    The complainant in S.T.No.1058\/1996 on the file<\/p>\n
of  Judicial   First  Class   Magistrate’s   Court,<\/p>\n
Nilambur filed this appeal challenging the order of<\/p>\n
acquittal. Appellant filed a complaint against the<\/p>\n
first respondent alleging that on 5.1.1996, first<\/p>\n
respondent borrowed Rs.45,000\/- and towards its<\/p>\n
repayment, issued Exhibit P1 cheque drawn in his<\/p>\n
account showing the date 21.3.1996 and when the<\/p>\n
cheque  was  presented   for  encashment,  it   was<\/p>\n
dishonoured for want of sufficient funds and in<\/p>\n
spite  of  issuing  notice  demanding  the   amount<\/p>\n
covered by the dishonoured cheque, first respondent<\/p>\n
did not pay the amount and thereby, he committed<\/p>\n
the  offence  under   Section  138  of   Negotiable<\/p>\n
Instruments Act.\n<\/p>\n
    2.  First   respondent  pleaded   not   guilty.<\/p>\n
Appellant was examined as PW1 and marked Exhibits<\/p>\n
CRA 206\/03               2<\/span><\/p>\n
P1 to P7. First respondent was examined as DW1.<\/p>\n
     3. First respondent contended that he did not<\/p>\n
borrow Rs.45,000\/- and did not issue Exhibit P1<\/p>\n
cheque towards discharge of any debt or liability<\/p>\n
and instead, he had borrowed Rs.15,000\/- and issued<\/p>\n
a signed blank cheque as security at that time and<\/p>\n
he had subsequently paid the amount, but, demanding<\/p>\n
Rs.5,000\/- as interest, the cheque was not returned<\/p>\n
and after filling up that cheque, it was presented<\/p>\n
and got it dishonoured and therefore, he is not<\/p>\n
liable to be convicted.\n<\/p>\n
     4. Learned Magistrate, on the evidence, found<\/p>\n
the first respondent not guilty. Learned Magistrate<\/p>\n
found that as per the complaint, the cheque was not<\/p>\n
issued subsequently when repayment was demanded and<\/p>\n
from the evidence of PW1, it is not proved that<\/p>\n
Exhibit P1 cheque was issued towards discharge of<\/p>\n
any debt or liability.\n<\/p>\n
     5. Argument of the learned counsel is that<\/p>\n
evidence of the first respondent as DW1 establishes<\/p>\n
that there were several witnesses when he borrowed<\/p>\n

the amount and issued the the cheque and none of<\/p>\n
them was examined and on the evidence, learned<\/p>\n
Magistrate was not justified in acquitting the<\/p>\n
first respondent.\n<\/p>\n
     6. I have gone through the pleadings in the<\/p>\n
complaint and the evidence of the appellant as PW1<\/p>\n
and first respondent as DW1. As rightly found by<\/p>\n
the   learned Magistrate,  on  a  reading  of  the<\/p>\n
complaint, it is evident that the case of the<\/p>\n
appellant   was that   first  respondent  borrowed<\/p>\n
Rs.45,000\/- on 5.1.1996 and towards its repayment,<\/p>\n
the dishonoured cheque was issued. The case is not<\/p>\n
that when first respondent failed to pay that<\/p>\n
amount and appellant demanded the amount, Exhibit<\/p>\n
P1 cheque was issued. On the other hand, the<\/p>\n
averment in the complaint is only to the effect<\/p>\n
that cheque was also issued on the date of borrowal<\/p>\n
itself. When PW1 was examined, his case was that<\/p>\n
first respondent borrowed Rs.45,000\/- on 5.1.1996<\/p>\n
promising to repay the same after two months and<\/p>\n
when it was not paid, he demanded the amount and<\/p>\n

then Exhibit P1 cheque was issued. Even then,<\/p>\n
evidence is not that the cheque was issued on<\/p>\n
21.3.1996,    but,  the  cheque  showing  the   date<\/p>\n
21.3.1996 was issued, which indicates that the<\/p>\n
cheque was not issued on 21.3.1996. On the evidence<\/p>\n
on   record,   the  order  of  acquittal  cannot be<\/p>\n
interfered.\n<\/p>\n
     7.   It is  the  specific  case  of  the  first<\/p>\n
respondent that he did not issue Exhibit P1 cheque<\/p>\n
towards    discharge of   Rs.45,000\/-  borrowed  and<\/p>\n
instead, it was issued as a signed blank cheque at<\/p>\n
the time when he borrowed Rs.15,000\/-. The case is<\/p>\n
that except the signature, nothing was written in<\/p>\n
the   cheque   at  that  time.  When  appellant  was<\/p>\n
examined as PW1, it was suggested that the cheque<\/p>\n
was   issued  without  writing  as  security.  True,<\/p>\n
appellant    denied  it.  But,   neither  in   chief<\/p>\n
examination nor in cross-examination, PW1 had a<\/p>\n
case that the cheque was written and brought before<\/p>\n
him and it was signed in his presence and handed<\/p>\n
over    to  him.  He  had  only  stated  that  first<\/p>\n

respondent issued the cheque. In cross-examination,<\/p>\n
PW1 admitted that the handwriting in Exhibit P1<\/p>\n
cheque is different from the signature. So also,<\/p>\n
the ink. When first respondent was examined, in<\/p>\n
chief examination, he deposed that he had handed<\/p>\n
over Exhibit P1 cheque after putting his signature<\/p>\n
alone and nothing was written in the cheque at that<\/p>\n
time.     Still, that  evidence  of   DW1  was  not<\/p>\n
challenged     in cross-examination.  When   it  is<\/p>\n
appreciated in the light of the admission of the<\/p>\n
appellant that the handwriting and the ink used for<\/p>\n
writing the cheque and putting the signature are<\/p>\n
different, it can only be found that appellant did<\/p>\n
not establish that Exhibit P1 cheque was issued by<\/p>\n
the first respondent towards discharge of any debt<\/p>\n
or liability. In such circumstances, I find no<\/p>\n
reason to interfere with the order of acquittal.<\/p>\n
     Appeal fails and it is dismissed.<\/p>\n
