Shah, learned Additional Public Prosecutor waives service of<br \/>\nrule on behalf of the respondent-State.\n<\/p>\n<p>2.\tOn<br \/>\n8th March 2011,<br \/>\nlearned Additional Public Prosecutor was granted time to see that<br \/>\nDistrict<br \/>\nSuperintendent of Police, Sabarkantha files report after inquiring<br \/>\npersonally or through a responsible officer on the point wither the<br \/>\napplicant can be released on his personal bond.  The District<br \/>\nSuperintendent of Police, Sabarkantha was also expected to make<br \/>\ninquiry  at two villages, namely, (i) village Narsoli, Taluka<br \/>\nBhiloda, District Sabarkantha, and (ii) village Kundal, Taluka<br \/>\nModasa, District Sabarkantha.\n<\/p>\n<p>3.\tThe<br \/>\nlearned Additional Public Prosecutor placed on record communication<br \/>\ndated 13.03.2011 addressed by the District Superintendent of Police,<br \/>\nSabarkantha at Himmatnagar to the learned Additional Public<br \/>\nProsecutor.  The report is prepared on the basis of the statements<br \/>\nrecorded of various persons like brothers of the accused, namely,<br \/>\nGalbaji Lalaji and Joitabhai Lalaji and also one Nanjibhai Pujabhai<br \/>\nof Kundal, Tal.Modasa, Dist.Sabarkantha.\n<\/p>\n<p>From<br \/>\nthe statement of Joitabhai Lalaji, brother of the convict it is borne<br \/>\nout that the present convict and Savitaben were residing as husband<br \/>\nand wife, but as the convict did not have any relation whatsoever<br \/>\nwith his brothers and sisters, nobody knew whether he had in fact<br \/>\nmarried Savitaben.  Not only that they did not know the whereabouts<br \/>\nof other relatives of Savitaben.  It is also stated by this Joitabhai<br \/>\nLalaji that, much prior to the incident of murder for which the<br \/>\npresent convict is undergoing sentence said Savitaben leaving behind<br \/>\na son, then aged 1 year had left the present convict; that  son was<br \/>\nkept by Joitabhai Lalaji with him and for the last about 5 years<br \/>\nJoitabhai Lalaji has shifted to Village Hindupur and kept son-Sunil<br \/>\nwith him.  It is stated that today the age of that son-Sunil is about<br \/>\n10 years.\n<\/p>\n<p>4.\tThe<br \/>\npicture which emerges from the totality of the circumstances is that<br \/>\nthere in nobody to house the convict on his release from Jail. That<br \/>\nis the reason why, when he was granted furlough nobody turned up to<br \/>\nbe his surety and therefore, he could not enjoy that furlough.\n<\/p>\n<p>5.\tTaking<br \/>\nthis case to be a case of peculiar nature, this Court is of the<br \/>\nopinion that the present convict be released on temporary bail for<br \/>\ntwo days with Police escort at the cost of the State so as to enable<br \/>\nthe convict to revive\/ have some contact and to get somebody prepared<br \/>\nto be his surety so that he can enjoy furlough.  At present, it<br \/>\nappears that the convict is totally cut of from the society as<br \/>\nneither his brothers nor his sisters are keeping relations with him.<br \/>\nHis wife has already deserted him about 10 years before.  It is good<br \/>\nthat Joitabhai Lalaji has maintained his son, Sunil for all these<br \/>\nyears.  Only with a view to see that this person is able to find some<br \/>\nplace in the society, it is deemed fit that he be granted temporary<br \/>\nbail.\n<\/p>\n<p>By<br \/>\nnow he has already undergone 4 years, 1 month and 22 days of<br \/>\nimprisonment since the date of his arrest, viz. 03.01.2007 and he has<br \/>\nnot enjoyed any furlough, parole or temporary bail, though a furlough<br \/>\nwas granted. Therefore, in the facts of this case this order is<br \/>\npassed.\n<\/p>\n<p>6.\tThe<br \/>\napplicant- appellant- original accused has been convicted for the<br \/>\noffences punishable under section 302 of the IPC and section 135 of<br \/>\nthe Bombay Police Act to suffer imprisonment for life with fine of<br \/>\nRs.1500\/-, in default, to undergo a further sentence of  9 months in<br \/>\nSessions Case No.72 of 2007 rendered by the learned Judge, Fast Track<br \/>\nCourt No.6, Modasa.\n<\/p>\n<p>7.\tThe applicant- appellant-\n<\/p>\n<p>convict is ordered to be released on  temporary bail for 2 (two)<br \/>\ndays with Police escort at the cost of the State from the<br \/>\ndate of his release  on his  executing a personal bond of Rs.5000\/-<br \/>\n(Rupees five thousand only) to the satisfaction of the Jail<br \/>\nauthorities.\n<\/p>\n<p>8.\tThe applicant shall<br \/>\nsurrender himself to the Jail authorities on expiry of the above<br \/>\ntemporary bail period.\n<\/p>\n<p>9.\tThe application is<br \/>\nallowed.  \tRule is made absolute.\n<\/p>\n<p>(RAVI<br \/>\nR.
