Justice M.SASIDHARAN NAMBIAR\n\n Dated :07\/10\/2010\n\n O R D E R\n            M.SASIDHARAN NAMBIAR,J.\n          ===========================\n            CRL.M.C.No. 3618 &amp;3706\n                     OF 2010\n          ===========================\n\n    Dated this the 7th day of October,2010\n\n                     ORDER\n<\/pre>\n<p>    Petitioners   in   Crl.M.C.3618\/2010    are<\/p>\n<p>accused 1 and 2 in CR No.52\/2010 of Excise<\/p>\n<p>Range,   Kothamangalam.        Petitioner    in<\/p>\n<p>Crl.M.C.3706\/2010 is the accused in CR.50\/2010<\/p>\n<p>of Excise Range, Thiruvananthapuram. She is the<\/p>\n<p>licensee of a Three Star Hotel having FL-3<\/p>\n<p>licence   at   Thiruvananthapuram.       Second<\/p>\n<p>petitioner in Crl.M.C.3618\/2010 is the licensee<\/p>\n<p>and first petitioner is the Manager of Hotel<\/p>\n<p>Maria International, Kothamangalam having a bar<\/p>\n<p>licence FL-3.  Both the crimes were registered<\/p>\n<p>on the allegations that in violation of the<\/p>\n<p>conditions of license, licensee had  put up an<\/p>\n<p>additional counter and the respective accused<\/p>\n<p>thereby committed the offence under section 56<\/p>\n<p>Crl.M.C.3706 &amp; 3618\/2010        2<\/p>\n<p>(b) of Abkari Act.         These petitions are filed under<\/p>\n<p>section 482 of the Code of Criminal Procedure to<\/p>\n<p>quash the crimes registered contending that an<\/p>\n<p>offence under section 56(b) of Abkari Act is not<\/p>\n<p>attracted.\n<\/p>\n<p>      2.     Learned senior counsel appearing for the<\/p>\n<p>petitioners         and  learned  Public  Prosecutor  were<\/p>\n<p>heard.\n<\/p>\n<p>      3.     Learned senior counsel pointed out that<\/p>\n<p>under        the     conditions  of  Annexure  C  license,<\/p>\n<p>licensee is permitted to sell and serve liquor not<\/p>\n<p>only in the bar room but also in the         room as well<\/p>\n<p>as the restaurant, to the inmates of the hotel. It<\/p>\n<p>also      permits       to serve liquor, along with the<\/p>\n<p>meals, by the side of           swimming pools, lawns and<\/p>\n<p>the roof gardens on getting special permit.         It is<\/p>\n<p>submitted that          both  licensees   obtained permit<\/p>\n<p>to serve liquor in the lawn by paying additional<\/p>\n<p>amount as          prescribed and in such circumstances<\/p>\n<p>putting up additional counter, within the licenced<\/p>\n<p>premises will not be a              in violation of the<\/p>\n<p>conditions of the license and therefore            offence<\/p>\n<p>Crl.M.C.3706 &amp; 3618\/2010       3<\/p>\n<p>under section 56(b) of Abkari Act is not attracted.<\/p>\n<p>Learned senior counsel pointed out that the very<\/p>\n<p>same question was considered by this court in<\/p>\n<p>Crl.M.C.2292\/2009 and by Annexure E order, the case<\/p>\n<p>registered was quashed, holding that putting up an<\/p>\n<p>additional counter within the licensed premises is<\/p>\n<p>not a violation of the conditions of the licence<\/p>\n<p>and therefore an offence under section 56(b) is not<\/p>\n<p>attracted.\n<\/p>\n<p>      4.     The argument of learned Public Prosecutor<\/p>\n<p>is that under the license, the licensee can sell<\/p>\n<p>liquor only within          the bar room and not outside<\/p>\n<p>and permission is granted only to serve liquor on<\/p>\n<p>the lawns or side of the swimming pools, to the<\/p>\n<p>residents of the hotel and it will not enable the<\/p>\n<p>licensee to put up additional counter and the<\/p>\n<p>additional counter put up, it is violation of the<\/p>\n<p>conditions of the license        and therefore an offence<\/p>\n<p>under section 56(b) is attracted.         Learned Public<\/p>\n<p>Prosecutor pointed out that under Rule 16 of Kerala<\/p>\n<p>Abkari      Disposal     Rules the  sale  of  liquor  is<\/p>\n<p>permitted only inside the bar room and by G.O.