PUBLIC PROSECUTOR for\nRespondent(s) : 1, \n=========================================\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE MD SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 08\/09\/2011 \n\n \n\nORAL\nORDER<\/pre>\n<p>1.\t\tThis<br \/>\napplication is preferred by the applicant under section 389 of the<br \/>\nCode of Criminal Procedure seeking bail pending appeal.\n<\/p>\n<p>2.\t\tThe<br \/>\napplicant is convicted by learned Special Judge, Vadodara by order<br \/>\ndated 19.03.2011 in Electricity (Special) Case No.75 of 2007 for the<br \/>\noffence punishable under section 135(1)(b) of the Electricity Act and<br \/>\nsentenced to undergo three years simple imprisonment and to pay fine<br \/>\nof Rs.6,44,193\/- and in default of payment of fine, to undergo<br \/>\nfurther three months simple imprisonment.\n<\/p>\n<p>3.\t\tThis<br \/>\nCourt on 27.04.2011 in Criminal Misc. Application No.4446 of 2011<br \/>\npassed following order :-\n<\/p>\n<p>&#8220;1.\n<\/p>\n<p>\tMs.Parul Joshi, learned counsel for the applicant, states that she<br \/>\n\tis not pressing the application at this stage with a liberty to file<br \/>\n\tfresh application if the appeal is not heard and decided within<br \/>\n\tthree months.\n<\/p>\n<p>2.<br \/>\n\tIn view of above, present application is disposed of as not pressed<br \/>\n\twith liberty to the applicant to file fresh application for bail, if<br \/>\n\tthe appeal is not heard and decided within a period of three<br \/>\n\tmonths.&#8221;\n<\/p>\n<p>4.\t\tIt<br \/>\nis submitted by learned advocate for the applicant that the applicant<br \/>\nis in jail since 19.03.2011.  It is further submitted that fine<br \/>\nimposed by the learned Trial Court is too harsh and it is not<br \/>\npossible for the applicant to pay the same.\n<\/p>\n<p>5.\t\tConsidering<br \/>\nthe fact that the applicant is in jail since last six months and that<br \/>\nthere is no possibility of appeal being disposed in near future,<br \/>\npresent application deserves to be allowed.\n<\/p>\n<p>6.\t\tIn<br \/>\nthe result application is allowed.  Applicant is ordered to be<br \/>\nreleased on bail on his furnishing personal bond of Rs.10,000\/-<br \/>\n(Rupees Ten Thousand only) with one solvent surety of the like amount<br \/>\nto the satisfaction of Trial Court and subject to the conditions that<br \/>\n: &#8211;\n<\/p>\n<p>(a)\tThe<br \/>\napplicant shall deposit Rs.2,15,000\/- (Rupees Two lac and  fifteen<br \/>\nthousand only) with the Trial Court within 10(ten) days from the date<br \/>\nof release.\n<\/p>\n<p>(b)\tThe<br \/>\napplicant shall not leave State of Gujarat without prior permission<br \/>\nof this Court.\n<\/p>\n<p>7.\t\tIf<br \/>\nbreach of any of the above conditions is committed,  present order<br \/>\npassed by this Court shall stand automatically cancelled.\n<\/p>\n<p>8.\t\tRule<br \/>\nis made absolute to the aforesaid extent. Application is disposed of<br \/>\naccordingly.
