concerned.<br \/>\nWhen the labour court has passed award of reinstatement with<br \/>\ncontinuity of service and petitioner employer is unable to reinstate<br \/>\nworkmen, in that circumstances, by staying operation of the award of<br \/>\nreinstatement during pendency of the matter, court can direct the<br \/>\nemployer to comply with the mandatory provisions of section 17B of<br \/>\nthe ID Act.  In these matters, while issuing rule and granting<br \/>\nad.interim relief, operation of the award of reinstatement was not<br \/>\nstayed by this court. Therefore, that part of the order is required<br \/>\nto be modified.\n<\/p>\n<p>\tTherefore,<br \/>\nconsidering the inability on the part of the petitioner Board to<br \/>\nreinstate workmen concerned considering various correspondence with<br \/>\nthe circle and division office,  order of this court dated 24.2.2006<br \/>\nis modified by staying operation of the award  of reinstatement.<br \/>\nConsequently, petitioner is directed to pay the full wages last drawn<br \/>\ninclusive of maintenance allowance, if any, available, under the<br \/>\nservice rules to the respondents workmen under section 17B of the ID<br \/>\nAct, 1947 from the respective dates of awards till 30th<br \/>\nApril, 2006 within one month from the date of receipt of copy of this<br \/>\norder. Petitioner is also directed to go on making such payments of<br \/>\nfull wages last drawn to each of the respondent workman regularly<br \/>\nevery month from 1st May, 2006 till the final disposal of<br \/>\nthe respective main matters without fail.  Learned advocate Mr. Bipin<br \/>\nI. Mehta appearing for workmen submits that each workman in this<br \/>\ngroup will file affidavit  under section 17B of the ID Act, 1947 with<br \/>\ncopy thereof to the petitioner.  Subject to these observations and<br \/>\ndirections, order of this court dated 24.2.2006 is modified. These<br \/>\nCivil Applications are disposed of.\n<\/p>\n<p>3.1\tThereafter,<br \/>\non 25.4.2008, this Court has passed following order :\n<\/p>\n<p> 1.\tHeard<br \/>\nlearned advocate Mr.B.I.Mehta for the applicants and learned advocate<br \/>\nMr.Munshaw for the respondent.\n<\/p>\n<p>2.\tThe<br \/>\napplicants are receiving last drawn wages of Rs.1300\/- per month<br \/>\nunder Section 17B of the I.D.Act,1947. In the present applications,<br \/>\nthe request is that vacancy is available and work is also available<br \/>\nand that the work has been carried out through Panchayat by the<br \/>\nrespondent Board and therefore, the case of the applicants is that<br \/>\nlet the Board may consider the applicants for reinstatement in<br \/>\nservice without prejudice to the rights and contentions of the<br \/>\napplicants.\n<\/p>\n<p>3.\tIn<br \/>\nlight of the aforesaid background, it is directed to the respondent<br \/>\nBoard to consider the case of applicants for reinstatement during the<br \/>\npendency of these petitions without prejudice to their rights and<br \/>\ncontentions, if work and vacancy both are available and that work is<br \/>\nto be carried out through Panchayat within a period of one month from<br \/>\nthe date of receiving the copy of this order.\n<\/p>\n<p>4.\tAccordingly,<br \/>\npresent civil applications are disposed of.\n<\/p>\n<p>4.\tIn<br \/>\nspite of  aforesaid two orders passed by this Court,  the applicants<br \/>\n  workmen are sufferer because they are getting only Rs.1300\/-<br \/>\nbeing a last drawn salary and though work was available with<br \/>\nrespondent   original petitioner Board to operate motor with<br \/>\npumping station and also to get repaired the motors of all pumping<br \/>\nstations. The respondent   original petitioner Board is having<br \/>\nseveral pumping stations and therefore, that work has been given on<br \/>\ncontract basis to M\/s.Vraj Construction, Amreli and Awarth<br \/>\nInfrastructure Pvt. Ltd., Jasdan. The above said contractor is<br \/>\nrequired to engage at least 10 workers on one pumping station. The<br \/>\ncontractors have engaged workers at Mahi Yojna Pumping Station, Kotda<br \/>\nPitha, Khanpur, Santhali, Botad, Modhuka, Mahuva, Bhadala and Ajmer<br \/>\nPumping Stations. The respondent   original petitioner Board has<br \/>\nengaged Ami Engineering Corporation, Rajkot for Hirpar, Hadala and<br \/>\nBedi Pumping Stations. Number of contracts have been given for<br \/>\noperating the motor of pumping stations as well as for repairing work<br \/>\nof all pumping stations. In all 150 workers are working under<br \/>\ncontractors and these applicants are really made to suffer because<br \/>\nthough they are ready and willing to work but, respondent<br \/>\noriginal petitioner Board is not prepared to reinstate them in spite<br \/>\nof two orders passed by this Court with a recommendations to<br \/>\nrespondent   original petitioner Board to consider case of<br \/>\napplicants. The applicants are ready and willing to work and<br \/>\nrespondent   original petitioner Board is in a position to give the<br \/>\nwork to each applicant in spite of giving some work to the Taluka<br \/>\nPanchayat and Gram Panchayat, only Rs.1300\/- has been paid under<br \/>\nSection 17B of I.D.Act,1947. It is very difficult for applicants to<br \/>\nmaintain themselves in such a meagre amount. Therefore, request is to<br \/>\ndirect respondent   original petitioner Board to pay current wages.\n<\/p>\n<p>5.\tI<br \/>\nhave considered submissions made by learned advocate Mr.Munshaw that<br \/>\nreinstatement is not possible because the work has been carried out<br \/>\nby other employees.\n<\/p>\n<p>6.\tIn<br \/>\nlight of this background, it is very difficult for this Court to<br \/>\ndirect at this stage to respondent   original petitioner Board to<br \/>\npay current wages because it is beyond the provisions of Section 17B<br \/>\nof the I.D.Act,1947. Therefore, if the work is available with<br \/>\nrespondent   original petitioner Board and such work has been<br \/>\ncarried out by workers of Board, then it is a legal obligation on<br \/>\npart of petitioner Board being a State authority to consider case of<br \/>\neach applicant for reinstatement subject to result of petitions as<br \/>\nwell as without prejudice to rights and contentions of petitioner<br \/>\nBoard in pending petitions.\n<\/p>\n<p>7.\tTherefore,<br \/>\nin the interest of justice, it is directed to petitioner Board to<br \/>\nconsider the case of each applicant for reinstatement with<br \/>\nsympathetic approach and looking to the fact that work has been<br \/>\nalloted to various contractors that means that work is available with<br \/>\npetitioner Board but, petitioner Board does not want to reinstate the<br \/>\npresent applicants that impression has been created before this<br \/>\nCourt. Therefore, let the case of each applicant may be considered<br \/>\nsympathetically by petitioner Board for reinstatement subject to<br \/>\nresult of main petitions and without prejudice to the rights and<br \/>\ncontents of petitioner Board in pending petitions, within a period of<br \/>\none month from date of receiving copy of present order.\n<\/p>\n<p>8.\tIn<br \/>\nview of aforesaid observations and directions, present applications<br \/>\nare disposed of.\n<\/p>\n<p>9.\tThe<br \/>\nRegistry to notify main SCAs for final hearing on 13.5.2010 in<br \/>\nadmission Board.\n<\/p>\n<p>(H.K.RATHOD,J.)<\/p>\n<p>(vipul)<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Pravinsinh vs Gujarat on 19 April, 2010 Author: H.K.Rathod,&amp;Nbsp;