(P)<\/p>\n<p>Crl.M.C.3706 &amp; 3618\/2010        4<\/p>\n<p>105\/09\/TD dated 17.6.2009,           Foreign Liquor Rules<\/p>\n<p>was amended whereunder Rule 3C was inserted to the<\/p>\n<p>effect that no liquor shall be sold under FL-3<\/p>\n<p>license through more than one bar counter, within<\/p>\n<p>the    licensed       bar   room of  the  hotel  and   an<\/p>\n<p>additional counter, that too on payment of the<\/p>\n<p>additional fee prescribed therein, could be put up<\/p>\n<p>only within the licensed bar room of the hotel not<\/p>\n<p>within the licensed premises and therefore the<\/p>\n<p>offence      under      section 56(b) of   Abkari  Act is<\/p>\n<p>attracted.\n<\/p>\n<p>      5.    Conditions 1, 2, 3 and 7 of the licence was<\/p>\n<p>considered by this court in detail in Annexure E<\/p>\n<p>order.        Condition No.2 provides that no liquor<\/p>\n<p>shall be sold under the licence for removal outside<\/p>\n<p>the hotel, to anyone including residents of the<\/p>\n<p>hotel providing that liquor may be sold and served<\/p>\n<p>to residents of the hotel in the rooms wherein they<\/p>\n<p>reside or in the restaurants where they partake<\/p>\n<p>food, by the employees of the bar.          It is further<\/p>\n<p>provided that liquor can be served             along with<\/p>\n<p>meals by the side of swimming pools, lawns and the<\/p>\n<p>Crl.M.C.3706 &amp; 3618\/2010       5<\/p>\n<p>roof gardens of the hotel, on obtaining special<\/p>\n<p>annual permit from the Excise Commissioner.         It is<\/p>\n<p>further provided that such a         hotel should have an<\/p>\n<p>exclusive restaurant for the use of families and<\/p>\n<p>others, where no liquor shall be served.           Though<\/p>\n<p>the conditions of licence provide for showing the<\/p>\n<p>boundaries of the licenced premises and boundaries<\/p>\n<p>of the bar room separately, there is         no condition<\/p>\n<p>providing         that     sale of liquor could only be<\/p>\n<p>within the boundaries of the           bar room. On the<\/p>\n<p>other      hand,      Condition  No.2  itself  makes   it<\/p>\n<p>sufficiently clear that, conditions of the licence<\/p>\n<p>provide      for     sale  of  liquor  even  outside  the<\/p>\n<p>boundaries        of    the bar  room.    Condition  No.2<\/p>\n<p>provides that liquor can be sold and served to the<\/p>\n<p>residents of the hotel, in their rooms or in the<\/p>\n<p>restaurant, where they partake food.         At the same<\/p>\n<p>time as far as swimming pools and lawns and roof<\/p>\n<p>gardens are concerned, Condition No.2 provide that<\/p>\n<p>though liquor cannot be sold there though         it can<\/p>\n<p>be served along with the meals by the side of<\/p>\n<p>swimming pools, lawns and the roof gardens.          Thus<\/p>\n<p>Crl.M.C.3706 &amp; 3618\/2010        6<\/p>\n<p>Condition No.2 makes a distinction between the<\/p>\n<p>restaurant and a roof gardens or lawns or swimming<\/p>\n<p>pools.       As far as swimming pools, lawns and roof<\/p>\n<p>gardens of a hotel are concerned, the licensee is<\/p>\n<p>not entitled to sell liquor and           can only serve<\/p>\n<p>liquor there.           On the other hand, as far as the<\/p>\n<p>restaurant is concerned, licensee is entitled to<\/p>\n<p>sell as well as serve liquor inside the restaurant,<\/p>\n<p>though such sale could only be to the residents of<\/p>\n<p>the hotel.        So also   serving liquor along with the<\/p>\n<p>meals, by the side of swimming pools, lawns and<\/p>\n<p>roof gardens could only be to the inmates of the<\/p>\n<p>hotel.         Therefore when condition No.2 makes a<\/p>\n<p>distinction with reference to the restaurant and<\/p>\n<p>roof gardens, whereunder sale is permitted inside<\/p>\n<p>the restaurant but not permitted inside the roof<\/p>\n<p>gardens or lawns, it is clear that        contention that<\/p>\n<p>sale is permitted only inside the bar room cannot<\/p>\n<p>be accepted.           If that be the case, it cannot be<\/p>\n<p>said that putting up a counter in the restaurant or<\/p>\n<p>outside the bar room and          within the licensed bar<\/p>\n<p>premises, would be         violation of Condition No.2 as<\/p>\n<p>Crl.M.C.3706 &amp; 3618\/2010       7<\/p>\n<p>found by this court in Annexure E order.<\/p>\n<p>      6. True, Rule 16 was not considered in the said<\/p>\n<p>decision.        