The facts lie<br \/>\nin a  short compass.  The land comprising 205 links situated<br \/>\nin plot no.702 which comprises a total area of 580 links was<br \/>\nacquired in the year 1963 for the construction of PWD office<br \/>\nbuilding in  Sharjuddinpur in  Azamgarh city.  While  making<br \/>\nconstruction, it was indeed, as found by the Civil Court, at<br \/>\na suit\tof the respondent that the State had encroached upon<br \/>\n140 links  of the  land in  the said  plot no.702  which was<br \/>\nsubsequently demarcated\t as plot  nos.702\/A and described as<br \/>\nplot nos.702\/4\t(68 links)  and 702\/5  (72 links). The Civil<br \/>\nCourt  issued  a  mandatory  injunction\t directing  the\t PWD<br \/>\nDepartment to  remove  the  encroachment.  The\tState  while<br \/>\ncarrying the  matter in\t appeal, simultaneously\t invoked its<br \/>\npower  of  eminent  domain  and\t issued\t notification  under<br \/>\nSection 4(1)  of the  Land Acquisition Act, 1894 (for short,<br \/>\n`the Act&#8217;) which was published on October 26, 1972. The said<br \/>\nnotification came to be questioned in the High Court in this<br \/>\nWrit Petition  on two  grounds and  the\t High  Court  found,<br \/>\nfirstly, that  the power  exercised under  s.17(1)  was\t not<br \/>\njustified since\t the land  is neither  waste nor arable land<br \/>\nand that,  therefore, the  notification dispensing  with the<br \/>\ninquiry under  s.5(A) was clearly illegal. It was also found<br \/>\nthat  since   the  Civil  Court\t that  the  appellants\thave<br \/>\nencroached upon\t the land  and issued a mandatory injunction<br \/>\nfor demolition of the compound wall constructed thereon, the<br \/>\nexercise of  power under  s.4(1) was  colourable, since\t the<br \/>\nappellants did\tnot admit  that the  property belongs to the<br \/>\nrespondents and\t had carried  the matter  in appeal  to\t the<br \/>\nDistrict Judge.\t Accordingly, the  notification under s.4(1)<br \/>\nand the declaration under s.6 came to be quashed. Thus, this<br \/>\nappeal by special leave.\n<\/p>\n<p>     It is  contended for  the State  that the view taken by<br \/>\nthe High  Court is  clearly unsustainable.  When  the  State<br \/>\nfound that there is mandatory injunction issued by the Court<br \/>\nholding that  the respondent  is owner\tof the land and that<br \/>\nthe construction was made on a land which is not part of the<br \/>\nland acquired in 1963, the Government exercised the power of<br \/>\neminent domain and that, therefore, the State is entitled to<br \/>\nissue the  notification under  s.4(1). It  is also contended<br \/>\nthat since  the compound wall was already constructed and as<br \/>\nmandatory injunction was operating against the appellant for<br \/>\nits demolition, the Government was justified to exercise its<br \/>\npower under  s.17(1) read  with s.17(4)\t dispensing with the<br \/>\ninquiry under Section 5A of the Act.\n<\/p>\n<p>     Sri Manoj Swarup, the learned counsel appearing for the<br \/>\nrespondent in  his usual  vehemence contends  that this is a<br \/>\nclear case  of mala  fide and  colourable  exercise  of\t the<br \/>\npower. In  view of  the fact  that the\tGovernment  had\t not<br \/>\nadmitted the  right of the respondents the State had taken a<br \/>\ndifferent stand\t that it  was a\t mistaken  identity  of\t the<br \/>\nproperty and  since the\t Civil Court recorded a finding that<br \/>\nthe respondent\tis the\towner of  the land  the\t Government,<br \/>\nwithout\t surrendering\tpossession  or\t demolition  of\t the<br \/>\ncompound  wall,\t  cannot  justify  its\tunlawful  action  by<br \/>\nexercising the\tpower of eminent domain. It cannot issue the<br \/>\nnotification  under   s.4(1)  to   nullify  the\t  decree  of<br \/>\ninjunction of  the Civil  Court. Thus,\tit would  constitute<br \/>\ncolourable  exercise  of  power\t and  this  Court  would  be<br \/>\nreluctant to  justify  such  action  under  Article  136  to<br \/>\nsupport such  high-handed and  illegal action on the part of<br \/>\nthe State.  