No.20927 of 2010\n                          KANHAI SAHANI\n                              Versus\n                       THE STATE OF BIHAR\n                           -----------\n<\/pre>\n<p>2   25.06.2010        Heard learned counsel appearing on behalf<\/p>\n<p>                 of the petitioner and learned counsel appearing<\/p>\n<p>                 on behalf of the State.\n<\/p>\n<p>                       The      petitioner       is       in         custody     in<\/p>\n<p>                 connection with Dariyapur P.S. No. 25 of 2010<\/p>\n<p>                 for offences punishable under Section 366(A)\/34<\/p>\n<p>                 of the Indian Penal Code.\n<\/p>\n<p>                           Learned     counsel     for     the         petitioner<\/p>\n<p>                 submits that records of the proceedings itself<\/p>\n<p>                 demonstrates    that    the     girl     was        major.     He<\/p>\n<p>                 further     submits    that     the     Court        below     has<\/p>\n<p>                 noticed in the impugned order that the date of<\/p>\n<p>                 birth entered in the certificate of the school<\/p>\n<p>                 concerned is 5.2.1991 and which makes the girl<\/p>\n<p>                 about 19 years.        He further submits that the<\/p>\n<p>                 girl herself admits to be 18 years of age.                      He<\/p>\n<p>                 further     submits    that     during        the     course    of<\/p>\n<p>                 supervision     it    appears     that        a     love   affair<\/p>\n<p>                 between the petitioner and the victim girl has<\/p>\n<p>                 come to light.        It is further stated that the<\/p>\n<p>                 medical officer has reported absence of recent<\/p>\n<p>                 sexual intercourse and that even the girl had<br \/>\n<span class=\"hidden_text\">                             2<\/span><\/p>\n<p>          admitted      that       there          was         no   physical<\/p>\n<p>          relationship.
