SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 05\/02\/2009 \n\n \n\nORAL\nJUDGMENT<\/pre>\n<p>By<br \/>\n\tway of this petition under Article 226 of the Constitution of India,<br \/>\n\tthe petitioners have prayed<br \/>\n\tfor appropriate writ, order and\/or directions  directing the<br \/>\n\trespondents authorities to consider case of the petitioners  for<br \/>\n\tpromotion for the post of Dy.Mamlatdar strictly in accordance with<br \/>\n\tRule 7 and other Rules of LRQE Rules 1978 and as amended in 1982 and<br \/>\n\tto give a consequential benefits to the petitioners.\n<\/p>\n<p>It<br \/>\n\tappears that at the relevant time, Provisional Seniority List was<br \/>\n\tprepared on the basis of which the petitioners have claimed<br \/>\n\tpromotion, however, the said Provisional Seniority List  was subject<br \/>\n\tto challenge before this Court by way of Special Civil Application<br \/>\n\tNo. 2198 of 1988 and other cognate matters. It appears that vide<br \/>\n\tinterim order dtd.29\/12\/1988, the Division Bench of this Court<br \/>\n\tpassed the following order:-\n<\/p>\n<p> Rule.\n<\/p>\n<p>By way of interim<br \/>\nrelief, it is directed that the respondents shall not revert the<br \/>\npetitioners from the posts of Deputy Mamlatdars till those who passed<br \/>\nthe Lower Revenue Qualification Examination after the petitioners and<br \/>\nwere promoted later are retained in the posts of Deputy Mamlatdar.<br \/>\nSubject to this restriction, it will be open to the respondents to<br \/>\noperate provisional seniority lists  prepared by them for the purpose<br \/>\nof reversion. In respect to those who have passed the examination at<br \/>\nthe same time and were promoted at the same time, last come first go<br \/>\nprinciple will apply.\n<\/p>\n<p>The respondents<br \/>\nare further directed to revise the provisional seniority list for<br \/>\neach district so as to make them consistent with the guidelines<br \/>\nissued by the Government along with its letter dated 15\/5\/1986. They<br \/>\nare further directed to complete the said process within one month<br \/>\nfrom today and submit copies of such lists to this Court on or before<br \/>\n6\/2\/1988, for granting such interim relief as may be thought fit.<br \/>\nThe interim  relief granted by the present order will continue till<br \/>\nfresh orders are passed thereafter, in this behalf.\n<\/p>\n<p>S.O. to 6\/2\/1988.\n<\/p>\n<p>Direct service to resp.Nos.1 and 2 permitted.\n<\/p>\n<p>It<br \/>\n\tis reported that the said Special Civil Application No. 2198 of 1988<br \/>\n\tand other cognate matters  are already disposed of  by the Division<br \/>\n\tBench of this Court vide judgement and order dtd.18\/1\/2006.<br \/>\n\tTherefore,  now the List would have been revised and\/or further<br \/>\n\toperated and therefore, the respective parties are to act as per the<br \/>\n\tdecision of the Division Bench in the aforesaid Special Civil<br \/>\n\tApplication No. 2198 of 1988 and other cognate matters and to<br \/>\n\tconsider the case of the petitioners, if not considered so far.