The question is whether Rule 16 makes<\/p>\n<p>any distinction. Rule 16 reads:-\n<\/p>\n<blockquote><p>          16. No premises shall be<\/p>\n<p>          used for the sale or for<\/p>\n<p>          possession       and   use   of<\/p>\n<p>          liquor       unless they   have<\/p>\n<p>          been approved by the Excise<\/p>\n<p>          Commissioner.&#8221;\n<\/p><\/blockquote>\n<p>Sub Rule (1) only provides that no premises shall<\/p>\n<p>be used for           sale or for possession and use of<\/p>\n<p>liquor,      without     prior  sanction  of  the  Excise<\/p>\n<p>Commissioner.           The licence granted enables the<\/p>\n<p>licensee, to sell liquor within             the licenced<\/p>\n<p>premises, in accordance with the conditions of the<\/p>\n<p>licence.       When condition No.2 of the licence enable<\/p>\n<p>the licensee to sell liquor, not only within the<\/p>\n<p>bar room but to the restaurant also, it cannot be<\/p>\n<p>said that Rule 16 is a bar to put up           additional<\/p>\n<p>counter      outside     the  bar  room  but  within  the<\/p>\n<p>premises of the hotel.         Therefore Rule 16 does not<\/p>\n<p>Crl.M.C.3706 &amp; 3618\/2010      8<\/p>\n<p>make any difference on the           earlier finding on<\/p>\n<p>putting up additional counter outside the bar room<\/p>\n<p>and within the licensed premises by a licensee as<\/p>\n<p>held in Annexure E order.          What remains is only<\/p>\n<p>Annexure R1, the Government Order amending      Foreign<\/p>\n<p>Liquor Rules by inserting sub rule 3C after sub<\/p>\n<p>rule 3B of Rule 13.           Sub Rule 3C so inserted<\/p>\n<p>reads:-\n<\/p>\n<blockquote><p>           &#8220;3C. No liquor shall be<\/p>\n<p>           sold     under FL3  licensee<\/p>\n<p>           through more than one bar<\/p>\n<p>           counter       within     the<\/p>\n<p>           licensed bar room of the<\/p>\n<p>           hotel.&#8221;\n<\/p><\/blockquote>\n<blockquote>\n<\/blockquote>\n<p>  The Explanatory Note shows that          there is at<\/p>\n<p>present no provision in the       Foreign Liquor Rules,<\/p>\n<p>to restrict the opening of more than one bar<\/p>\n<p>counter within the licenced bar room of the hotel<\/p>\n<p>and Government considers that if a license holder<\/p>\n<p>is allowed to maintain more than one bar counter,<\/p>\n<p>it will enable him to provide more facilities to<\/p>\n<p>Crl.M.C.3706 &amp; 3618\/2010       9<\/p>\n<p>the customers and therefore it is decided to<\/p>\n<p>permit       FL-3 licence holder to maintain additional<\/p>\n<p>bar counters, within the licenced bar room, by<\/p>\n<p>paying an additional annual fee of Rs.25,000\/- for<\/p>\n<p>each additional bar counter and to make necessary<\/p>\n<p>amendments to the Foreign Liquor Rules.         Thus, by<\/p>\n<p>sub rule 3C, what is provided is putting up<\/p>\n<p>additional          bar counter within the licensed bar<\/p>\n<p>room of the hotel.           True, sub rule 3C does not<\/p>\n<p>provide for putting up additional bar counter<\/p>\n<p>outside the bar room.         But the question is whether<\/p>\n<p>there is any prohibition for putting up additional<\/p>\n<p>bar counter outside the bar room.\n<\/p>\n<p>      7. That is the question which was considered,<\/p>\n<p>in the earlier Crl.M.C. and decided in Annexure E<\/p>\n<p>order.      As it is already found that a licensee can<\/p>\n<p>sell liquor not only within the            bar room but<\/p>\n<p>within the licensed premises, when sub rule 3C<\/p>\n<p>only provide for collecting additional fee for<\/p>\n<p>putting up additional counter within the licensed<\/p>\n<p>premises        and     does not  prohibit   putting  up<\/p>\n<p>additional counter outside the bar room, Rule 3C<\/p>\n<p>Crl.M.C.3706 &amp; 3618\/2010       10<\/p>\n<p>also      will      not   make  any  difference   in  the<\/p>\n<p>conclusions         arrived  at   in  Annexure  E  order.<\/p>\n<p>Therefore by putting up an additional counter as<\/p>\n<p>found at the time of inspection, evidenced by<\/p>\n<p>Annexure A mahazar which are within the licensed<\/p>\n<p>premises, no offence under section 56(b) of Abkari<\/p>\n<p>Act is attracted. Hence the Crimes registered<\/p>\n<p>could only be quashed.\n<\/p>\n<p>      Petitions        are  allowed.
