No.44808 of 2010\n          BUTTU KAHAR @ GUDDU RAM S\/O LATE BABULAL RAM\n                                  Versus\n                         THE STATE OF BIHAR\n                                 -----------\n<\/pre>\n<p>3.   16.03.2011                Heard learned counsel for the petitioner and<\/p>\n<p>                  the state.\n<\/p>\n<p>                           The petitioner seeks bail in a case instituted<\/p>\n<p>                  for the offence under Section 379 of the Indian Penal<\/p>\n<p>                  Code and Section 40 of the Indian Electricity Act.<\/p>\n<p>                           It has been submitted that the petitioner was<\/p>\n<p>                  not arrested at the spot and his name transpired at<\/p>\n<p>                  the confessional statement of the co-accused but there<\/p>\n<p>                  has been no recovery from his possession and he is in<\/p>\n<p>                  custody since 12.7.2007.\n<\/p>\n<p>                               Considering the same, let the petitioner<\/p>\n<p>                  above named, be released on bail on furnishing bail<\/p>\n<p>                  bond of Rs. 5,000\/-(Five thousand) with two sureties<\/p>\n<p>                  of the like amount each or any other surety to be fixed<\/p>\n<p>                  by the court concerned to the satisfaction of learned<\/p>\n<p>                  Judicial Magistrate Ist Class, Nawada in connection<\/p>\n<p>                  with Akbarpur P.S. Case No. 19\/07, subject to the<\/p>\n<p>                  conditions, (i) That one of the bailor will be a close<\/p>\n<p>                  relative of the petitioner who will give an affidavit<\/p>\n<p>                  giving genealogy as to how he is related with the<br \/>\n<span class=\"hidden_text\">                    2<\/span><\/p>\n<p>petitioner. The bailor will undertake to furnish<\/p>\n<p>information to the Court about any change in address<\/p>\n<p>of the petitioner. (ii) That the bailors shall also state<\/p>\n<p>on affidavit that they will inform the court concerned<\/p>\n<p>if the petitioner is implicated in any other case of<\/p>\n<p>similar nature after his release in the present case<\/p>\n<p>and thereafter the court below will be at liberty to<\/p>\n<p>initiate the proceeding for cancellation of bail on<\/p>\n<p>ground of misuse, (iii) That the petitioner will give an<\/p>\n<p>undertaking that he will receive the police papers on<\/p>\n<p>the given date and be present on date fixed for charge<\/p>\n<p>and if he fails to do so on two given dates and delays<\/p>\n<p>the trial in any manner, his bail will be liable to be<\/p>\n<p>cancelled   for   reasons   of   misuse,   (iv)   That   the<\/p>\n<p>petitioner will be well represented on each date if he<\/p>\n<p>fails to do so on two consecutive dates, his bail will be<\/p>\n<p>liable to be cancelled, (v) In view of the antecedents of<\/p>\n<p>the petitioner, the petitioner is directed to appear<\/p>\n<p>before the Superintendent of Police, Nalanda within<\/p>\n<p>fifteen days of his release with a copy of this order and<\/p>\n<p>every two weeks thereafter for the next one year. The<\/p>\n<p>conduct of the petitioner will be kept under watch in<\/p>\n<p>this period by the superintendent of Police concerned<br \/>\n<span class=\"hidden_text\">                            3<\/span><\/p>\n<p>         and if it is found wanting in any respect, a report shall<\/p>\n<p>         be made to the court concerned by him to initiate a<\/p>\n<p>         proceeding for cancellation of bail for reasons of<\/p>\n<p>         misuse of bail. After reporting to the Superintendent<\/p>\n<p>         of Police, a certificate will be filed by the petitioner<\/p>\n<p>         before the court concerned.\n<\/p>\n<\/p>\n<pre>Fahad.
