SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 24\/03\/2011 \n\n \n\nORAL\nORDER<\/pre>\n<p>1.\tBy<br \/>\nway of this petition under Article 226 of the Constitution of India,<br \/>\nthe petitioners have prayed for following relief:\n<\/p>\n<p>(a).\tTo<br \/>\nissue a writ of mandamus or any other appropriate writ, directions<br \/>\nand\/ or orders directing and\/ or commanding the respondents and in<br \/>\nparticular the Collector Shri, Amreli to handover back the said land<br \/>\nbearing Survey No.629 admeasuring Acres H-6-49-52 + Pot Kharaba<br \/>\n0-8-09 totally admeasuring H-6-57-61 situate at Babara, Tal: Babara,<br \/>\nDist. Amreli to the petitioners;\n<\/p>\n<p>(b).\tPending<br \/>\nthe hearing and final disposal of petition, direct the respondents<br \/>\nand in particular the Collector Shri, Amreli to maintain status quo<br \/>\nof the land in question;\n<\/p>\n<p>2.\tAt<br \/>\nthe outset, it is required to be noted that the land in question was<br \/>\nalready given to the then erstwhile Bombay State by the grandfather<br \/>\nof the petitioners somewhere in the year 1960. It also appears from<br \/>\nthe mutation entry which was recorded in the year 1960 that more<br \/>\nparticularly entry no. 759 dated 17.1.1960, the land in question was<br \/>\ngiven by the grandfather of the petitioners i.e. Dadabhai Kathadbhai<br \/>\nto the erstwhile State of Bombay, Agriculture Department, by way of<br \/>\nsome settlement and \/ or understanding. Once the land in question is<br \/>\nvested absolutely in favour of the State Government, it is not open<br \/>\nfor the petitioner being heirs of the original land owner Dadabhai<br \/>\nKathadbhai  to claim or reclaim or pray for regrant of the land in<br \/>\nquestion as State Government has become absolute owner of the land in<br \/>\nquestion.
