The order of learned Single Judge<br \/>\n\twas read to us, and in this order, the learned Single Judge was<br \/>\n\tconstrained to observe that in second call, the learned counsel for<br \/>\n\tthe petitioner had remained absent. Therefore, the Court had<br \/>\n\tproceeded to decide the petition.\n<\/p>\n<p>The<br \/>\n\tappellant was a Chowkidar, appointed with respondent &#8211; Trust.<br \/>\n\tThe chargesheet was issued to him on 5.1.1996. On 15.1.1996, the<br \/>\n\tnotice was issued and, thereafter, inquiry proceeded and the inquiry<br \/>\n\twas conduced on 24.6.1996. The charges levelled against the<br \/>\n\tdelinquent were held proved. According to the Tribunal, there was no<br \/>\n\tinfirmity in the inquiry so conducted. The entire procedure, as<br \/>\n\tprescribed in law, was followed, and not only that, the order which<br \/>\n\twas finally passed was after the inquiry report was sent to the<br \/>\n\tVice-Chancellor of the University for approval, which was approved<br \/>\n\tby the Vice-Chancellor. Hence, the order of dismissing the appellant<br \/>\n\tfrom service was passed and upheld by the Tribunal.\n<\/p>\n<p>The<br \/>\n\tlearned Single Judge has also dealt with the question and have found<br \/>\n\tthat serious charges of insubordination and indiscipline were there,<br \/>\n\twhich we are delineating hereinafter. For ready reference, about 14<br \/>\n\tinstances were quoted by the Inquiry Officer, of serious dereliction<br \/>\n\tof duties of the appellant, which are mentioned hereunder:-\n<\/p>\n<p>The<br \/>\n\tChowkidar is found irregular in his duties.\n<\/p>\n<p>Have<br \/>\n\tleft the place without intimation, and even though he is not<br \/>\n\tpresent, has signed the muster-roll.\n<\/p>\n<p>Has<br \/>\n\tbeen found in deep sleep during the duty hours and though warned<br \/>\n\tmany a times, no change in his behaviour.\n<\/p>\n<p>Behaving<br \/>\n\tin insulting manner with staff members by using filthy language and<br \/>\n\tthough warned, no improvement is shown.\n<\/p>\n<p>He<br \/>\n\tis found carrying out duty of Home Guard without the permission of<br \/>\n\tthe Institution.\n<\/p>\n<p>Used<br \/>\n\tiron bar, which is the property of the Institution for his personal<br \/>\n\tuse without permission.\n<\/p>\n<p>Though<br \/>\n\tunder suspension, has kept the key of main door, battery and<br \/>\n\tumbrella, which is  the property of the Institution, in his custody,<br \/>\n\tillegally, and not deposited the same and have informed that he will<br \/>\n\tdeposit the same at ease. This, keeping the keys of main door in his<br \/>\n\tcustody, though under suspension, would be very harmful for the<br \/>\n\tinstitution.\n<\/p>\n<p>Has<br \/>\n\tbeen found threatening staff members during service.\n<\/p>\n<p>The<br \/>\n\tinstitution has suffered financial loss on account of theft and<br \/>\n\tdamage caused to the properties, due to total negligence and his<br \/>\n\thabit of sleeping during duty hours and for this many notices are<br \/>\n\tgiven to him, but he has not shown any repentance for his acts.\n<\/p>\n<p>To<br \/>\n\tRemain absent and leave duty place as per his wish without taking<br \/>\n\tpermission.\n<\/p>\n<p>To<br \/>\n\tsign the muster-roll in advance and irregularly and refusal to<br \/>\n\taccept the letters sent by the Institution.\n<\/p>\n<p>Said<br \/>\n\twatchman and other two persons are highhanded and having disputed<br \/>\n\tnature. On that issue, Manager, Daffodil Pharma, Kadi had given<br \/>\n\tcomplaint in respect of the theft and disturbance which had taken<br \/>\n\tplace in his company wherein it has been found that the name of<br \/>\n\tnight Watchman Jayrambhai is there as accused along with other<br \/>\n\taccused.\n<\/p>\n<p>Over<br \/>\n\tand above this, Principal of Shri Pramukh Swami Science and<br \/>\n\tH.D.Patel Arts College, Kadi who is having very responsible position<br \/>\n\tand status in the establishment, it is proved that the dispute was<br \/>\n\traised with him and insultive and abusive language was used with him<br \/>\n\tand threat was given for beating him. Said matter could be<br \/>\n\tconsidered as too much serious and such which cannot be condoned.\n<\/p>\n<p>Inspite<br \/>\n\tof repeated notices given by the Principal of the establishment to<br \/>\n\tsaid night Watchman for his different type of misconduct, no<br \/>\n\timprovement has been found in the conduce of the said person nor he<br \/>\n\thas expressed sorry for the same.\n<\/p>\n<p>If<br \/>\n\tthe misconduct, intolerable negligence of any subordinate officer<br \/>\n\tresults in financial loss to the establishment and if he is found to<br \/>\n\thave been behaving in improper manner by administering threats and<br \/>\n\tdoes not show any improvement inspite of giving repeated notices or<br \/>\n\twarning and if he is not having any grievance in respect of his<br \/>\n\tconduct, then such type of notices or warning would result into<br \/>\n\tunnecessary burden on the administration of the establishment. Not<br \/>\n\tonly that, but, if such type of misconduct is permitted to continue<br \/>\n\tfor a long period an no actions are taken for the same, then it<br \/>\n\twould be having adverse effect on the other employees by passage of<br \/>\n\ttime and that would adversely and seriously affect the<br \/>\n\tadministration, and the administration cannot run properly.\n<\/p>\n<p>In<br \/>\n\tview of the aforesaid, the learned Single Judge was of the opinion<br \/>\n\tthat the order of dismissal passed against the appellant was fully<br \/>\n\tjustified. Since the learned counsel for the appellant was not<br \/>\n\tbefore us, we, with the help of learned counsel for the respondent &#8211;<br \/>\n\tTrust examined the record, perused the relevant material and we find<br \/>\n\tthat the conclusion arrived by the Tribunal and the learned Single<br \/>\n\tJudge are prima-facie in accordance with law. No case for judicial<br \/>\n\treview is made out, when the inquiry was made as per the law laid<br \/>\n\tdown and after giving due opportunity to the delinquent. We do not<br \/>\n\tfind any interference is called for. No costs.
