Justice K.T.SANKARAN\n\n Dated :13\/10\/2010\n\n O R D E R\n                      K.T.SANKARAN, J.\n                 ---------------------------------------------\n                  W.P.(C).No.31326 of 2010\n                 ---------------------------------------------\n             Dated this the 13th day of October, 2010\n\n\n\n                           JUDGMENT\n<\/pre>\n<p>      In the manner in which I propose to dispose of the Writ<\/p>\n<p>Petition, I do not think it is necessary to issue notice to the<\/p>\n<p>fourth respondent.        Government Pleader takes notice for<\/p>\n<p>respondents 1 to 3.\n<\/p>\n<\/p>\n<p>      2.   The petitioner was appointed as HSA (Urdu) in<\/p>\n<p>Koodali High School from 30.7.2009 against the retirement<\/p>\n<p>vacancy of P.P.Ravindran, who retired on 31.3.2009 as Full Time<\/p>\n<p>HSA (Urdu). It is stated that P.P.Ravindran was appointed as<\/p>\n<p>L.G.Urdu Teacher in the U.P. Section of the school in the year<\/p>\n<p>1983; and in 1986, he was promoted as Full Time HSA (Urdu).<\/p>\n<p>The post against which the petitioner was appointed was not<\/p>\n<p>sanctioned by the District Educational Officer as per the Staff<\/p>\n<p>Fixation Order 2009-2010 evidenced by Exhibit P2. Challenging<\/p>\n<p>Exhibit P2, the petitioner filed Exhibit P8(a) revision under Rule<\/p>\n<p>12E of Chapter XXIII of the Kerala Education Rules.               The<\/p>\n<p><span class=\"hidden_text\">WPC No.31326\/2010                2<\/span><\/p>\n<p>revision is pending disposal.      Since Exhibit P8(a) was not<\/p>\n<p>disposed of, the petitioner filed Exhibit P9 dated 20.9.2010<\/p>\n<p>before the Government.\n<\/p>\n<\/p>\n<p>     3.    The reliefs prayed for in the Writ Petition are the<\/p>\n<p>following :\n<\/p>\n<blockquote><p>                 &#8220;(i) issue a writ of mandamus or other<\/p>\n<p>           appropriate     writ    order    or    direction<\/p>\n<p>           commanding the third respondent to grant<\/p>\n<p>           approval to Exhibit P1 appointment order.<\/p>\n<\/blockquote>\n<blockquote><p>                 (ii)   declare that the fourth respondent<\/p>\n<p>           school is entitled to have continuous sanction<\/p>\n<p>           for full-time post of High School Assistant<\/p>\n<p>           (Urdu).\n<\/p><\/blockquote>\n<blockquote><p>                 (iii) issue a writ of mandamus or other<\/p>\n<p>           appropriate     writ    order    or    direction<\/p>\n<p>           commanding the first respondent to effectively<\/p>\n<p>           consider and pass appropriate orders upon<\/p>\n<p>           Exhibit P9 after affording an opportunity of<\/p>\n<p>           being heard to the petitioner within a time<\/p>\n<p><span class=\"hidden_text\">WPC No.31326\/2010                3<\/span><\/p>\n<p>           limit.\n<\/p><\/blockquote>\n<blockquote><p>                 (iv) pass such other order or direction<\/p>\n<p>           which this Hon&#8217;ble Court may deem fit and<\/p>\n<p>           proper to grant in the circumstances of the<\/p>\n<p>           case.&#8221;<\/p><\/blockquote>\n<p>      4.   The learned counsel for the petitioner submitted that<\/p>\n<p>since Exhibit P8(a) revision is pending before the Director of<\/p>\n<p>Public Instruction, it is only proper that the Director of Public<\/p>\n<p>Instruction considers the revision on the merits.<\/p>\n<p>      In the facts and circumstances of the case, the Writ Petition<\/p>\n<p>is disposed of as follows :\n<\/p>\n<blockquote><p>      (a)  The Director of Public Instruction shall consider and<\/p>\n<p>           dispose of Exhibit P8(a) revision, as expeditiously as<\/p>\n<p>           possible and at any rate, within a period of three<\/p>\n<p>           months from the date of receipt of a copy of the<\/p>\n<p>           judgment, after affording an opportunity of being<\/p>\n<p>           heard to the petitioner, the Manager and any other<\/p>\n<p>           affected party.\n<\/p><\/blockquote>\n<blockquote><p><span class=\"hidden_text\">WPC No.31326\/2010                4<\/span><\/p>\n<\/blockquote>\n<blockquote><p>    (b)    The petitioner shall produce certified copy of the<\/p>\n<p>           judgment and a copy of the Writ Petition before the<\/p>\n<p>           Director of Public Instruction.<\/p>\n<\/blockquote>\n<blockquote><p>    (c)    The petitioner shall send a copy of the Writ Petition<\/p>\n<p>           and a copy of the judgment to the fourth respondent<\/p>\n<p>           Manager by registered post and the petitioner shall<\/p>\n<p>           produce proof of the same before the Director of<\/p>\n<p>           Public Instruction.<\/p><\/blockquote>\n<p>                                           K.T.SANKARAN<br \/>\n                                                 JUDGE<br \/>\ncsl<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Muhammed Iqbal Puthalath vs The State Of Kerala Represented By &#8230; on 13 October, 2010 IN THE HIGH COURT OF KERALA AT ERNAKULAM WP(C).No. 31326 of 2010(M) 1.
