RESPONDENTS<\/pre>\n<p>   S&#8217;1:i,Satish R Girji, HCGP for R1<br \/>\n_&#8217;  &#8216;R2&#8217;&#8211;is&#8221;served)<\/p>\n<p>This Criminal Petition is \ufb01led under Section 482 Cr.P.C.<br \/>\npraying to quash the proceedings initiated by the Respondent&#8211;1<br \/>\nin FIR No.171\/09 dated 30.11.2009 on the file of the ACJ<br \/>\n{JR.DVN) &amp; JMFC court, Bantwal and this Criminal Petition be<br \/>\nallowed with costs throughout. 1 <\/p>\n<p>This petition coming on for admission this <\/p>\n<p>made the following:\n<\/p>\n<p>ORDEE<\/p>\n<p>Petitioner has sought for_~quashing'&#8221;of the<\/p>\n<p>Crime N0_171\/2009 dated 30th&#8221;&#8221;N:o&#8217;vember&#8221;  registered bf V<\/p>\n<p>the Vittal Police, D.K.&#8217;i\u00a7istrict&#8217;;d&#8217;mf(51&#8217;*:lj\ufb02ld\u00e9&#8217;-.. Qff\u20acI10\u00e9&#8217;S &#8220;liu\ufb02ishabl\ufb01<\/p>\n<p>under Sections 464, 465,   34 of IPC.\n<\/p>\n<p>2. Res\u00abpovndetit.&#8217;_   c.gir:;;\u00a7iaittaht alleged that, the<br \/>\naccused   document created an entry<br \/>\nin his lavotn&#8217;  the grantee of the land in the<\/p>\n<p>year 1900 and&#8221;  mutation was effected in<\/p>\n<p> V. No.D\u00a7CDR.: 164\/P8009801 and there is no grant..<\/p>\n<p>0  V    Counsel for the petitioner submits that,<\/p>\n<p>  bundle of false statements, as the detail facts<\/p>\n<p> are n~ot&#8217;;stated and material avennents are not made. He<\/p>\n<p>reierred to W.P.No.30920\/2000 filed by the father of the<\/p>\n<p>&#8216;second respondent wherein he had sought for a direction to<\/p>\n<p>make an enquiry in respect of very mutation i.e., DCDR<\/p>\n<p>164\/1980&#8211;8l. However, this court after hearing found that the<\/p>\n<p>matter is purely civil in nature and dismissed the writ petition.<br \/>\nThe allegation that the Assistant Commissioner and the<br \/>\nDeputy Commissioner have confirmed his grant is also as<br \/>\nthe detail enquiry was held under Rule 25 of the<br \/>\nRules as regard to the grant made in favour<br \/>\nand others and the Deputy<br \/>\n9.8.2004 has found that the p&#8217;etitione&#8217;r_:vis alsopia.<br \/>\nordered for podi of the land  _order.l.has;&#8217;.}\/reeomel \ufb01nalr<br \/>\nHe submitted that, wherrthe  been resolved on<br \/>\nthe revenue side and  father of the<br \/>\nsecond  the complaint is<\/p>\n<p>filed as an after-ijthouglit  petitioner.<\/p>\n<p> The  eomplaint relates to the same<\/p>\n<p>mutation entry,   the subject matter of the writ<\/p>\n<p> peti\u00bbtion.i&#8217;~ Thisn\ufb02ourt has observed that the matter is purely<\/p>\n<p> \u00bboivi1._ i1:,Vvnatuareeand has dismissed the writ petition. Further,<\/p>\n<p>lllthehr-Deputy.__Commissioner&#8217;s order under Rule 25 of the Land<\/p>\n<p>Grant Rules; also reveals that, the petitioner is a grantee. if<\/p>\n<p> that isdlso, prima facie if there is any dispute, it has to be<\/p>\n<p>resolved before the civil court not in private complaint. in my<\/p>\n<p>id  &#8216;opinion, the proceedings are misconceived. 3,&#8217;<br \/>\nx3 &#8216;<\/p>\n<p>Accordingiy, the petition is allowed.