It is  also contended  that since land is not an<br \/>\narable land,  the exercise  of power under s.17(1) read with<br \/>\ns.17(4) is clearly illegal.\n<\/p>\n<p>     Having considered the respective contentions, we are of<br \/>\nthe considered\tview that  the conclusion  of the High Court<br \/>\nwas clearly  illegal. It  is seen that the land acquired was<br \/>\nfor a public purpose. Admittedly, the same land was acquired<br \/>\nin the\tyear 1963  for\tbuilding  a  PWD  office  and  after<br \/>\nconstruction compound  wall was\t also constructed to protect<br \/>\nthe building.  As found\t by the\t Civil\tCourt,\ton  adducing<br \/>\nevidence in  a suit, that the Department had encroached into<br \/>\nrespondent&#8217;s land  which was  directed to  be demolished and<br \/>\ndelivery of  possession to  be given.  It is  seen that when<br \/>\nthat land  was needed  for a public purpose, i.e. as part of<br \/>\npublic office,\tthe State  is entitled to exercise its power<br \/>\nof eminent domain and would be justified to acquire the land<br \/>\naccording to  law. Section  4(1) was,  therefore,  correctly<br \/>\ninvoked to  acquire the land in dispute. It is true that the<br \/>\nState had not admitted that its officers had encroached upon<br \/>\nthe respondent&#8217;s  land and had carried the matter in appeal.<br \/>\nThe finding of the Civil Court was that the property belongs<br \/>\nto the\trespondent. The\t factum of  the action under the Act<br \/>\nimplies admission  of the  title of  the respondent  to\t the<br \/>\nextent\tof   land  found   by  the  civil  court  to  be  an<br \/>\nencroachment. Though  the State\t chose to  file\t the  appeal<br \/>\nwhich was pending, better Judgment appears to have prevailed<br \/>\non the\tState to  resort to  the  power\t of  eminent  domain<br \/>\ninstead of  taking a decision on merits from a Court of Law.<br \/>\nIn view of the fact that the PWD Office building was already<br \/>\nconstructed and\t a compound  wall was  needed  to  make\t the<br \/>\nbuilding safe  and secure and construction was already made,<br \/>\nwhich is  a public purpose, the exercise of power of eminent<br \/>\ndomain is  perfectly warranted\tunder law. It can neither be<br \/>\nsaid to\t be colourable\texercise of  power nor\tan arbitrary<br \/>\nexercise of power.\n<\/p>\n<p>     The next  question is  whether the\t Government would be<br \/>\njustified in exercising its power under s.17(4) and dispense<br \/>\nwith the inquiry under s.5A of the Act. Mandatory injunction<br \/>\nissued by  the Civil Court to demolish the compound wall and<br \/>\nto restitute possession to the respondent had to be complied<br \/>\nwith. There  is thus urgency. The public purpose was obvious<br \/>\nas the\tcompound was  required to be retained to protect the<br \/>\nsafty of  the office. The object of s.5A enquiry was to show<br \/>\nwhether there  was no  public purpose  or the  land was\t not<br \/>\nsuitable or  some other\t lands may  be acquired.  All  these<br \/>\nrelevant and related facts are redundant due to the facts of<br \/>\nthe case.\n<\/p>\n<p>     So,  on   the  facts  and\tin  the\t circumstances,\t the<br \/>\nGovernment was\tjustified in  exercising their\tpower  under<br \/>\ns.17(4)\t invoking  urgency  clause  and\t dispense  with\t the<br \/>\ninquiry under s.5A. By no stretch of imagination it could be<br \/>\nsaid that  there was  no public\t purpose, for  which inquiry<br \/>\nunder s.5A could be made and decision taken. In that view of<br \/>\nthe matter,  the High Court was clearly in error in allowing<br \/>\nthe Writ  Petition and\tcommitted a manifest error of law in<br \/>\nquashing the notification under s.4(1) and declaration under<br \/>\ns.6 of the Act.\n<\/p>\n<p>     In view  of the  fact that\t the matter is pending for a<br \/>\nlong time,  the Land Acquisition Officer is directed to pass<br \/>\nan award  within six  months from the date of the receipt of<br \/>\nthe order of this Court. It is open to the respondent to put<br \/>\nforth his  claim for  compensation according  to law  and it<br \/>\nwould be  decided by  the Land Acquisition Officer according<br \/>\nto law.
