GOVERNMENT PLEADER for Respondent(s) : 2 -\n3. \n=========================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE Z.K.SAIYED\n\t\t\n\t\n\n \n\nDate\n: 07\/10\/2011\n \n\nORAL\nJUDGMENT<\/pre>\n<p>\tThis<br \/>\n\tpetition is directed against the order of detention dated 14th<br \/>\n\tJuly, 2011 passed by respondent No.1, in exercise of powers<br \/>\n\tconferred under Section 3(1)\/3(2) of the Gujarat Prevention of Anti<br \/>\n\tSocial Activities Act, 1985 (in short &#8220;the Act&#8221;) by<br \/>\n\tdetaining the detenue as a &#8220;bootlegger&#8221; as defined under<br \/>\n\tSection 2(b) of the Act.\n<\/p>\n<p>\tLearned<br \/>\n\tAdvocate for the detenue submits that registration of FIR&#8217;s itself<br \/>\n\tcannot lead to disturbance of even tempo of public life and<br \/>\n\ttherefore the public order.  He further submits that, except FIR&#8217;s<br \/>\n\tregistered under the Bombay Prohibition Act, there was no other<br \/>\n\tmaterial before the detaining authority whereby it could be inferred<br \/>\n\treasonably that the detenue is a &#8216;bootlegger&#8217; within the meaning of<br \/>\n\tSection 2(b) of the Act and required to be detained as the detenue&#8217;s<br \/>\n\tactivities are prejudicial to the maintenance of public health and<br \/>\n\tpublic order.  In support of the above submission, learned Counsel<br \/>\n\tfor the detenue has placed reliance on judgment of the Apex Court in<br \/>\n\tthe case of <a href=\"\/doc\/1169973\/\">Piyush Kantilal Mehta vs. Commissioner of Police,<br \/>\n\tAIR<\/a> 1989 Supreme Court 491 and the recent judgment dated<br \/>\n\t28.03.2011 passed by the Division Bench of this Court (Coram : S.K.<br \/>\n\tMukhopadhaya C.J. and J.B. Pardiwala, J.) in Letters Patent<br \/>\n\tAppeal No.2732 of 2010 in Special Civil Application No.9492 of 2010<br \/>\n\t<a href=\"\/doc\/1733522\/\">(Aartiben vs. Commissioner of Police)<\/a> which would squarely<br \/>\n\thelp the detenue.\n<\/p>\n<p>\tLearned<br \/>\n\tAssistant Government Pleader submitted that registration of FIR&#8217;s<br \/>\n\twould go to show that the detenue had, in fact, indulged into such<br \/>\n\tactivities, which can be said to be disturbing the public health and<br \/>\n\tpublic order and in view of sufficient material before the detaining<br \/>\n\tauthority to pass the order of detention, no interference is called<br \/>\n\tfor by this Court in exercise of its power under Article 226 of the<br \/>\n\tConstitution of India.\n<\/p>\n<p>\tHaving<br \/>\n\theard the rival submissions of the parties and perused the record of<br \/>\n\tthe case, I am of the view that FIR&#8217;s registered under the Bombay<br \/>\n\tProhibition Act alone cannot be said to be sufficient enough to<br \/>\n\tarrive at subjective satisfaction to the effect that the activities,<br \/>\n\tas alleged, are prejudicial to the public order or lead to<br \/>\n\tdisturbance of public order.  There has to be nexus and link for<br \/>\n\tsuch activities with disturbance of the public order.  On careful<br \/>\n\tperusal of the material available on record and the ratio laid down<br \/>\n\tby the Apex Court in the case of  Piyush Kantilal Mehta<br \/>\n\t(supra) and the recent judgment dated 28.03.2011 passed by the<br \/>\n\tDivision Bench of this Court (Coram : S.K. Mukhopadhaya C.J. and<br \/>\n\tJ.B. Pardiwala, J.) in Letters Patent Appeal No.2732 of 2010<br \/>\n\tin Special Civil Application No.9492 of 2010 <a href=\"\/doc\/1733522\/\">(Aartiben vs.<br \/>\n\tCommissioner of Police), I<\/a> am of the view that the<br \/>\n\tactivities of the detenue cannot be said to be in any manner<br \/>\n\tprejudicial to the public order and therefore, the order of<br \/>\n\tdetention passed by the detaining authority cannot be sustained and<br \/>\n\tis required to be quashed and set aside.\n<\/p>\n<p>\tIn<br \/>\n\tthe result, the petition is allowed.  The order of detention dated<br \/>\n\t14th July, 2011 is quashed and set aside.  The detenue,<br \/>\n\tis ordered to be set at liberty forthwith, if not required in<br \/>\n\tconnection with any other case.
