No.34108 of 2011\n                  Shankar Paswan son of Mahendra Paswan\n                                   Versus\n                             The State Of Bihar\n                                  -----------\n<\/pre>\n<p>2.   13.10.2011                Heard learned Counsel for the petitioners and the<\/p>\n<p>                  State.\n<\/p>\n<p>                              The petitioners seek bail in a case instituted for the<\/p>\n<p>                  offence under Section 302\/34 of the Indian Penal Code and<\/p>\n<p>                  27 of the Arms Act.\n<\/p>\n<p>                             Considering that there is no eye witness to the<\/p>\n<p>                  actual murder and only material against the petitioners is that<\/p>\n<p>                  they were seen fleeing away from the place of occurrence, let<\/p>\n<p>                  the petitioners above named, be released on bail on<\/p>\n<p>                  furnishing bail bond of Rs. 5,000\/-(Five thousand) with two<\/p>\n<p>                  sureties of the like amount each or any other surety to be<\/p>\n<p>                  fixed by the court concerned to the satisfaction of learned<\/p>\n<p>                  A.D.J., F.T.C. 5th, Munger in connection with S.T. No.559 of<\/p>\n<p>                  2011 arising out of Jamalpur P.S. Case No.49 of 2011,<\/p>\n<p>                  subject to the conditions (i) That one of the bailor will be a<\/p>\n<p>                  close relative of the petitioners who will give an affidavit giving<\/p>\n<p>                  genealogy as to how he is related with the petitioners. The<br \/>\n<span class=\"hidden_text\">                                   -2-<\/span><\/p>\n<p>            bailor will undertake to furnish information to the Court about<\/p>\n<p>            any change in address of the petitioners. (ii) That the bailor<\/p>\n<p>            shall also state on affidavit that he will inform the court<\/p>\n<p>            concerned if the petitioners is implicated in any other case of<\/p>\n<p>            similar nature after their release in the present case and<\/p>\n<p>            thereafter the court below will be at liberty to initiate the<\/p>\n<p>            proceeding for cancellation of bail on ground of misuse, (iii)<\/p>\n<p>            That the petitioners will give an undertaking that they will<\/p>\n<p>            receive the police papers on the given date and be present on<\/p>\n<p>            date fixed for charge and if they fail to do so on two given<\/p>\n<p>            dates and delays the trial in any manner, their bail will be<\/p>\n<p>            liable to be cancelled for reasons of misuse, (iv) That the<\/p>\n<p>            petitioners will be well represented on each date if they fail to<\/p>\n<p>            do so on two consecutive dates, their bail will be liable to be<\/p>\n<p>            cancelled.\n<\/p>\n<\/p>\n<pre>Narendra\/                        ( Anjana Prakash, J. )\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Guddu Sah vs The State Of Bihar on 13 October, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.Misc.
