JUSTICE MOHIT S. SHAH)<\/p>\n<p>\tIn<br \/>\nthis petition under Article 226 of the Constitution, the petitioners<br \/>\nhad challenged the constitutional validity of the Gujarat Provision<br \/>\nfor Disqualification of Members of Local Authorities for Defection<br \/>\nAct, 1986 and the rules framed thereunder being the Gujarat Provision<br \/>\nfor Disqualification of Members of Local Authorities for Defection<br \/>\nRules, 1987. The petitioners had also prayed for quashing the<br \/>\nproceedings under the said Act and Rules being Application Nos.65 to<br \/>\n72 of 1987 which were then pending before respondent No.3<br \/>\nSecretary to the Government of Gujarat, General Administration<br \/>\nDepartment and prayed for permanent injunction to restrain the said<br \/>\nauthority from proceeding with the said inquiry.\n<\/p>\n<p>2.\tWhile<br \/>\nadmitting the petition on 15.4.1991, interim relief as prayed for was<br \/>\nrefused and this Court had specifically observed that the proceedings<br \/>\npending before respondent No.3 shall proceed further in accordance<br \/>\nwith law.\n<\/p>\n<p>3.\tWith<br \/>\npassage of time, the petition has obviously become infructuous as the<br \/>\nterm for which the petitioners were elected as members of the Bagasra<br \/>\nMunicipality came to an end long back by efflux of time.\n<\/p>\n<p>4.\tOn<br \/>\nthis short ground alone, this petition is dismissed as infructuous.<br \/>\nRule is discharged.\n<\/p>\n<p>5.\tIt<br \/>\nis also required to be noted that challenge to the constitutional<br \/>\nvalidity of  Gujarat Provision for Disqualification of Members of<br \/>\nLocal Authorities for Defection Rules, 1987 was turned down by this<br \/>\nCourt in <a href=\"\/doc\/1508312\/\">Devabhai Parbatbhai Avadia &amp; Ors. vs. P.D.
