JUSTICE ABHILASHA KUMARI\n\t\t\n\t\n\n \n\nDate\n: 05\/10\/2010 \n\n \n\n \nCOMMON\nORAL ORDER<\/pre>\n<p>(Per<br \/>\n: HONOURABLE MR.JUSTICE D.H.WAGHELA)<\/p>\n<p>1.\tRULE.\n<\/p>\n<p>Learned AGP waives service for opponent Nos. 1 and 3. None present<br \/>\nfor opponent No. 2, though served.\n<\/p>\n<p>2.\tBy<br \/>\nway of the present group of review applications, the applicants,<br \/>\noriginal petitioners, have prayed for recalling the common oral<br \/>\njudgement dated 20.01.2010 in Special Civil Application No. 9599 of<br \/>\n2008 with Special Civil Applications No. 12690 to 12694 of 2008.\n<\/p>\n<p>3.\tIt<br \/>\nwas argued by learned counsel, Mr. P.M.Bhatt appearing for the<br \/>\napplicants, and fairly conceded, after verification of the record, by<br \/>\nlearned AGP that the major issue before the Court in the main<br \/>\npetitions was related to service of the award and issuance of the<br \/>\nnotice in time upon the petitioners in compliance with the provisions<br \/>\nof Section 12 of the Land Acquisition Act, 1894. The Court was<br \/>\ninclined to accept the say of learned AGP that the petitioners were<br \/>\naware of the award and had also countersigned the Rojkam, leading to<br \/>\nthe conclusion that original petitioners were informed about the<br \/>\naward as early as on 18.04.2001. It was, however, seen from the<br \/>\nrecord that no counter-affidavit was filed in any of the petitions,<br \/>\nexcept Special Civil Application No. 9599 of 2008, and no countersign<br \/>\nof any of the petitioners was found on the Rojkam as alleged on<br \/>\nbehalf of the respondent. The aspects of delay after making of the<br \/>\naward and the period between the date of award and issuance or<br \/>\nservice of notice under Section 12 of the Land Acquisition Act were<br \/>\nnot considered at all though raised by the petitioner. Under such<br \/>\ncircumstances, it appears to be necessary and in the interest of<br \/>\njustice that the judgement sought to be reviewed is recalled so as to<br \/>\nafford to the parties full opportunity of being heard on the issues<br \/>\nraised and arising in the main petitions.
