                     this revision application under Section 53 of<\/p>\n
                     the Juvenile Justice (Care and Protection of<\/p>\n
                     Children)     Act,      2000      against        the       order      dated<\/p>\n
                     19.07.2011       passed      by     the       learned       Additional<\/p>\n
                     Sessions      Judge-II,           Supaul         in        Cr.     Appeal<\/p>\n
                     No.04\/2011(s)          by      which          the        order        dated<\/p>\n
                     19.01.2011        passed       by    the       learned           Juvenile<\/p>\n
                     Justice     Board,       Supaul       in      Supaul        P.S.       Case<\/p>\n
                     No.113\/2010,        G.R.     No.445\/10           for       the   offence<\/p>\n
                     punishable under Sections 302\/34 of the I.P.C.<\/p>\n
                     has   been       confirmed        and      the      prayer       of     the<\/p>\n
                     petitioner for grant of bail has been rejected.<\/p>\n
                                  Heard       learned           counsel           for        the<\/p>\n
                     petitioner and learned counsel for the State.<\/p>\n
                                  The    main     contention             of     the    learned<\/p>\n
                     counsel      for       the     petitioner             is     that       the<\/p>\n
                     petitioner       was     declared         a    juvenile          by     the<\/p>\n
                     learned Juvenile Justice Board vide order dated<\/p>\n
                     29.10.2010. His prayer for bail was rejected by<\/p>\n
                     the   Juvenile       Justice        Board      vide        order      dated
\n                   2<\/span><\/p>\n
19.01.2011.      Against        the     said        order,    the<\/p>\n
petitioner preferred Cr. Appeal No.04\/11 (S),<\/p>\n
which has been rejected by the impugned order<\/p>\n
on    the     ground     that    the        release     of    the<\/p>\n
petitioner is not in the interest of justice<\/p>\n
since    he   will     fall   into     association      of    the<\/p>\n
known criminals and expose him to moral danger<\/p>\n
and     his   release    would       affect     the    ends    of<\/p>\n
justice. He has further submitted that there is<\/p>\n
no material on record to show that the release<\/p>\n
of    the     petitioner        will        bring     him     into<\/p>\n
association with known criminal and expose him<\/p>\n
to moral, physical and psychological danger and<\/p>\n
his release would defeat the ends of justice.<\/p>\n
It is further submitted that parents of the<\/p>\n
petitioner will take care of the petitioner and<\/p>\n
they will produce the petitioner in the court<\/p>\n
as and when required. He has further submitted<\/p>\n
that the petitioner is a student of class X of<\/p>\n
William High School, Supaul. He has been in<\/p>\n
custody since 14.05.2010.\n<\/p>\n
               Learned counsel for the State could<\/p>\n
not controvert the contention of the petitioner<\/p>\n
while opposing the prayer of the petitioner.<\/p>\n
               After    hearing       the    learned    counsel<\/p>\n
for both the parties and on perusal of the
\n                      3<\/span><\/p>\n
materials       on       record,       it     appears       that       the<\/p>\n
contention      of        the    learned          counsel       for    the<\/p>\n
petitioner is correct. There is no material on<\/p>\n
record     to     show         that     the       release       of     the<\/p>\n
petitioner will bring him into association with<\/p>\n
known    criminal          and        expose       him     to     moral,<\/p>\n
physical     and         psychological            danger        and   his<\/p>\n
release would defeat the ends of justice.<\/p>\n
            Considering                 the          facts             and<\/p>\n
circumstances stated above, in my opinion, the<\/p>\n
impugned order is not fit to be sustained. The<\/p>\n
impugned    order         is     set   aside.       The     petitioner<\/p>\n
above-named is directed to be released on bail<\/p>\n
on   furnishing           bail    bond       of     Rs.10,000\/-(ten<\/p>\n
thousand only) with two sureties of the like<\/p>\n
amount   each        to    the     satisfaction           of     learned<\/p>\n
Juvenile Justice Board, Supaul                       in connection<\/p>\n
with Supaul P.S. Case No.113\/10, G.R.No.445\/10<\/p>\n
on the following terms and conditions :<\/p>\n
            (i)       One of the bailors will be the<\/p>\n
father of the petitioner.\n<\/p>\n
            (ii)      Father       of       the    petitioner         will<\/p>\n
produce the petitioner in the court if and when<\/p>\n
required.\n<\/p>\n
            (iii) The petitioner will not indulge<\/p>\n
in similar or in any other offence.
\n                              4<\/span><\/p>\n
                     (iv)    In case of his absence for two<\/p>\n
          consecutive dates or in case of violation of<\/p>\n
          the terms of the bail, his bail bond will be<\/p>\n
          liable to be cancelled by the learned Juvenile<\/p>\n
          Justice    Board       and   he   will   be   taken   into<\/p>\n
          custody.\n<\/p>\n
                     In   the     result,   this   application    is<\/p>\n
          allowed.\n<\/p>\n
                     Let a copy of this order be sent to<\/p>\n
          the Court below through Fax at the cost of the<\/p>\n
          petitioner.\n<\/p>\n
