ii2,_”l’l”ieiiClvaii1ni_ pietition was lodged by the 1st respondent, who<\/p>\n
suist_ainedi'”=.injuries” in a road traffic accident occurred on<\/p>\n
i  The claimant was a pillion rider on a motor cycle on<\/p>\n
i\ufb02iiaccountiieffthe rash and negligent driving of the driver of the<\/p>\n

La}<\/p>\n
KSRTC bus near Ganebail on NH\u00bb–4A between Khanapur and
\nBelgaum road, the driver of the bus dashed against the motor<\/p>\n
cycle, as a result of which the claimant sustained grievous injuriets.<\/p>\n
He was immediately shifted to KLE Hsopital, Belgaurn hevvvasjv” <\/p>\n
as an inpatient for 21 days. He sustained the foll_ovvin–g <\/p>\n
right fronto parietal regior, fracture of tibia; lefti\ufb02leg i’r_aotAur.eGIr” <\/p>\n
clavicle and other injuries. He was agedr.aboutfIL i’ye’ars.i<\/p>\n
According to him he was at   and he had
\nsecured a job in Gulf Country. 12,000\/–, on
\naccount of the    id’uetj\/ at Gulf Country.
\nIt is this case thation   and other injuries
\nto the body   cornjoletely paralysed and he is
\ndepending on ojtheirsiei\/erii.i”the nature call. He examined
\ntwo Doctorg ,()une   Surgeon and other is a Neuro
\n ~~i:\/}l{(.3C3\u20aci’1’I:lil1g’ toj”1\\leuro Surgeon, he is suffering from 40%<\/p>\n
disabjilitj\/.j_etoi  other parts of the body, as a result of<\/p>\n
 hjiwiiich he is unahlettoi drive the vehicle and he cannot carry on the<\/p>\n
“-\u00abday\u00a2_to\u00ab~day acvtivities. According to Orthopedic Surgeon, on<\/p>\n
 4″accou–ntr.of’j”the injuries sustained to right lower limb and right<\/p>\n
i  he has sustained disability of 60%. The Tribunal<\/p>\n
\ufb01g’<\/p>\n
‘\\<\/p>\n
5. So far as the 1″ point is concerned, admittedly the KSRTC
\nBus passed completely on his right side and chargesheet is \ufb01led<\/p>\n
against the driver of KSRTC. The evidence of petitioner in regard<\/p>\n
to in the manner in which the accident occurred has_Mn_iotViibe’en”\u00abV<\/p>\n
challenged seriously by the appellant. Therefore,  i<\/p>\n
has to be held against the appellant.\n<\/p>\n
6. So far as the 2nd poinitfisi  he has
\nsuffered severe fractureyto right…ti.b_ia   and severe
\nhead injury, which   was in hospital
\nfor 21 days   taken treatment.\n<\/p>\n
Considering the nature  sustained by him, this Court
\ndoes not see error  sum of Rs. 50,000 \/- under
\nthe head pain arid  Similarly considering the total
\n igjroducediiibymihirn and total number of days of<\/p>\n
 of Rs.50,000\/– is awarded under the said<\/p>\n
 also.__can,noti’the stated to be on higher side. For future<\/p>\n
 expenses a sum of Rs.25,000\/– is awarded, which<\/p>\n
 ‘ i*occ–u.rred _to’}us is on lower side, considering the nature of disability<\/p>\n
 suffering. Therefore, We do not see any reasons to interfere<\/p>\n

  he had futureii\u00e9prospects in his life and that he was working as
\n“–\u00abaj\u00a7:m_o’tor~cycleinechanic and his income would not be less than<\/p>\n
 Rs. 5,000\/– per month. In the circumstances, we do<\/p>\n
with the compensation awarded under the said head. “The
\nTribunal has awarded a sum of Rs.ES0,000\/– under the head
\namenities in life. Admittedly, the petitioner was
\nmarriage prospects has become bleak. In.Jaddition’.*to”thTat ii
\nto depend upon others even to pass
\nevidence has not been challenged bydtheg appellant.
\nopinion that awarding of Rs.50,000\/iiiandger ithci,.ii:l’iiead:i}loss of\ufb02 _
\namenities of life also cannot be ieonisidereds_then_nwhat 1\u00b0-Pa\ufb01f\u00e9s in
\nregard to the compensation    future loss of
