\nAdvocate Mr.Pandya for the petitioner.\n<\/p>\n
\tWhen it is
\ninquired from the learned Advocate for the petitioner as to whether
\nthe petitioner has approached the authority for the relief which he
\nis seeking in this petition, the learned Advocate submitted that,
\n‘certainly’.\n<\/p>\n
2.\tThe relief
\nsought for in this petition is as under:-\n<\/p>\n
 16.\tA.\tThat
\nthe Honourable Court may be pleased to issue writ of mandamus or any
\nother, writ, order or direction,  directing the respondents to
\nproduce the answer sheets in the subject of Gujarati and English
\nfor the post of Sahayak (unarmed) Police Sub Inspector and be further
\npleased  to verify as to whether any proper assessment and counting
\nor marks are properly given and be further pleased to declare that
\nthe petitionener is entitled to more marks in Gujarati and English
\nthan what are given by the respondents.\n<\/p>\n

2.1\tAnother
\nprayer sought for in the petition is as under:-\n<\/p>\n
 16.\tB.\tThe
\nHonourable Court may further be pleased to issue writ of mandamus or
\nany other, writ, order or direction, directing the respondents  to
\nconsider the petitioner eligible  for the post of Sahayak
\n(unarmed) Police Sub Inspector and be further pleased to proceed
\nfurther with the recruitment process.\n<\/p>\n

3.\tLearned
\nAdvocate for the petitioner submitted that the petitioner did
\napproach respondent No.2   Chairman, Sahayak (unarmed) Police Sub
\nInspector Bharti Board with a written application on 06.09.2010.  The
\ncase of the petitioner as set out in para-7 is that:-\n<\/p>\n
 7.\t…..\n<\/p>\n
The application of the petitioner was not accepted by the chairman
\nand the petitioner was replied that such stage is lost by the
\npetitioner…..\n<\/p>\n
4.\tApproaching
\nthe Chairman directly with a written application and not forwarding
\nthe same under the accepted modes of sending an application is
\nunknown to law.  Besides that, the aforesaid averments are required
\nto be appreciated in light of the averments made in para-11, which
\nreads as under:-\n<\/p>\n
 11.\tThe
\npetitioner submits that looking to the qualifications of the
\npetitioner and  looking to the experience as a lecturer in  the
\ncollege, it is beyond imagination of the petitioner to have
\nreceived such marks allocated to the petitioner i.e. 46 out of 100 in
\nGujarati and 29 out of 100 in English.  The system of the respondent
\nis that there is no provision of reassessment for the satisfaction of
\nthe petitioner and also it is necessary to verify the marks of the
\nanswer sheet on which questions, therefore, the marks are required to
\nbe recorded.  The request made by the petitioner to the second
\nrespondent is turned down because of such system, the petitioner has
\nbeen discriminated and there is violation of article 14 of the
\nConstitution of India.  The petitioner submits that the post of
\nSahayak (unarmed) Police Sub Inspector is post for which the
\nrespondent-authorities are the recruitment agency.  Denying the post
\nof Sahayak (unarmed) Police Sub Inspector would amount to violation
\nof fundamental right in the matter of equal opportunity in Government
\nservice and this would amount to violation of article 16 of the
\nConstitution of India.\n<\/p>\n

4.1\tThough the
\npetitioner knows that there is no provision for reassessment and it
\nis also the settled position of law that reassessment is not
\npermissible, the learned Advocate for the petitioner has prayed for
\nthe relief that, ‘the respondents be directed to
\nverify as to whether any proper assessment and counting or marks are
\nproperly given and be further pleased to declare that the petitioner
\nis entitled to more marks in Gujarati and English than what are given
\nby the respondents’.  This is possible only if the Court undertakes
\nexercise of reassessment of the answer sheets of the petitioner.\n<\/p>\n
4.2\tIn para-13,
\nthe petitioner has stated that:-\n<\/p>\n
 13.\tThe
\npetitioner submits that several  other candidates who are
\nhigh qualified are also given less marks.  To the knowledge of the
\npetitioner, there are some candidates who are given more marks
\ncompared to the candidate having higher qualification.
\n It is also submitted that the oral interview was conducted by the
\noffice of the respondents whereas the assessment of the paper was
\nmade by the agency other than the respondent.  The petitioner has
\nreason to believe that there is a possibility of irregularity or
\nmischief in the matter of allocation of marks and, therefore, the
\npetitioner approaches the Honourable Court  with a prayer of
\nthe intervention of the Honourable Court to examine the papers
\nand to verify as to whether any irregularity, mischief or otherwise
\nis committed in the matter of assessment of answer sheet.\n<\/p>\n

4.3\tMaking such
\na bald assertion without giving even one single name of any candidate
\nshows how casually the petitioner has approached this Court.  To say
\nthat ‘high qualified are given less marks’ and then in the second
\nbreath to say that, ‘some candidates, who are given more marks
\ncompared to the candidates having higher qualification’, are
\nself-contradictory exhibits and reflects the understanding of the
\nquestion involved in the petition by the petitioner.\n<\/p>\n
4.4\tOnly
\nbecause the petitioner has scored 71% marks in B.A. Examination, 59%
\nin M.A. Examination and has passed LLB examination, does not
\nguarantee that the petitioner must do equally well in the examination
\nconducted by respondent No.2.\n<\/p>\n
4.5\tThe fact
\nthat the petitioner has participated not only in the written
\nexamination but also in oral interview and after final result is
\ndeclared has come to this Court is nothing but taking a chance before
\nthe selection authority and then to challenge the selection after
\nparticipating in the same.\n<\/p>\n
5.\tThe Court
\nfinds no substance in this petition.  This Court is of the opinion
\nthat the petition is moved with ill-design and therefore, it deserves
\nto be dismissed with cost of Rs.7,500\/- (Rupees Seven Thousand Five
\nHundred Only), but then the Court restrains itself from imposing any
\ncost.\n<\/p>\n
