No. 1063 of 2010\n               ======================\n           Dated, this the 26th day of March, 2010.\n\n                             O R D E R\n<\/pre>\n<p>      In this Revision Petition filed under Section 397 read with<\/p>\n<p>Sec. 401     Cr.P.C. the petitioner who was the accused in C.C.<\/p>\n<p>No.47 of 2009 on the file of the Judicial First Class Magistrate-II,<\/p>\n<p>Kasaragod challenges the conviction entered and the sentence<\/p>\n<p>passed against him for an offence punishable under Sec. 138 of<\/p>\n<p>the Negotiable Instruments Act, 1881 (hereinafter referred to as<\/p>\n<p>&#8216;the Act&#8217;). The   cheque    amount     was    Rs.3,50,000\/-.    The<\/p>\n<p>fine\/compensation ordered by the lower appellate court is<\/p>\n<p>Rs.3,50,000\/-.\n<\/p>\n<p>      2.    I heard the learned counsel for the Revision Petitioner<\/p>\n<p>and the learned Public Prosecutor.\n<\/p>\n<p>      3.    The learned counsel appearing for the Revision<\/p>\n<p>Petitioner re-iterated the contentions in support of the Revision.<\/p>\n<p>      4.     The courts below have concurrently held that the<\/p>\n<p>cheque in question was drawn by the petitioner in favour of the<\/p>\n<p>complainant, that the complainant had validly complied with<\/p>\n<p>clauses (a) and (b) of the proviso to Section 138 of the Act and<\/p>\n<p><span class=\"hidden_text\">Crl.R..P. No. 1063\/2010           -:2:-<\/span><\/p>\n<p>that the Revision Petitioner\/accused failed to make the payment<\/p>\n<p>within 15 days of receipt of the statutory notice.            Both the<\/p>\n<p>courts have considered and rejected the defence set up by the<\/p>\n<p>revision petitioner while     entering the conviction.        The said<\/p>\n<p>conviction has been recorded after a careful evaluation of the<\/p>\n<p>oral and documentary evidence. This Court sitting in the rarefied<\/p>\n<p>revisional jurisdiction will be loath to interfere with the findings of<\/p>\n<p>fact recorded by the courts below concurrently. I do not find any<\/p>\n<p>error, illegality or impropriety in the conviction so recorded<\/p>\n<p>concurrently by the courts below and the same is hereby<\/p>\n<p>confirmed.\n<\/p>\n<p>       5.       What now survives for consideration is the legality of<\/p>\n<p>the sentence imposed on the revision petitioner.        In the light of<\/p>\n<p>the    decision      of the  Supreme      Court   in     Ettappadan<\/p>\n<p>Ahammedkutty v. E.P. Abdullakoya &#8211; 2008 (1) KLT 851<\/p>\n<p>default sentence cannot be imposed for the enforcement of an<\/p>\n<p>order for compensation under Sec. 357 (3) Cr.P.C.                I am,<\/p>\n<p>therefore, inclined to modify the sentence to one of fine only.<\/p>\n<p>Accordingly, for the conviction under Section 138 of the Act the<\/p>\n<p>revision petitioner is sentenced to pay a fine of Rs.3,55,000\/-<\/p>\n<p><span class=\"hidden_text\">Crl.R..P. No. 1063\/2010           -:3:-<\/span><\/p>\n<p>(Rupees three lakhs and fifty five thousand only).            The<\/p>\n<p>said fine shall be paid as compensation under Section 357 (1)<\/p>\n<p>Cr.P.C. The revision petitioner is permitted either to deposit the<\/p>\n<p>said fine amount before the Court below        or directly pay the<\/p>\n<p>compensation to the complainant within nine months from<\/p>\n<p>today and produce a memo to that effect before the trial Court in<\/p>\n<p>case of direct payment. If he fails to deposit or pay the said<\/p>\n<p>amount within the aforementioned period he shall suffer simple<\/p>\n<p>imprisonment for three months by way of default sentence.<\/p>\n<p>       In the result, this Revision is disposed of confirming the<\/p>\n<p>conviction entered but modifying the sentence imposed on the<\/p>\n<p>revision petitioner.\n<\/p>\n<p>       Dated this the 26th day of March, 2010.\n<\/p>\n<\/p>\n<p>                                          V.
