                        J U D G M E N T<\/p>\n
     Petitioners are working as Ramp Service Agents in<\/p>\n
the International Airport at Thiruvananthapuram.        They<\/p>\n
had responded to Ext.P7-notification by the 3rd respondent<\/p>\n
which is the Air India Air Transport Services Ltd inviting<\/p>\n
applications for appointment to the post of Ramp Service<\/p>\n
Agents. The notification stipulated that the appointment<\/p>\n
will be on a contract basis for a period of three years which<\/p>\n
could be extended on the basis of the merit of the<\/p>\n
performance. In the case of some of the petitioners the<\/p>\n
original period had expired and contract was extended. In<\/p>\n
the case of the 1st petitioner the period of the extended<\/p>\n
contract is due to expire by 30.9.2009. Third respondent<\/p>\n
has not extended the period of contract or expressed its<\/p>\n
willingness to do so.     But in the meanwhile, Ext.P14<\/p>\n
communication has been mailed by the Asst. General<\/p>\n
Manager of the AIATSL of the 3rd respondent indicating<\/p>\n

that man power is being engaged in the 3rd respondent<\/p>\n
under three years contract which is renewed for a further<\/p>\n
period of three years as approved by the competent<\/p>\n
authority. But there is no approval to further extend the<\/p>\n
contract.    Therefore, it is mandatory not to continue or<\/p>\n
roster any staff who have completed the first renewal of the<\/p>\n
contract i.e. completion of total six years in AIATSL. This is<\/p>\n
under challenge in the writ petition.          Petitioners are<\/p>\n
praying for a direction to the 3rd respondent to allow them<\/p>\n
to continue in service and also restraining the respondents<\/p>\n
from terminating the service of the petitioners and<\/p>\n
appointing fresh recruits to discharge the duties arising in<\/p>\n
the ground handling Department. Petitioners at the same<\/p>\n
time make it clear that they have not in this writ petition,<\/p>\n
prayed for a direction to regularise their services.<\/p>\n
      2.     A statement has been filed on behalf of the<\/p>\n
respondents.       A reply affidavit has been filed by the<\/p>\n
petitioners.\n<\/p>\n
      3.     Heard Sri. Elvin Peter, learned counsel for the<\/p>\n
petitioners and Sri.E.K. Nandakumar, learned counsel<\/p>\n

appearing for the respondents.\n<\/p>\n
      4.     It is pointed out that the original recruitment<\/p>\n
was on a contract basis, for a period of three years, which<\/p>\n
was extendable by a further unspecified period on the basis<\/p>\n
of merit. The contract for the subsequent period has been<\/p>\n
produced along with the statement which shows that the<\/p>\n
renewal of the contract is for three years but the date of<\/p>\n
expiry of the renewed contract is also mentioned, in the<\/p>\n
case of the 1st petitioner as 30.9.2009.<\/p>\n
      5.     Learned counsel for the petitioners submits that<\/p>\n
an instrumentality of the State should not resort to<\/p>\n
successive contracts, which is to deny the benefit of<\/p>\n
regularisation to the employees. It is contended that they<\/p>\n
do the same duties as that of other employees, Ramp<\/p>\n
Assistants, who are engaged on a regular basis. Though the<\/p>\n
petitioners do not claim the benefit of regularisation, their<\/p>\n
services need not be dispensed with, for the purpose of<\/p>\n
accommodating other employees on a fixed term contract<\/p>\n
basis, it is contended.\n<\/p>\n
      6.     I do not find force in the submission made by the<\/p>\n

\n                                   4<\/span><\/p>\n
petitioners.      They have no case that the original<\/p>\n
employment on a contract basis, was a camouflage for a<\/p>\n
regular recruitment, to avoid the burden of regular<\/p>\n
recruitment to a cadre post. They took the contract which<\/p>\n
was offered by the 3rd respondent. They served for the<\/p>\n
period of contract.      Thereafter, the period was extended<\/p>\n
for one more term. There is a specific date of expiry of the<\/p>\n
term of contract which varies from person to person and in<\/p>\n
the case of the 1st petitioner , it is 30.9.2009.  It is not a<\/p>\n
case where a further extension is         mandated under the<\/p>\n
renewed contract. The date of expiry is specified. Unless<\/p>\n
there is a fresh contract, the period of contract expires on<\/p>\n
the specified date.\n<\/p>\n
      7.     It  is   relevant to    note   the definition  of<\/p>\n
retrenchment in Section 2 (oo) of the I.D Act and the same<\/p>\n
reads as follows:\n<\/p>\n
             ”     “Retrenchment”         means     the
\n      termination by the employer of the service of a
\n      workman for any reason whatsoever, otherwise
\n      than as a punishment          inflicted by way of
\n      disciplinary action but does not include –<\/p>\n

\n                                   5<\/span><\/p>\n
             (a)   voluntary retirement of the workman;<\/p>\n
\n\n      or\n\n             (b)   retirement   of   the  workman    on\n<\/pre>\n
      reaching the age of superannuation if the
\n      contract of employment between the employer
\n      and     the    workman   concerned    contains  a
\n      stipulation in that behalf; or<\/p>\n
             (bb) termination of the service of the
\n      workman as a result of the non-renewal of the
\n      contract of employment between the employer
\n      and the workman concerned on its expiry or of
\n      such contract being         terminated   under a
\n      stipulation on that behalf contained therein; or<\/p>\n
             (c)   termination    of the service of a
\n      workman on the ground of continued ill-health<\/p>\n
      8.     Non-renewal of the term of contract and<\/p>\n
termination of the services of such non-renewal does not<\/p>\n
qualify as a retrenchment within the meaning of the I.D<\/p>\n
Act.\n<\/p>\n
      9.     Though the petitioners themselves do not claim<\/p>\n
the benefit of regularisation, they refer to Ext.P16 Scheme<\/p>\n
which essentially comprehends           casual employees. It<\/p>\n
provides for the right of a casual employee to be considered<\/p>\n
when a regular recruitment is launched.         The fact that<\/p>\n
petitioners have served as        employees on a fixed term<\/p>\n

contract basis will obviously be taken into account when a<\/p>\n
recruitment is made. That will subject to the rules and<\/p>\n
regulations which are then prevailing.<\/p>\n
      10. I do not find any illegality       in the employer<\/p>\n
deciding that a fresh recruitment of employees on a fixed<\/p>\n
term contract basis might become necessary. It does not<\/p>\n
mean that the present petitioners will not be considered if<\/p>\n
such fresh contracts are contemplated and decided upon by<\/p>\n
the employer. But it is up to the respondents to decide the<\/p>\n
mode of engagement.       I am sure, the fact that petitioners<\/p>\n
have chosen to approach this Court will not be treated as a<\/p>\n
blot by respondents if they decide to go for a fresh batch of<\/p>\n
employees on a fixed term contract basis . Respondents are<\/p>\n
an instrumentality of the State and they are only interested<\/p>\n
in regulating their activities in the larger public interest<\/p>\n
and in the interest of the organisation as such.<\/p>\n
      Subject to the above, writ petition is disposed of.<\/p>\n
