Justice ANTONY DOMINIC\n\n Dated :22\/11\/2007\n\n O R D E R\n                   ANTONY DOMINIC, J.\n\n            = = = = = = = = = = = = = = = =\n              W.P.(C) No. 34542 OF 2007 K\n            = = = = = = = = = = = = = = = =\n\n           Dated this the 22nd November, 2007\n\n                    J U D G M E N T\n<\/pre>\n<p>    Proceedings   have  been   initiated   against  the<\/p>\n<p>petitioner&#8217;s vehicle on the allegation of unauthorised<\/p>\n<p>transportation of river sand. Ext.P2 is the Mahazar and<\/p>\n<p>Ext.P3 is the objection filed.     At this stage, this<\/p>\n<p>writ  petition  has  been  filed  for  release  of  the<\/p>\n<p>vehicle, I am not inclined to pass such an order.<\/p>\n<p>    2.   In my view, the proper course to be adopted is<\/p>\n<p>to  direct  the   1st    respondent   to  conclude  the<\/p>\n<p>proceedings  in  terms  of   Rule   27  of  the  Kerala<\/p>\n<p>Protection of River Banks and Regulation of Removal of<\/p>\n<p>Sand Rules, as expeditiously as possible.<\/p>\n<p>    3.   Accordingly, I dispose of this writ petition<\/p>\n<p>directing that the 1st respondent shall finalise the<\/p>\n<p>proceedings in terms of Rule 27 of the Rules, as<\/p>\n<p>expeditiously, at any rate within ten days of receipt<\/p>\n<p>of a copy of this judgment.
