     This is an application for anticipatory bail under Section 438<\/p>\n
of the Code of Criminal Procedure. The petitioner is accused No.3<\/p>\n
in  Crime    No.233\/2009     of   Venjarumoodu       Police Station,<\/p>\n
Thiruvananthapuram District.\n<\/p>\n
     2.    The offences alleged against the petitioner are under<\/p>\n
Sections 286 and 304 read with Section 34 of the Indian Penal<\/p>\n
Code and Sections 3, 5 and 6 of the Explosive Substances Act.<\/p>\n
     3.   When the Bail Application came up for hearing on<\/p>\n
08.01.2010, the following order was passed:<\/p>\n
                 “After having heard the learned counsel<\/p>\n
           for the petitioner and the learned Public<\/p>\n
           Prosecutor, I am of the view that before<\/p>\n
           disposing     of   the    Bail   Application,   an<\/p>\n
           opportunity should be given to the petitioner<\/p>\n
           to appear before the investigating officer.<\/p>\n
           Accordingly, there will be a direction to the<\/p>\n
           petitioner to appear before the investigating<\/p>\n
           officer at 9 A.M. on 12th and 13th January,<\/p>\n
           2010.\n<\/p><\/blockquote>\n

                      Post on 18.01.2010.\n<\/p><\/blockquote>\n
                      It is submitted by the learned Public<\/p>\n
                 Prosecutor that the petitioner will not be<\/p>\n
                 arrested until further orders in connection<\/p>\n
                 with Crime No.233\/2009 of Venjarumoodu<\/p>\n
                 Police Station, Thiruvananthapuram.<\/p>\n<\/blockquote>\n
                      The petitioner shall produce copy of this<\/p>\n
                 order before the investigating officer.<\/p>\n<\/blockquote>\n
                      Hand over copy to both sides.”<\/p><\/blockquote>\n
       4. It is submitted by the learned counsel for the petitioner<\/p>\n
and the learned Public Prosecutor that the petitioner has<\/p>\n
complied with the direction contained in the order dated<\/p>\n
08.01.2010.\n<\/p>\n
       5.      Taking into account the facts and circumstances of<\/p>\n
the case, the nature of the offence and other circumstances, I<\/p>\n
am of the view that anticipatory bail can be granted to the<\/p>\n
petitioner. There will be a direction that in the event of the<\/p>\n
arrest of the petitioner, the officer in charge of the police station<\/p>\n
shall release him on bail on his executing bond for Rs.15,000\/-<\/p>\n
with two solvent sureties for the like amount to the satisfaction<\/p>\n
of the officer concerned, subject to the following conditions:<\/p>\n
B.A. No. 5671 of 2009                 3<\/span><\/p>\n
          A) The petitioner shall         report    before     the
\n               investigating    officer  between 9 A.M and 11
\n               A.M. on alternate Mondays, till the final report is
\n               filed or until further orders;\n<\/p><\/blockquote>\n
          B) The      petitioner    shall   appear  before     the
\n               investigating officer for interrogation as and
\n               when required;\n<\/p><\/blockquote>\n
          C) The petitioner shall not try to influence the
\n               prosecution witnesses or tamper with the
\n               evidence.\n<\/p><\/blockquote>\n
          D) The petitioner shall not commit any offence or
\n               indulge in any prejudicial activity while on bail.<\/p>\n
          E) In case of breach of any of the conditions
\n               mentioned above, the bail shall be liable to be
\n               cancelled.<\/p><\/blockquote>\n
         The Bail Application is allowed to the extent indicated<\/p>\n
 above.\n<\/p>\n<\/p>\n
