Thakkar, J) passed the<br \/>\n\tfollowing order :\n<\/p>\n<p> Notice<br \/>\nreturnable on 29th November 1995.\n<\/p>\n<p>By<br \/>\nway of ad-interim relief, it is open to the respondents to deduct an<br \/>\namount of Rs.960\/- instead of Rs.1920\/- as ordered in Office Order<br \/>\ndated September 28, 1995.  The above recovery however, will be<br \/>\nsubject to the result of the petition and without prejudice to the<br \/>\nrights and contentions of the petitioner. Direct Service is<br \/>\npermitted.\n<\/p>\n<p>Thus,<br \/>\n\tthe petitioner has been granted ad interim relief by this Court and<br \/>\n\tthe respondents were directed to deduct an amount of Rs.960\/- i.e.<br \/>\n\teconomic rent from the petitioner. Thereafter, when the present<br \/>\n\tpetition came up for admission hearing on 19th July 1996,<br \/>\n\tthis Court (Coram : R.M. Doshit, J) passed the following order:\n<\/p>\n<p> Rule.\n<\/p>\n<p>Ad-interim<br \/>\norder made earlier shall continue till further order. Respondents are<br \/>\ndirected to file their affidavit-in-reply to the petition, if any,<br \/>\nbefore 30.12.1996.\n<\/p>\n<p>It<br \/>\n\tis submitted by the learned<br \/>\n\tadvocate for the petitioner<br \/>\n\tthat in compliance of the aforesaid interlocutory order dated 14th<br \/>\n\tNovember 1995, the petitioner<br \/>\n\thas been granted the reliefs as directed by this Court. In view of<br \/>\n\tthe same, in my opinion, it would not be appropriate for this Court<br \/>\n\tto disturb the said order passed in the year 1995 at<br \/>\n\tthis stage after a period of almost 15 years. The<br \/>\n\tinterest of justice would be met by disposing of the matter by<br \/>\n\tsuitable directions to the parties.\n<\/p>\n<p>It<br \/>\n\tis pertinent to note that in view of the aforesaid orders, the<br \/>\n\trespondents have been recovering the aforesaid amount i.e. Rs.960\/-<br \/>\n\twhich is the economic rent, from the petitioner. It is required to<br \/>\n\tbe noted that till date no application vacating the ad interim<br \/>\n\trelief as well as the interim relief has been preferred by the<br \/>\n\trespondents. It is relevant to note that looking to the record, it<br \/>\n\ttranspires that there is no affidavit-in-reply on record of the<br \/>\n\tpetition.\n<\/p>\n<p>In<br \/>\n\tview of aforesaid observations and discussion, the present petition<br \/>\n\tis hereby allowed. The impugned orders dated 26th August<br \/>\n\t1994 as well as 28th September 1995 are hereby quashed<br \/>\n\tand set aside and the same are modified to the effect that the<br \/>\n\trespondents will recover the economic rent from the petitioner i.e.<br \/>\n\tRs.960\/- per month from the petitioner in respect of the quarter<br \/>\n\toccupied by him. The<br \/>\n\tparties will be governed by the aforesaid interlocutory order<br \/>\n\trendered by this Court. Rule is made absolute to the<br \/>\n\taforesaid extent.
