C. Sharma\nRespondent:          Deputy Commissioner Police (DCP) Vigilance\n\n\nFACTS<\/pre>\n<p>       By an application of 1.3.2007 Shri S. C. Sharma an advocate of Patiala<br \/>\nHouse Court, Delhi applied to Shri K. K. Paul, IPS, Commissioner of Police ,<br \/>\nDelhi seeking the following information:\n<\/p>\n<blockquote><p>       A.     What is the status of the above complaint and day to day<br \/>\n              progress made in investigating this matter and outcome<br \/>\n              of the vigilance inquiry by Police.\n<\/p><\/blockquote>\n<blockquote><p>       B.     Particulars of the instruction of the Delhi Police\/ DOPT<br \/>\n              and CVC under which the complainants\/ representation in<br \/>\n              vigilance matters are not even acknowledged and the<br \/>\n              complainant is kept in the dark about the outcome of the<br \/>\n              vigilance enquiry made by the police.<\/p><\/blockquote>\n<p>       C.     Number of vigilance complainants received against the<br \/>\n              SHO and Staff of the Police Station, Mayur Vihar, during<br \/>\n              the last 3 years and how many vigilance complaints have<\/p>\n<p>       This information related to a complaint made by Dr. C. M. Bhan, Senior<br \/>\nConsultant, RML hospital, Delhi. To this Shri S. C. Sharma received a<br \/>\nresponse from Shri M. R. Gothwal, PIO, Vigilance Delhi dated 16.4.&#8217;07,<br \/>\nreceived by the latter on 15.3.&#8217;07 from Police HQ, as follows:-\n<\/p>\n<blockquote><p>       &#8220;It is stated that the complaint filed by Dr. C. M. Bhan, r\/o A-102,<br \/>\n       Manas Apartments, Mayur Vihar, Phase I, Delhi 110091 was<br \/>\n       dealt by the office of ACP\/PG Cell East Disst., Delhi. A total<br \/>\n       number of 157 complaints were received in this office against<br \/>\n       the staff of the Police Station Mayur Vihar during the last 3 years<br \/>\n       i.e. 1.1.2004 to till date). 12 complaints were enquired by this<br \/>\n       branch and remaining complaints were sent to concerned Distt\/<br \/>\n       Unit for appropriate action. Outcome of these enquiries were<br \/>\n       not sent to the complainant, as they have not requested for the<br \/>\n       same.&#8221;<\/p><\/blockquote>\n<p>       Not satisfied Shri S. C. Sharma moved his first appeal on 3.5.2007<br \/>\nspecifically on the following grounds:-\n<\/p>\n<p><span class=\"hidden_text\">                                          1<\/span><\/p>\n<blockquote><p>        &#8220;1.    That the information furnished by Delhi Police vide letter<br \/>\n              dated 16.4.2007 copy enclosed is incomplete and<br \/>\n              misleading and the complete information has not been<br \/>\n              furnished in respect of action taken against S. I. &amp; SHO,<br \/>\n              Mayur Vihar, on application given by dr. C. M. Bhan to<br \/>\n              Shri K. K. Paul Police commissioner personally.\n<\/p><\/blockquote>\n<blockquote><p>       2.     That no information has been supplied in respect of the<br \/>\n              letter sent by Dr. C. M. Bhan to the police commissioner<br \/>\n              in respect of the seepage problems in his flat and<br \/>\n              outcome of the vigilance inquiry against S. I. and SHO<br \/>\n              and the reasons why the complainant has been kept in<br \/>\n              the dark of the fate of the vigilance inquiry.&#8221;<\/p><\/blockquote>\n<p>       However, Shri R. P. Upadhyaya, First Appellate Authority found as<br \/>\nfollows in his order of 16.5.2007.\n<\/p>\n<blockquote><p>       &#8220;As per the records, the PIO\/ Vigilance has provided you all the<br \/>\n       information available with him, that could be provided under the<br \/>\n       provisions of the RTI Act. You can approach the office of PIO\/<br \/>\n       East District, situated at Vishwas Nagar, Shahadra for<br \/>\n       information regarding the complaint of Dr. C. M. Bhan, referred<br \/>\n       to by you in your application, as the complaint was dealt with by<br \/>\n       that office. There is no fresh grounds in the appeal to interfere<br \/>\n       with the orders of the PIO\/ Vigilance.&#8221;<\/p><\/blockquote>\n<p>       Appellant&#8217;s prayer before us in his second appeal, therefore, is as<br \/>\nbelow:-\n<\/p>\n<blockquote><p>       &#8220;That having failed to get the correct information from Delhi<br \/>\n       Police and the failure of the CPIO and the Appellate<br \/>\n       authority in furnishing the requisite information which I<br \/>\n       have sought in public interest u\/s 2 (f) of the RTI Act 2005. I<br \/>\n       am preferring second appeal u\/s 19 (3) of the RTI Act 2005.&#8221;\n<\/p><\/blockquote>\n<p>The appeal was heard on 5-12-08. The following are present.\n<\/p>\n<p>       Appellant<br \/>\n       Shri S. C. Sharma.\n<\/p>\n<p>       Respondent<br \/>\n       Shri Mahendra Nath Tiwari, DCP\/ Vig.\n<\/p>\n<p>       The request for information was examined point wise with both parties.<br \/>\nIt is found that only question at C has received a complete answer. Shri M. N.<br \/>\nTiwari, DCP, Vigilance submitted that the complaint of Dr Bhan had been<br \/>\ntransferred to ACP, East District, Delhi. He was not able to answer why in<br \/>\nthat case the RTI application was also not similarly transferred as mandated<br \/>\nunder section 6 sub-section (3). Shri M. N. Tiwari did indeed explain the<\/p>\n<p><span class=\"hidden_text\">                                       2<\/span><br \/>\n particulars   of   the    practice   followed   on   receipt   of   complaints   and<br \/>\nrepresentations. However, this has not been provided in the PIO&#8217;s response<br \/>\nto the RTI application.\n<\/p>\n<p>                                DECISION NOTICE<\/p>\n<p>       From the above it is clear that only one out of the three questions<br \/>\nposed by appellant Shri S. C. Sharma have, in fact, been answered in full.<br \/>\nCPIO Shri M. N. Tiwari, DCP, Vigilance is therefore, directed to provide<br \/>\nanswer to questions A and B to appellant within 10 working days of the<br \/>\ndate of issue of this decision notice.\n<\/p>\n<p>       If the complaint of Dr. Bhan has indeed been transferred to the ACP,<br \/>\nEast District, because CPIO has not availed the opportunity to transfer the<br \/>\nRTI application to that office u\/s 6 (3 (i), he will now himself obtain the<br \/>\ninformation now sought and provide this together with the remaining<br \/>\ninformation to appellant Shri S. C. Sharma. Appeal is thus allowed. There<br \/>\nwill be no cost.\n<\/p>\n<p>       Announced in the hearing.
