Shri Adhil Minhaj\n\n^          Shri Akhil Mishra\n\n CORAM:   Honable Mr Justice Pritinker Diwaker \n\n Dated: 16\/04\/2010\n\n: JUDGEMENT    \n<\/pre>\n<p>                 O R D E R<\/p>\n<p> PETITION UNDER SECTION 482 OF THE CODE OF CRIMINAL<br \/>\n                     PROCEDURE<\/p>\n<p>     The instant petition has been filed against the<br \/>\norder  dated  10.2.2010  passed  by  the  Additional<br \/>\nSessions  Judge (FTC) Ambikapur in Criminal Revision<br \/>\nNo.  13\/2010  affirming  the order  dated  28.1.2010<br \/>\npassed by Judicial Magistrate First Class, Ambikapur<br \/>\nin   Criminal  Case  No.  1389\/2009  rejecting   the<br \/>\napplication  filed by the petitioner  under  Section<br \/>\n437 (6) of the Code of Criminal Procedure.\n<\/p>\n<p>2.    Facts  of  the  case in  brief  are  that  the<br \/>\npetitioner is facing Criminal Case No. 1389\/2009  in<br \/>\nrelation to the offences under sections 419 and  420<br \/>\nof the Indian Penal Code. It is not disputed that he<br \/>\nis in jail since 31.7.2009.\n<\/p>\n<p>3.    From  the record it appears that on  27.1.2010<br \/>\nthe   petitioner  had  filed  an  application  under<br \/>\nSection  437  (6) of the Code of Criminal  Procedure<br \/>\nfor  grant of bail on the ground that from the first<br \/>\ndate   fixed   for  recording  the   evidence   i.e.<br \/>\n27.11.2009, the trial has not been concluded  within<br \/>\nthe specified period of sixty days. This application<br \/>\nof the petitioner was rejected by the trial Court on<br \/>\n28.1.2010  on  the  ground that  as  co-accused  who<br \/>\nhappens  to be the brother of the accused\/petitioner<br \/>\nis  absconding, prosecution apprehends that even the<br \/>\naccused\/appellant may also abscond  or  tamper  with<br \/>\nthe   prosecution  witnesses.  In  revision,   while<br \/>\naffirming   the   order  passed   by   the   learned<br \/>\nMagistrate,  the revisional Court held that  looking<br \/>\nto the seriousness of the offences of high magnitude<br \/>\nfor  which the revisionist was charged, the  overall<br \/>\nimpact  of  the  offence and release of  the  person<br \/>\naccused   of  such  offence  on  the  society,   the<br \/>\npossibility  that the revisionist,  if  released  on<br \/>\nbail was likely to influence the witnesses or tamper<br \/>\nwith   the  prosecution  evidence  along  with   the<br \/>\nabsconded  accused  who  is  real  brother  of   the<br \/>\nrevisionist, petitioner is not entitled for bail.\n<\/p>\n<p>4.   Contention of the counsel for the petitioner is<br \/>\nthat provisions of Section 437 (6) are mandatory  in<br \/>\nnature  and  if the accused is not at  fault  he  is<br \/>\nentitled for bail. He submits that once the trial is<br \/>\nnot concluded within the stipulated period, right to<br \/>\nbe  released  on bail has accrued in favour  of  the<br \/>\npetitioner.\n<\/p>\n<p>5.     On   the   other   hand   counsel   for   the<br \/>\nrespondent\/State  supports the  order  impugned.  He<br \/>\nsubmits that looking to the seriousness of the  case<br \/>\nand  that  the  co-accused who  happens  to  be  the<br \/>\nbrother   of  the  petitioner  is  absconding,   the<br \/>\npetitioner is not entitled for bail. He submits that<br \/>\nthe  trial  is in progress and three witnesses  have<br \/>\nalready  been  examined  and  therefore,  also   the<br \/>\npetitioner is not entitled for bail. He submits that<br \/>\non one occasion it is the counsel for the petitioner<br \/>\nwho  had  made a request for a longer date  and  for<br \/>\nthis reason also the petitioner is not entitled  for<br \/>\nbail.\n<\/p>\n<p>6.   Order sheets of the Court below reflect that on<br \/>\nthe first date fixed for recording the evidence i.e.<br \/>\n27.11.2009  no prosecution witness was  present.  On<br \/>\nthe  next  date  i.e. 7.12.2010 also no  prosecution<br \/>\nwitness  appeared though the witnesses were summoned<br \/>\nand therefore the case was adjourned for 21.12.2010.<br \/>\nOn  that  date also the accused\/petitioner  was  not<br \/>\nproduced  in  the Court from Jail and therefore  the<br \/>\ncase was adjourned for 6.1.2010. On 6.1.2010 as none<br \/>\nof  the prosecution witnesses was present, case  was<br \/>\nfixed on 19.1.2010. On 19.1.2010 as the accused  was<br \/>\nnot  produced  from jail the case was  adjourned  to<br \/>\n2.2.2010  and  on  that  date also  the  prosecution<br \/>\nwitnesses  were not present and therefore  the  case<br \/>\nwas adjourned for 15.2.2010 and in the meanwhile the<br \/>\nCourt  had also issued bailable warrant against  the<br \/>\nwitnesses.  On  15.2.2010 also the accused  was  not<br \/>\nproduced  and  therefore the case was  adjourned  to<br \/>\n22.2.2010.  Case  was again taken  up  on  different<br \/>\ndates.\n<\/p>\n<p>      From  the  record  it is  apparent  that  from<br \/>\n27.11.2009  to 27.1.2010 the Court below has  failed<br \/>\nto conclude the trial and on all these occasions the<br \/>\npetitioner\/accused   was   not    at    fault.    If<br \/>\naccused\/petitioner was not produced in the Court, it<br \/>\ncannot be said that he was at fault.\n<\/p>\n<p>     Considering the settled legal position, reasons<br \/>\nassigned by the trial Court and the revisional Court<br \/>\ndo  not  appear  to  be justified. Accordingly,  the<br \/>\napplication is allowed.
