P.C.,<br \/>\n\tagainst the Judgment and order dated 6.05.2002, rendered in P.F.A.<br \/>\n\tCase No.15 of 2001 by the learned Judicial Magistrate First Class<br \/>\n\t(Municipal Court), Surat. The said case was registered against the<br \/>\n\tpresent respondent Nos.1 to 4 &#8211; original accused for the<br \/>\n\toffence under sections 16 of the Prevention of Food Adulteration Act<br \/>\n\t(for short &#8220;PFA Act&#8221;) in the Court of learned Judicial<br \/>\n\tMagistrate First Class (Municipal Court), Surat. The said Judgment<br \/>\n\tof the trial Court has been challenged by the Food Inspector on the<br \/>\n\tground that the Judgment and order passed by learned J.M.F.C. is<br \/>\n\tagainst the law and evidence on record.\n<\/p>\n<p>\tAccording to the<br \/>\n\tprosecution case, the complainant &#8211; Food Inspector visited the<br \/>\n\tfirm of respondent No.1 &#8211; accused on 8.09.1999 at 11.30 A.M. and, in<br \/>\n\tpresence of panch,  took 600 gram groundnut oil for the purpose of<br \/>\n\tanalysis. The panchnama was also prepared. Thereafter, after<br \/>\n\tcompleting the necessary procedure, the complainant sent the said<br \/>\n\tsamples to the Public Analyst for analysis. The Public Analyst<br \/>\n\tsubmitted the report in which it has been found that the sample is<br \/>\n\tadulterated.  Upon receipt of the report the complainant, after<br \/>\n\tobtaining sanction, filed complaint against the respondent Nos.1 to<br \/>\n\t4  &#8211; original accused for breach of Section 7 of the Act and<br \/>\n\tthereby the accused has committed an offence under Section  16 of<br \/>\n\tthe Act in the Court of learned Judicial Magistrate First Class<br \/>\n\t(Municipal Court), Surat, being P.F.A. Case No. 15 of 2001.\n<\/p>\n<p>At<br \/>\n\tthe conclusion of trial and after appreciating the oral as well as<br \/>\n\tdocumentary evidence, the learned J.M.F.C. vide impugned Judgment,<br \/>\n\tacquitted the respondents &#8211; accused.\n<\/p>\n<p>Mr.Mirza,<br \/>\n\tlearned advocate appearing for  Mr.R.R.Marshall, for the appellant &#8211;<br \/>\n\tFood Inspector has contended that the Judgment and order of<br \/>\n\tacquittal is contrary to law and evidence on record and is not<br \/>\n\tproper. He has contended that learned Judge ought to have considered<br \/>\n\tthe fact that the accused Nos.2 and 3 are the partners and it was<br \/>\n\tclear from oral inquiry by the Food Inspector. He has contended that<br \/>\n\tlearned Judge have erred in coming to the conclusion that the sample<br \/>\n\twas not tested by the Public Analyst himself. He has  contended that<br \/>\n\tthe trial Court has failed to appreciate the report of Public<br \/>\n\tAnalyst. He has also contended that the offences punishable under<br \/>\n\tthe Act are directly connected with the health of public at large.\n<\/p>\n<p>I<br \/>\n\thave gone through the papers produced in the Case. I have also gone<br \/>\n\tthrough the evidence led before the trial Court as well as the<br \/>\n\tExpert&#8217;s Opinion. I have also gone through the Judgment of the trial<br \/>\n\tCourt. The learned J.M.F.C. has rightly observed that complainant<br \/>\n\thas not produced any evidence showing Harjivandas Maganlal Company<br \/>\n\tis a partnership firm. I have also perused report. The learned<br \/>\n\tJ.M.F.C. has rightly observed that complainant has not produced<br \/>\n\tpress ticket or label from which oil-tin groundnut oil was taken.<br \/>\n\tLearned Counsel for the appellant is unable to convince this Court<br \/>\n\tas to whether the prosecution has followed the mandatory provision<br \/>\n\tof Rules. In the facts of the case I am in complete agreement with<br \/>\n\tthe reasons assigned by the trial Court.\n<\/p>\n<p>It<br \/>\n\tis settled legal position that in acquittal Appeal, the Appellate<br \/>\n\tCourt is not required to re-write the Judgment or to give fresh<br \/>\n\treasonings when the Appellate Court is in agreement with the reasons<br \/>\n\tassigned by the trial Court acquitting the accused. In the instant<br \/>\n\tcase, this Court is in full agreement with the reasons given and<br \/>\n\tfindings recorded by the trial Court while acquitting the<br \/>\n\trespondents &#8211; accused and adopting the said reasons and for<br \/>\n\tthe reasons aforesaid, in my view, the impugned Judgment is just,<br \/>\n\tlegal and proper and requires no interference by this Court at this<br \/>\n\tstage. Hence, this Appeal requires to be dismissed.\n<\/p>\n<p>In<br \/>\n\tthe result, the Appeal is hereby dismissed. The impugned Judgment<br \/>\n\tand order dated 6.05.2002 passed by the learned Judicial Magistrate<br \/>\n\tFirst Class (Municipal Court), Surat, in P.F.A.
