Ramachandran Nair, J.\n<\/p>\n
      Heard standing counsel appearing for the appellant and counsel<\/p>\n
appearing for the claimant-respondent, and also standing counsel<\/p>\n
appearing for the fourth respondent. The claimant is 70 year old lady<\/p>\n
who lost her son aged 27 years, in the accident. Though the Claim<\/p>\n
Petition was filed under Section 166, it was later converted into a claim<\/p>\n
under Section 163A of the Act. The MACT awarded compensation<\/p>\n
going by the formula stated in the Second Schedule.             The total<\/p>\n
compensation granted is Rs. 2,04,500\/-. The MACT held that since it<\/p>\n
is a claim awarded under Section 163A, liability has to be shared<\/p>\n
between the insurance companies.             However, there is a specific<\/p>\n
direction to the appellant to deposit the entire amount and recover 50%<\/p>\n
from the fourth respondent.\n<\/p>\n
      2. We have heard Sri. Rajan P Kalliyath, counsel appearing for<\/p>\n
the appellant, who cited before us the decision of the Supreme Court in<\/p>\n
                                   2<\/span><\/p>\n
RAMESH SINGH V. SBBIR SINGH, (2008) ACC 765 (SC) wherein<\/p>\n
the Supreme Court held that Second Schedule prescribed under Section<\/p>\n
163A does not contain static principle and if the claimants are fairly<\/p>\n
old, the Tribunal should not grant compensation going by the age of the<\/p>\n
victim. Counsel for the appellant heavily relied on the age of the<\/p>\n
claimant, who was 70 years of age as on the date making Claim<\/p>\n
Petition, and according to him, the multiplier applicable going by her<\/p>\n
age is only 5 as against 10 taken in this case, under the Second<\/p>\n
Schedule. He further pointed out that even in a Section 166 claim,<\/p>\n
eligible compensation would have been lesser because the multiplier<\/p>\n
would have been only 5 and reduction in dependency should also be<\/p>\n
taken after the normal age of marriage of the victim who was 27 years<\/p>\n
at the time of his death. Counsel for the claimant on the other hand<\/p>\n
contended that whatever be the contentions raised, the total<\/p>\n
compensation granted for the death of 27 year old son of the claimant<\/p>\n
on whom she was depending for her livelihood is only Rs. 2,04,500\/-.<\/p>\n
He further pointed out that if the claim was proceeded under Section<\/p>\n
166, compensation would have been claimed under other heads, which<\/p>\n

is not the case herein, where the claim is considered and awarded under<\/p>\n
Section 163A. Eventhough we find force in the various contentions<\/p>\n
raised by counsel for the appellant, we do not think any interference is<\/p>\n
called for in this case because the total compensation awarded is Rs.<\/p>\n
2,04,500\/- only. Even in the case of death of a very tender child, we<\/p>\n
have noticed that courts have been granting compensation around Rs. 2<\/p>\n
lakhs. Further, even going by the decision of the Supreme Court cited<\/p>\n
by the appellant, wherein the Supreme Court says that life expectancy<\/p>\n
of the claimant should also be reckoned while fixing the multiplier.<\/p>\n
We find that the claimant who was 70 years of age at the time of filing<\/p>\n
of the Claim Petition in the year 1998 is still alive which means that she<\/p>\n
is 81 years of age now. Therefore going by the expectancy of life of<\/p>\n
the claimant, which factually stands proved, we do not find any ground<\/p>\n
to interfere with the multiplier applied on the facts of this case. We<\/p>\n
therefore leave open the contentions raised by the appellant to be raised<\/p>\n
in appropriate case for exhorbitant awards which may not be tenable<\/p>\n
under Section 163A.\n<\/p>\n
      3. We do not find any logic in the MACT directing the appellant<\/p>\n
                                   4<\/span><\/p>\n
to deposit the entire amount after noticing that the liability is to be<\/p>\n
shared between the two insurance companies.      We therefore modify<\/p>\n
the award directing both the insurance companies to deposit 50% of the<\/p>\n
amount awarded with proportionate interest.\n<\/p>\n
     The Appeal is dismissed, but with the above observations.<\/p>\n
