MC No.401 of 2010-E\n<\/p>\n<p>                  &#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;-<br \/>\n                   Dated 11th February 2010<\/p>\n<p>                                Order<\/p>\n<p>            This is a petition filed under S.482 of the Code<\/p>\n<p>of Criminal Procedure, seeking to have the proceedings in<\/p>\n<p>Crime No.1446\/09          of    Muvattupuzha           Police Station,<\/p>\n<p>pending before the JFCM Court, Muvattupuzha, quashed<\/p>\n<p>and all further proceedings dropped.\n<\/p>\n<p>            2.  The petitioner is the sole accused in the<\/p>\n<p>above said crime. The marriage between the petitioner and<\/p>\n<p>the defacto complainant was solemnized on 16.08.1992.<\/p>\n<p>Eversince then, they had been living in the matrimonial<\/p>\n<p>house. On 11.08.2009, the second respondent laid a<\/p>\n<p>complaint before the Muvattupuzha Police Station, alleging<\/p>\n<p>acts of cruelty from the part of the petitioner, based on<\/p>\n<p>which, Crime No.1446\/09 was registered for the offence<\/p>\n<p>punishable under S.498A IPC.\n<\/p>\n<p><span class=\"hidden_text\">CRMC 401\/10                       2<\/span><\/p>\n<p>           3. It is unnecessary to go into the details of the<\/p>\n<p>case for the simple reason that this petition can be<\/p>\n<p>disposed of on a very short ground. The petitioner as well<\/p>\n<p>as the second respondent\/defacto complainant have filed a<\/p>\n<p>petition before this Court, pointing out that    they have<\/p>\n<p>settled the disputes and differences between them and<\/p>\n<p>they are living together now. The learned counsel for the<\/p>\n<p>second respondent\/defacto complainant submitted that the<\/p>\n<p>complainant has no further grievance in the matter and that<\/p>\n<p>she has no objection in dropping further proceedings.<\/p>\n<p>           4. True, the offence under S.498A may not be<\/p>\n<p>compoundable. But, the fact remains that the parties have<\/p>\n<p>settled their disputes and the complainant has no further<\/p>\n<p>grievance in the matter.     Therefore, no purpose will be<\/p>\n<p>served by continuing the proceedings in the above said<\/p>\n<p>crime. In the light of the decisions in <a href=\"\/doc\/1442974\/\">Madan Mohan Abbot<\/p>\n<p>v. State of Punjab<\/a> (2008(3) KLT 19 SC) and Manoj<\/p>\n<p>Sharma v. State (2008(4) KLT 417), it is only proper that<\/p>\n<p><span class=\"hidden_text\">CRMC 401\/10                     3<\/span><\/p>\n<p>the proceedings are given a quietus.
