PATTANAIK (J)\n\nCITATION:\n JT 1996 (5)   423\t  1996 SCALE  (4)299\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\t\t    WITH<br \/>\n\t     CIVIL APPEAL NOS. 7617-50 OF 1996<br \/>\n       (Arising out of SLP (C) Nos.27604-37 of 1995)<br \/>\n\t\t\t O R D E R<br \/>\n     Leave granted.\n<\/p>\n<p>     We have heard learned counsel on both sides.<br \/>\n     By order  dated December 4, 1995, this Court had issued<br \/>\nnotice and  directed interim  stay of  the execution  of the<br \/>\nawards, subject\t to the\t condition that\t the appellant would<br \/>\npay 50%\t of the\t enhanced compensation.\t We are\t informed by<br \/>\nShri Goswami, learned senior counsel for the appellant, that<br \/>\nthe order  has been  complied with. On the other hand, it is<br \/>\ncontended for  the respondents\tthat the  deposit 50% of the<br \/>\namount was  not in  terms of  the decree  of  the  reference<br \/>\nCourt. Be it as it may, the appellant is directed to deposit<br \/>\n50% of the enhanced compensation as awarded under Section 26<br \/>\nof the\tLand Acquisition  Act, 1894  in the decree and award<br \/>\nwhich is  the subject  matter of  the present  appeals.\t The<br \/>\nrespondents are\t at liberty  to withdraw  the  same  without<br \/>\nfurnishing any security. The withdrawal of 50% of the amount<br \/>\nwill be\t subject to  the result\t in the\t appeal. In case the<br \/>\nappeals are  allowed, to  that extent  the respondents shall<br \/>\nrestitute the amounts withdrawn.\n<\/p>\n<p>     Pursuant to  the order passed by this Court on December<br \/>\n4, 1995, an enquiry was held into the allegation made by the<br \/>\nrespondents in their counter affidavit, in particular by one<br \/>\nMr. B.S.  Hans S\/o Rattan Singh that one B.K. Mehta, dealing<br \/>\nclerk  of   the\t Defence   Estate  Office,   Gopinath  Bazar<br \/>\napproached the Claimants and asked them to pay 2% commission<br \/>\npromising that\tthe decretal  amount will  be deposited\t one<br \/>\nR.K. Sharma,  Director,\t Defence  Estate,  Western  Command,<br \/>\nChandigarh came to be appointed as an Enquiry Office. In his<br \/>\nreport dated  December 26,  1995 in paragraph 28, he came to<br \/>\nthe conclusion\tthat there  is no  evidence in regard to the<br \/>\nallegation made by the Hans and members of the Bar. On going<br \/>\nthrough the  report submitted  by him,\twe are\tat a loss to<br \/>\nunderstand his conclusion in the face of the material placed<br \/>\nbefore him.  However, Mr. Goswami informed us that a regular<br \/>\nenquiry has  been ordered  and it would be conducted in this<br \/>\nmatter. It  is needless\t to say that the report submitted by<br \/>\nR.K. Sharma  is not  even worthy  of salt to look at and was<br \/>\nnot stemmed  with a  sense of responsibility but with a zeal<br \/>\nto shield  the corrupt\tand the\t reasons are not far to seek<br \/>\nand  ex\t  facie\t eloquent.   The  Enquiry   Officer   should<br \/>\nindependently go  into and  conduct  the  enquiry  and\ttake<br \/>\nappropriate action  and submit\tthe report  to this Court on<br \/>\nthe final action taken in that matter.\n<\/p>\n<p>     The appeals are accordingly disposed of.
